Tl'_:e..il:3'rief  of the case are that the first petitioner\n\n:i':\"is___a_reeiste'red  Trust, which runs the second petitioner\n\n4' .\u00a2'ol'lege.  joetihtiloners No.3 to 16 are the members of the\n\n teeo_hin_'gxe'nd._Anon-teaching staff of the second petitioner College.\n\n   oetitloner College was receiving the salary grant.\n\n ~ University Grants Commission of India established\n\nNetional Assessment and Accreditation Council ['N.A.A.C.' for\n\nRBI-1\n\n\n\nshort] to assess and accredit institutions of hiqher.Vsoocati_oo\"    \n\nthe Country. The grading system was as ff'o|to'ws:.V \n\nThe Grading System\n\nGrade Iostita\ufb01onalt\ufb01wsk\u00e9 : V;\n  (uppertifmifoexclusive) \n\nA++  ' , - *  tt'sV\u00a7)5\u00a5:oooV:'  V\nA*  o V9Q@95V'..~,.:\".\n\nA    =\n\n4. ThuAs,.__t\"t1e accr\u00e9&amp;jit;o'd..:imi-ititutions were graded on a\nnine-point scaisf V'Enstitti'tio:ns, which did not obtain 55%\n\nscore '9ver.s'tfouE\u00e9'ci riot'_.quam'isd for accreditation.\n\n5;_ s*ctcowi:t3\u00a7It\"ofre\u00a7\u00a7;from 1* Apra, 2oo7, N.A.A.C. introduced\n\n metho\ufb01otogy  assessment and accreditation. What can be\n\n ~ab__out\"\"tshe new methodology is the introduction of\n\n gtade point average. Government i_(arn'a.ta!&lt;&#039;a,.__in exercise of its powers\n\nconferred by  Karnataka Education Act,\n1933 [&#039;the said ms irarfianded K.E.I.(C.E) Rules, 2oo3,f\nDeaiieg withitvhe generaiiiggririitions of grant-in-aid, Rule 9 of\n\n _F\u00a7ui.:e_*.-r,  states that seeking of grant-in-aid is\n\n&#039;;a5pejecti&quot;&#039; tot-ci&#039;ue&#039; i\ufb01iifiiiiniient of the infrastructure, etc, as per\n\nvjfapipvendix II&#039; \ufb01g&quot;.\/(:i;.h.vE&quot;.V&#039;KeE.L(C.E.:) Ruies, 2003 or production of\n\n  &quot;B&#039;_Grade status accreditation certi\ufb01cate. Further, Rule\n\n,\/  K.E.I.(C.E) Rules, 2003 gives the power to the\n\nxi&quot;&#039;rjfvstatef\u00e9overnment to withhold, withdraw or reduce the annual\n\nHRH.\n\nT Level of __ *  T&#039;? &quot;V  A ~\n2 01 _ 3 00 B Good accompfishment  the  K \n&#039; &#039; (Accredited) minimum fave! ex.o&#039;e::&#039;te_d area  &#039;\n\nMinimum   \n1.<\/pre>\n<p>51 &#8212; 2.90 C.&#8217; (Agcredfted) accompiisbtrrent  woof &#8216;<\/p>\n<p>grants if the institutions fail to provide infrestructur&#8221;e.:i&#8217;fe\u00e9&#8217;ititVi&#8217;es ht  <\/p>\n<p>speci\ufb01ed In Appendix II to the said Ruleseor tat! f1&#8217;te&#8217;tsp.fo&#8217;dut\u00e9VIiiheah<\/p>\n<p>minimum &#8216;B&#8217; Grade certi\ufb01cate issue\u00e9V_b;r_V..N..tt.A.&#8217;C. V 1.)(f) vh<\/p>\n<p>of the K.E.I.(C .E.) Rula, 2003_states the  efisaiary<br \/>\ngrant is subject to every colle9e&#8230;\u00e9ibta\u00a7_ni;:;\u00bbg:vt&#8217;.