Justice M.SASIDHARAN NAMBIAR\n\n Dated :26\/08\/2009\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.2154 of 2009\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    Petitioners are the accused in C.C.No.176\/2004 on<\/p>\n<p>the file of Judicial First Class Magistrate&#8217;s Court,<\/p>\n<p>North Paravur, taken cognizance for the offences under<\/p>\n<p>Sections 143, 147, 447, 427 and 506(i) read with<\/p>\n<p>Section 149 of Indian Penal Code on Annexure-II final<\/p>\n<p>report. This petition is filed under Section 482 of<\/p>\n<p>Code of Criminal Procedure to quash the proceedings<\/p>\n<p>pending before the Magistrate contending that in view<\/p>\n<p>of the settlement arrived at between the petitioners<\/p>\n<p>and respondents 2 to 4, it is not in the interest of<\/p>\n<p>justice to further prosecute the petitioners.<\/p>\n<p>    2. Respondents 2 to 4 appeared through a counsel<\/p>\n<p>and filed separate affidavits stating that they have<\/p>\n<p>already settled the disputes with the petitioners.<\/p>\n<p>    3. Prosecution case, as seen from Annexure-II<\/p>\n<p>final report, is that petitioners formed themselves<\/p>\n<p>into an unlawful assembly with the common object of<\/p>\n<p>committing house trespass and causing damages to the<\/p>\n<p><span class=\"hidden_text\">CRMC 2154\/09               2<\/span><\/p>\n<p>property of the first respondent and in furtherance of<\/p>\n<p>the   common  object,  on  29.1.2004,  committed  house<\/p>\n<p>trespass and intimidated respondents 2 to 4 and thereby<\/p>\n<p>committed the alleged offences.\n<\/p>\n<p>     4.   Affidavits  filed  by  respondents  2   to  4<\/p>\n<p>establish that there was a settlement of the disputes<\/p>\n<p>with the petitioners. When the offences alleged against<\/p>\n<p>the  petitioners   are purely  personal  in  nature  as<\/p>\n<p>against respondents 2 to 4 and all the disputes were<\/p>\n<p>settled between them, as held by the Apex Court in<\/p>\n<p><a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008 (3) KLT 19),<\/p>\n<p>it is not in the interest of justice to continue the<\/p>\n<p>prosecution,   when,  ultimately,  consequent   to  the<\/p>\n<p>settlement, possibility of a successful prosecution is<\/p>\n<p>very bleak.\n<\/p>\n<p>     Petition is allowed.
