No. 5927 of 2008 (O&amp;M)\n\n                                   Date of Decision: 14.1.2009.\n\nSanjeev Kumar and another\n                                              ....Petitioners\n           Versus\n\nMadan Lal and others\n                                               ...Respondents\n\nCORAM : Hon'ble Mr. Justice Rajesh Bindal\n\nPresent:- Mr.Gorakh Nath, Advocate\n          for the petitioners.\n\nRAJESH BINDAL, J.\n<\/pre>\n<p>                   ****<\/p>\n<p>           The challenge in the present revision petition is to the<\/p>\n<p>order passed by the learned Court below whereby the prayer for<\/p>\n<p>injunction was granted in favour of respondent\/plaintiffs.<\/p>\n<p>           Briefly, the facts are that the respondent\/plaintiffs filed a<\/p>\n<p>suit for injunction seeking restrain against the petitioners from<\/p>\n<p>carrying on the business of sale of meat on old place of business.<\/p>\n<p>Keeping in view the fact that Municipal Committee, Kalka had carved<\/p>\n<p>out a special market for sale of meat, the petitioners and private<\/p>\n<p>respondents, both were carrying on business of sale of meat at<\/p>\n<p>Gandhi Chowk, Kalka.       Though the plaintiffs had shifted to new<\/p>\n<p>market but the petitioner\/defendants had not shifted. It was noticed<\/p>\n<p>by learned Court below that in terms of provisions of Section 170 of<\/p>\n<p>the Haryana Municipal Act, 1973, a municipal committee is<\/p>\n<p>competent to fix any place for slaughter of animals and for sale of<\/p>\n<p>meat.   It is further provided therein that when any such separate<\/p>\n<p>location is identified, no person shall slaughter any animal for sale<br \/>\n<span class=\"hidden_text\"> C.R. No. 5927 of 2008 (O&amp;M                                  -2-<\/span><\/p>\n<p>within the municipal limit at any other place. The fact that new meet<\/p>\n<p>marked at different place had been constructed is not in dispute.<\/p>\n<p>                 Keeping these facts in view, the learned Court below has<\/p>\n<p>granted injunction in favour of respondent\/plaintiffs restraining the<\/p>\n<p>petitioners from carrying on the business at the old premises at<\/p>\n<p>Gandhi Chowk.