&#8217;\u00a5\u00a3s&#8217;.&#8217;L\u00a32tf&#8217;ed\u00bbe certi\ufb01cate :3?<br \/>\nassessment and accreditation  the peried<\/p>\n<p>speci\ufb01ed by the   _     <\/p>\n<p>8. In Wfit &#8211;\u00a5;e&#8217;tttieh\u00a7s&#8221;\u00abM6t.3&#8217;tvS?\u00a7\u00a7&#8217;8?&#8221;hf 1997, this Ceurt by<br \/>\nits interim or&lt;v\u00a31&#039;e;:&quot;,&quot;  .2004 directed the State<br \/>\nGetremment ts s&#039;p*ei\u00a2\u00a7fy wtthin which the private<br \/>\nedee:et\u00a79na.\u00a7&#039;:_j&#039;;\u00a5nstttvt\u00a7oh&#039;s&#039;,&quot;&quot;cteiming or receiving grants, should<\/p>\n<p>prcdttce.138&#039;-V.TGtede\u00abttie&#8211;rt\u00a7\ufb01cete; the Government was further<\/p>\n<p>:{&quot;di__\u00a7e\u00a2ted&quot;te&quot;&quot;&#039;exe?r\u00a7V\u00a7ne.&#039;e1&#039;end pass appropriate orders regarding<\/p>\n<p>_  withthewing or reducing the grant to such of the<\/p>\n<p> I*n_stitt:ti&#039;ons;&#039;\u00ab&#8211;.whe fail to ccmpty with the requirements of Rule<\/p>\n<p>nthe K.E,I.(C.E.} Rules, 2003. Pursuant to the said<\/p>\n<p>&#039;VVVsfL&#039;inte&#039;\ufb01:&#039;nVV&#039;erder, the State Gevernment issued the Netifieetien,<\/p>\n<p>hhdeted 16&quot;&#039; June, 2004 requiring the coiieges situated in urban<\/p>\n<p>areas to obtain &#039;a&#039; Grade certi\ufb01cate from &amp;A!A\u00a2\ufb0159 en or befere<\/p>\n<p>R834.\n<\/p>\n<p>30&#8243;&#8216; Aprii, 2005. Theree\ufb01er a show cause netice,__&#8217;\u00a72_eteciA_.:&#8217;i\u00ab;8&#8242;&#8221;T&#8217; <\/p>\n<p>August, 2006 was issued canine open <\/p>\n<p>Cellege end some other Celiegee toehow tteoee asTte_.$oi1y <\/p>\n<p>eatery grant some net be withorexo&#8217;r:e\u00bb.:VV:ee perV&#8221;Rr_ute:.V-1.?tnIetVVVthe<br \/>\nKrE.I.(C,,E,) Rules, 2oo3&#8242; &#8216;fee eetneo%%fmatqoeer rconee<br \/>\nsubmitted its repiy on 6&#8243;&#8216;  vAA&#8211;&#8216;.i&#8217;V_~g[1fs~ereafter the<br \/>\nGovernment vide its    (Annexurew<br \/>\nA) ordered the  obtains &#8216;B&#8217; Grade<br \/>\ncerti\ufb01cate or  is earlier. This is in<br \/>\nrespect of ee\\tierei&#8211;  the second petitioner<br \/>\nCollege. E-!oAwexrer, &#8216;th_e Govererrient reconsidered the issue end<\/p>\n<p>greeted. oo&#8221;e.&#8217;\u00a7re.er&#8217;s&#8221;t&#8211;ti&#8217;rne&#8217;foreoteinlng &#8216;E&#8217; Grade certi\ufb01cate. This<\/p>\n<p>. mod\u00e9\ufb01&#8217;ceter.'{er\u00a2ier e\u00e9eevipassed on 30&#8243;&#8216; Gctober, 2006 (Annexure<\/p>\n<p>t  ..  Srieishok Herenahelli, the tearned counsel appearing<\/p>\n<p>  tee petititonere urged the feliowieg contentions:<\/p>\n<p>  The very grading system by N.A.A.C. has undergone<br \/>\nu a change. &#8216;B&#8217; Grade in the otd regime does not<\/p>\n<p>correspond itself to any grade in the new system.