In April  1964,  the  appellant\napproached the Minister, and he was informed that no further\nlicence\t would be issued to him.  Thereupon,  the  appellant\nfiled a petition under Art. 226 of the Constitution  seeking\na  mandamus for the issue of the import licence.   The\tHigh\nCourt\tdismissed  the\tpetition  in  limine   but   granted\ncertificate Under Art. 133(1)(a) of the\t Constitution. '\nHELD: The  appeal must fail.\n    The\t petition  under Art. 226 of  the  Constitution\t was\nfiled  after great delay.  No explanation was given  in\t the\npetition for the delay in filing the petition and it was not\nexplained  what\t the appellant was doing  between  March  6,\n1962, when  the supplementary licence was issued, and  April\n1964.  The exchange position of this country and the  policy\nof  the\t Government regarding  international  trade,  varies\nfrom year to  year and it would be rather odd for this Court\nto  direct that an import  licence  be granted in  the\tyear\n1968  in  respect  of alleged  default\t committed  by\t the\nGovernment  in\t1959  or  1962.\t In  these  matters  it\t was\nessential  that persons who were aggrieved by orders of\t the\nGovernment  should approach the High Court after  exhausting\nthe  remedies  provided by law, rule or\t order\twith  utmost\nexpedition.    Even  in\t the  case  of\talleged\t breach\t  of\nfundamental rights the matter must be left to the discretion\nof the High Court. [864 G, 865 B]\n    Smt. Narayani Debi Khaitan v. The Judgment of the Court was delivered by
\n    Sikri, J. The appellant, Durga Prashad, filed a petition
\nunder Art. 226 of the Constitution against the\trespondents.
\nThe  High Court of Punjab, Circuit Bench,  Delhi,  dismissed
\nthe   petition in limine.  Thereupon the appellant   applied
\nfor   a\t   certificate\tunder  Art.   133  (1)(a)   of\t the
\nConstitution.\tThe High Court gave this certificate on\t the
\nground\tthat  the  value  of  the  subject-matter   directly
\ninvolved in the petition exceeds Rs. 20,000\/-.
\n  In  our opinion this appeal must fail on the\tground\tthat
\nthe  petition under Art. 226 of the Constitution  was  filed
\nafter  great delay.  The relevant facts are as\tunder.\t The
\nappellant was carrying on business of export and import, and
\nexported goods of the value of Rs. 8,10,325\/-, F.O.B.  value
\nRs.  8,03,530.45,  during the period August 25,\t  1958,\t  to
\nSeptember   29,\t  1958.\t On   November\t 12,\t1958,\t the
\nappellant   applied   for  an import licence  for  art\tsilk
\nyarn   of the  f.o.b.  value  of  Rs. 8,03,530.45  nP  under
\nthe Export Promotion Scheme. The Export Promotion Scheme was
\ndiscontinued with effect from March 6, 1959.  On October  9,
\n1959, import licence of the value of Rs. 3,27,841\/- only was
\nissued\tto  the appellant by the Joint Chief  Controller  of
\nImports and Exports, Bombay.  His appeal against this  order
\nwas rejected by the Joint Chief Controller on March 4, 1960.
\nIt  is\talleged\t by the appellant that he was  not  given  a
\nhearing.   The appellant filed a second appeal to the  Chief
\nController of Imports and Exports, and this was dismissed on
\nApril 22,  1961.  Here again it is alleged that no’  hearing
\nwas  given  to\tthe appellant.\tHe  filed  a  representation
\nagainst\t the  order  dated April 22,   1961,   and  on\tthat
\nrepresentation a supplementary import licence for import  of
\nart  silk  yarn\t of  the  value\t of Rs. 30,000\/- was  issued
\nto  the\t appellant. This exhausted all the remedies  he\t had
\nunder para 85 of the order relating to the Export  Promotion
\nScheme,\t but he instead of filing a writ chose to wait.\t The
\nappellant    apparently\t  approached   the    Minister\t  of
\nInternational Trade by letter dated April 6, 1964-  this  is
\nthe  letter  referred  to  in  the  letter  of\tthe  Private
\nSecretary  to  the Minister of International  Trade-and\t the
\nPrivate\t Secretary, vide  his letter  dated April 16,  1964,
\nwrote  to him saying that his letter had been passed  on  to
\nthe Chief Controller of Imports and Exports, New Delhi,\t and
\nif  so\tdesired\t the appellant may see him  in\tthe  matter.
\nApparently the Chief Controller invited him and on June\t 22,
\n1964,  he  was\tinformed that no further  licence  would  be
\nissued to him.\tOn August 24, 1964, the appellant filed\t the
\npetition above-mentioned in the High Court.  No\t explanation
\nhas  been given in the petition for the delay in filing\t the
\npetition  and it has not been explained what  the  appellant
\nwas doing between March
\n863<\/span>
\n    5, 1962, when the supplementary licence was issued,\t and
\nApril 6, 1964.\n<\/p>\n
    It\tis  well-settled that the relief under Art.  226  is
\ndiscretionary, and one ground for refusing relief under Art.
