I would like to inspect the records regarding these\n        encroachments, please tell me the date, time and place\n        when I can inspect the records.\n\nGrounds for First Appeal:\nNo Reply was given till the date of filing of first appeal.\n Order of the FAA:\nNot mentioned.\n\nGround of the Second Appeal:\nUnsatisfactory information provided.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing held on April 1, 2011:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant : Mr. Dinesh Chand Jain;\n<\/p>\n<p>Respondent : Mr. Ravideep Singh Chahar, PIO &amp; Assistant Commissioner;\n<\/p>\n<p>        &#8220;The Respondent states that the RTI application was received on 18\/10\/2010 and information<br \/>\nwas sought from the Sanitary Inspectors (SI) of Ward 248, 250 &amp; 259. The information was received<br \/>\nform the SI of Ward 259 which was sent to the Appellant and no information had been received from<br \/>\nSIs of Ward no.248 and 250. After the order of the FAA on 03\/02\/2011 the respondents claim that the<br \/>\ninformation from two wards was sent on 10\/02\/2011 by speed post. They have produced the<br \/>\nphotocopies of the speed post receipt of that day. The Appellant claims that he has not received this<br \/>\ninformation. However, a duplicate copy of the information has again being given to the Appellant<br \/>\nbefore the Commission.&#8221;\n<\/p>\n<p>Decision dated April 1, 2011:\n<\/p>\n<p>The Appeal was allowed.\n<\/p>\n<p>      &#8220;The information available on the records has been provided.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\ndeemed PIOs &amp; Sanitary Inspectors of Ward no.248 and 250 within 30 days as required by the<br \/>\nlaw.\n<\/p>\n<p>From the facts before the Commission it is apparent that the deemed PIOs are guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30<br \/>\ndays, as per the requirement of the RTI Act.\n<\/p>\n<p>It appears that the deemed PIOs actions attract the penal provisions of Section 20 (1). A showcause<br \/>\nnotice is being issued to them, and they are directed give their reasons to the Commission to show<br \/>\ncause why penalty should not be levied on them.\n<\/p>\n<p>The deemed PIOs &amp; Sanitary Inspectors of Ward no.248 and 250 will present themselves before the<br \/>\nCommission at the above address on 29 April 2011 at 10.30AM alongwith their written submissions<br \/>\nshowing cause why penalty should not be imposed on them as mandated under Section 20 (1). They<br \/>\nwill also bring the information sent to the appellant as per this decision and submit speed post<br \/>\nreceipt as proof of having sent the information to the appellant.&#8221;\n<\/p>\n<p>Relevant facts emerging at the show cause hearing held on April 29, 2011:<br \/>\nThe following were present:\n<\/p>\n<p>Respondents: Mr. Vijendra Singh, SI (Ward No. 248), Mr. Shabuddin, SI (Ward No. 250) and Mr.<br \/>\nRaman Kumar, RTI Clerk.\n<\/p>\n<p>The Commission noted that the RTI application dated 03\/08\/2010 was received at the office of the PIO<br \/>\n&amp; AC on 18\/10\/2010 and forwarded to inter alia SI (Ward No. 248) and SI (Ward No. 250). Mr.<br \/>\nVijendra Singh stated that information was furnished by him vide letter dated 19\/11\/2010, which was<br \/>\nsent to the PIO &amp; AC via the Sanitation Superintendent on the same day. Mr. Raman Kumar stated<br \/>\nthat the reply prepared by SI (Ward No. 248) was not forwarded to the Appellant from the office of the<br \/>\nPIO &amp; AC and the person responsible for the same was Mr. Gyan Chand Sharma, UDC (now retired).\n<\/p>\n<p>Mr. Shabuddin stated that information was provided by him vide letter dated 02\/11\/2010. The said<br \/>\nreply was required to be sent to the PIO &amp; AC by the Sanitation Superintendent, who failed to do so<br \/>\nand therefore, the information furnished by SI (Ward No. 250) was not sent to the Appellant. Mr.<br \/>\nShabuddin stated that Mr. J. K. Gupta was the then Sanitation Superintendent.<br \/>\n Adjunct Decision announced on May 2, 2011:\n<\/p>\n<p>In view of the aforesaid, the Commission hereby directs Mr. Ravideep Singh Chahar, PIO &amp; AC, Mr.<br \/>\nJ. K. Gupta, the then Sanitation Superintendent, Mr. Vijendra Singh, SI (Ward No. 248), Mr.<br \/>\nShabuddin, SI (Ward No. 250), Mr. Raman Kumar, RTI Clerk and Mr. Gyan Chand Sharma, UDC<br \/>\n(now retired) to present themselves before this Commission on June 1, 2011 at 4:30 pm along with<br \/>\ntheir written submissions to show cause why penalty should not be imposed and disciplinary action<br \/>\nrecommended against them under Section 20 of the RTI Act.\n<\/p>\n<p>Further, they may serve this notice to any other official(s) who are responsible for the delay in<br \/>\nproviding the information, and may direct them to be present before the Commission along with them<br \/>\non the aforesaid scheduled date and time.