<\/p>\n<p>HRH.\n<\/p>\n<p><span class=\"hidden_text\">(19)<\/span><\/p>\n<p>(c)<\/p>\n<p><span class=\"hidden_text\">10<\/span><\/p>\n<p>As the secend petitioner Coiiege the<br \/>\ninfrastructural facilities, as per Ai:4i;ren&#8217;dix&#8217;:e_IE&#8212;-h: <\/p>\n<p>said Rules, the insistence for the&#8217;product&#8217;iee:4_Vef  .<\/p>\n<p>Grade certi\ufb01cate is not  iii:.:ie:&#8217;;9 and<br \/>\n12(1)(1) of the  ahe of the<br \/>\ntwo conditions be_me_tV._  Eeeiiegf\ufb01-rnent is not<br \/>\njustified iii iiieeistiriiigi&#8217;  with both the<\/p>\n<p>conditid.ri5..::_&#8221;&#8221;&#8216;..V _    &#8216;<br \/>\nSri_,.e.Asi1&#8217;oi:e_&#8217;H&#8217;e;renah&#8217;e.l_ii&#8217; &#8216;aieoVV_.\u00bbtompiains af hostiie<\/p>\n<p>ds\u00a7c.nmina\u00a3idr-i;;riii[jiHerifsubinwsts that there are 349<\/p>\n<p>Goverrmient teiieijeeii\ufb01e\u00e9tiie State. out ef these, 257<\/p>\n<p>Qielivleges h\u00e9veiiet even appiiw for accreditation from<\/p>\n<p>  92 Colleges have obtained<\/p>\n<p> . &#8220;.ecr:i*ei\u00a7_ivtetii~\u00a7)&#8217;:i'&#8221;by N.A.A.C. Out ef them, 45 coueges<\/p>\n<p>&#8220;&#8216;have:A.been given &#8216;C&#8217; Grade. In support of these<\/p>\n<p> * ieeeubrhiseions, the petitioners have produced the<\/p>\n<p>   &#8216;&#8221;e&gt;:(tract from N.A.A.C. manuei at Annexure-J.<\/p>\n<p>In View of the change In the rnethedoiogy of grading,<\/p>\n<p>the State Government itself vide its letter, dated 21&#8221;<br \/>\n68!!<\/p>\n<p>I<\/p>\n<p><span class=\"hidden_text\">13<\/span><\/p>\n<p>only in compliance with the directions issued by this    it  .,  <\/p>\n<p>order, dated 27%\u00bb: March, 2004 in writ peijietsons&#8217;i%i\u00a2t\ufb0231is:\u00bb$5;.g7V _t\u00a7f%A\ufb01%&#8221;rt<\/p>\n<p>1997. He submitted that the Governmentis dutyfiooviznd  <\/p>\n<p>ensure that the aided institutionsiivifeeinteine&#8217;<br \/>\ninfrastructure and further kee\u00a7&#8221;&#8216;~upgred.i&#8217;nij\u00ab._Vttiv\u00e9ir infrvaustrvucture.<br \/>\nNo aided institution has anyv\ufb02eyestegjiebi&#8217;i;oii.,&#8217;r:Jemand the<br \/>\ncontinuation of grant&#8217;+ir:f;ia:td  a_ If the<br \/>\nGovernment forrnsigftstitution has vioiated<br \/>\nany condition   breach of statutory<br \/>\nprovision, it is etvgiays &#8220;th:e&#8221;4t5overnment to withdraw the<\/p>\n<p>grant. A . L  .\n<\/p>\n<p>&#8220;&#8217;13,.  ;&gt;_t!ianioharV&#8217;fu\ufb01&#8211;he&#8217;r eubmits that there is no privity<\/p>\n<p>of coiitraz:_&#8217;Vt..\u00a7E-overnment and the petitioners No.3 to<\/p>\n<p> Therefore itiannot maintain this petition. It is his<\/p>\n<p>&#8230;ernp4het&#8217;ic sebrniesivon that by invoking Rule 1S(1)(f) of the<\/p>\n<p>  2003, the Government can always stop the<\/p>\n<p>A V  <\/p>\n<p> The submissions of the learned counsei have<\/p>\n<p> my anxious consideration. The legal submissions of Sri<\/p>\n<p>FEE!-I.\n<\/p>\n<p><span class=\"hidden_text\">16<\/span><\/p>\n<p>16. Further, this Court in writ petitions i&#8217;io.315i&#8217;?&#8217;\u20ac;&#8217;-\u00a73&#8242;;&#8217;::.&#8217;..joVf _<\/p>\n<p>1997 has already taken the View that the consequenee&#8217;~of&#8217;A~~non&#8211;it&#8221;  <\/p>\n<p>production of &#8216;B&#8217; Grade certi\ufb01cate inciiidefs to&#8217;<\/p>\n<p>withdrawal or reduction of grants _oay_ab|e&#8221;&#8216;to&#8221;&#8216;the  .<\/p>\n<p>Judicial discipline requires that the  stated&#8221; ther&#8217;ein:&#8217;fhas to<br \/>\nbe foilowed. If the petitionersejrgy  thewsaid writ<br \/>\npetitions, it is always open to  to   of the same<br \/>\nby impieading  th:eyse_id\ufb01 chaiienging it<\/p>\n<p>before the Division ea;-ma V  4. A &#8221;\n<\/p>\n<p>17. Thevreia a\ufb01other.yreason&#8221;&#8216;as&#8217;Vto why I am negating<\/p>\n<p>the challenge some vaiioitty1d5(1)(n of the said Ruies.<br \/>\nAdmittediy, none VVof.VtheVVoetit\u00a7.one&#8217;rs have filed any objections to<br \/>\nthe.\u00ab-&#8216;Dra_ft  said &#8220;R&#8217;uies..\u00abFor all the aforesaid reasons, I<\/p>\n<p>negaitiyertheictiailenoe&#8217; to the validity of Rule 15(1)(f) of the said<\/p>\n<p>?:&#8221;R._t_iies.\n<\/p>\n<p> yTh.av&#8230;A:other contentions raised on behalf of the<\/p>\n<p>;oetitionei&#8217;s,_n\u00a7erit serious consideration. I notice with concern<\/p>\n<p>  349 Government Coiieges, 257 Colleges did not even<\/p>\n<p>.qi&#8217;\u00bbaVpp-iyifor accreditation from N.A.A.C. The Government&#8217;s counter<\/p>\n<p>HRH<\/p>\n<p><span class=\"hidden_text\">17<\/span><\/p>\n<p>is silent on this aspect of the matter. Further out of**9&#8211;:\u00a7\u00a7fCo&#8217;i*ieg\u00abes &#8221;  <\/p>\n<p>which have obtained the accreditation, 45 <\/p>\n<p>given &#8216;C&#8217; Grade. when these are.\u00bbthe admitted  .<\/p>\n<p>considerable force in the submissionsv&#8217;vl&#8217;ot&#8221;:&#8217;Sri _i-\u00ab&#8217;!:araf:rIahaill<br \/>\nthat there cannot be double stantiarc\u00a5V: in; of utilisation<br \/>\nof State funds in the \ufb01eld of eduicaitioni  been done<\/p>\n<p>amounts to violation_d_i&#8217;  to&#8221;tVh_e_&#8221;Censtit*ution of India.\n<\/p>\n<p>19. Rule 1(3) Qf&#8217;VtF;E:&#8221;~KfE-|:V$:&#8217;J.(C&#8217;L$3) Rules, 2003 states that<\/p>\n<p>the said Rules&#8221;the.V\u00a73~overnreeVnt, local authority and<br \/>\nprivate aided ai&#8217;\ufb01&#8217;liatedv  &#8216;Government Colleges and<br \/>\nprivate aided&#8217;insttitutionstihavelt diitfferent status, does not mean<br \/>\nthait-&#8216;theA_Ge${ern\u00bbti}ent sheuld&#8230;not be concerned with the quality of<\/p>\n<p>education.V&#8221;in._i&#8217;ts&#8217;~r(t&#8217;:-ttiivemment) colleges and upgradation of<\/p>\n<p>Zidinfrastructurei th&#8217;e%ein&#8217;;&#8217;vVbut at the same time insist for the<\/p>\n<p>_  ofilthightiicla\u00e9ss infrastructure in private aided institutions.<\/p>\n<p>_ .j2&#8217;heV&#8221;&#8221;transitlonal problem is aiso required to be<\/p>\n<p> i\\i.A.A.C. has switched over from the nine point scale<\/p>\n<p>(.l:ii:?&#8217;\u00b0&#8217;*&#8221;&#8221;&#8221;i (ii) A&#8221;: (iii) A, (iv) 3&#8243;, (V) 8*. (vi) rs, (vii) C&#8221;, (vim<\/p>\n<p> (ix) C to the new cumulative grade point average system<\/p>\n<p>\ufb01Bl1<\/p>\n<p><span class=\"hidden_text\">18<\/span><\/p>\n<p>of (3) A, (ii) 3, (iii) c and (iv), the equisgaience df&#8221;the&#8217;_&#8217;;v:&gt;id: &#8220;re? 4  V<\/p>\n<p>Grade is yet to be worked out. The rigcrst-of r$ne&#8217;*i.1&#8242;<\/p>\n<p>methodology to the other methodeiogy are to  vh<\/p>\n<p>N.A.A.C. itself has ciarified that &#8216;Cf_tmC-rad_e  **reeerg;|f;ed as<br \/>\naccredited. This is evident  the relevant<\/p>\n<p>portions of which are extracted:ri&#8217;i&#8217;ereiijebe\u00a7,\u00a7;   it &#8221; it\n<\/p>\n<p>21. Nobody can  the st&#8217;ete&#8217;rnent~ of Sri Meneher<\/p>\n<p>that the  the grant, if the<br \/>\ninstitution vleietes   or contravenes any<br \/>\nprovisions cf stetn:t&#8217;e.V Bi.;i:&#8217;.VA$bi&#8217;hiie:.:_}e:r&#8217;e&#8217;rcising its power, the State<br \/>\nGovernment jhaspto into accoiint an the reievant factors. No<\/p>\n<p>expvianetightfg fhirthicomingivvttasivto why insistence for obtaining of<\/p>\n<p> &#8216;B&#8217;  not being made in respect of 257<\/p>\n<p> v&lt;:3o\\rernmen&#8211;t__V It cannot be the case of the Government<\/p>\n<p>&quot; &#039;th&#8211;et&quot;\u00ab\u00abth&#039;e qualityvcef education in Government Coiieges can be low<\/p>\n<p>&quot;\u00abthe&#039;que&#8211;iity of education has got to be high in aided<\/p>\n<p> in&#039;r;titet_i_er*is. The impugned orders were passed one year three<\/p>\n<p> prior to the ciarificatory communication issued by<\/p>\n<p>sN&#039;.&quot;A.A.C. at Annexure-L. In the wake of this subsequent<\/p>\n<p>3:354.\n<\/p>\n<p><span class=\"hidden_text\">19<\/span><\/p>\n<p>development, the petitioners&#8217; cases certainly&#8217;    <\/p>\n<p>reconsidered.\n<\/p>\n<p>22.