\n226  is\t that the petitioner has filed\tthe  petition  after
\ndelay for which there is no satisfactory explanation.
\n    Gajendragadkar,  C.J.,  speaking  for  the\tConstitution
\nBench,\tn  Smt. Narayani Debi  Khaitan\tv.  The\t  State\t  of
\nBihar(1), observed.\n<\/p>\n
\t\t    “It is well-settled that under Art. 226,
\n\t      the  power  of  the High\tCourt  to  issue  an
\n\t      appropriate writ is discretionary.  There\t can
\n\t      be  no doubt that if a citizen moves the\tHigh
\n\t      Court  under  Art. 226 and contends  that\t his
\n\t      fundamental  rights have been  contravened  by
\n\t      any  executive  action, the High\tCourt  would
\n\t      naturally like to give relief to him; but even
\n\t      in  such\ta case, if the petitioner  has\tbeen
\n\t      guilty of laches, and there are other relevant
\n\t      circumstances which indicate that it would  be
\n\t      inappropriate  for the High Court to  exercise
\n\t      its high prerogative jurisdiction in favour of
\n\t      the  petitioner, ends of justice\tmay  require
\n\t      that  the High Court should refuse to issue  a
\n\t      writ.  There can be little doubt that if it is
\n\t      shown that a party moving the High Court under
\n\t      Art. 226 for a writ is, in substance, claiming
\n\t      a relief which under the law of limitation was
\n\t      barred at the time when the writ petition\t was
\n\t      filed,  the High Court would refuse  to  grant
\n\t      any relief in its writ jurisdiction.  No\thard
\n\t      and fast rule can be laid down as to when\t the
\n\t      High  Court  should  refuse  to  exercise\t its
\n\t      jurisdiction in favour of a party who moves it
\n\t      after  considerable  delay  and  is  otherwise
\n\t      guilty of laches.\t That is a matter which must
\n\t      be  left to the discretion of the\t High  Court
\n\t      and like all matters left to the discretion of
\n\t      the Court, in this matter too discretion\tmust
\n\t      be exercised judiciously and reasonably.”<\/p><\/blockquote>\n
    Relying  on\t the judgment of this Court  in\t Maharashtra
\nState  Road Transport Corporation v. Shri  Balwant   Regular
\nMotor<\/a>  service,\t Amravati(2)  the learned  counsel  for\t the
\nappellant  contends hat the delay should not debar him\tfrom
\nseeking\t relief because he respondents have not suffered  in
\nany  manner because of the delay.  In this  case  Ramaswami,
\nJ., speaking for the Court, referred to an earlier  decision
\nin Moon Mills v. Industrial Court<\/a>(a).\n<\/p>\n

\nIn  that  case\tRamaswami,  J.,..speaking  for\tthe   Court,
\nobserved:\n<\/p>\n
\t\t    “It is true that the issue of a writ  of
\n\t      certiorari  is  largely  a  matter  of   sound
\n\t      discretion.   It is also true ‘that  the\twrit
\n\t      will   not  be  granted  if  there   is\tsuch
\n\t      negligence  or  omission on the  part  of\t the
\n\t      applicant\t to  assert his right as,  taken  in
\n\t      conjunction  with the lapse of time and  other
\n\t      circumstances, causes prejudice to the adverse
\n\t      party.   The principle is to a  great  extent,
\n\t      though  not  identical with,  similar  to\t the
\n\t      exercise\t of  discretion\t in  the  Court\t  of
\n\t      Chancery.”\n<\/p><\/blockquote>\n
It  would be noticed that Ramaswami, J., had first  examined
\nthe  question  of delay and came to a finding that  in\tfact
\nthere was n delay.  Ramaswami, J., observed:\n<\/p>\n
      “On  behalf  of the respondent Mr.  B.  Sen,  however,
\npointed\t out  that  the conduct of the\tappellant  does\t not
\nentitle\t it  to\t the grant of a writ, because  it  has\tbeen
\nguilty of acquiescence or delay. It was pointed out that the
\naward  of  Mr.\tWhat was given on April\t 25,  1958,  but  an
\napplication  to the High Court for grant of a writ was\tmade
\nlong  after on November 16, 1959.  We do not think there  is
\nany   substance\t in  this  argument,  because\tthe   second
\nrespondent had made an application, dated August 19, 1958 to
\nthe  Labour  Court  for enforcement of\tthe  award  and\t the
\nappellant  had\tcontested  that\t application  by  a  Written
\nStatement,  dated  September  15, 1958.\t  The  Labour  Court
\nallowed the application on August 4, 1959 and the  appellant
\nhad  preferred an appeal to the Industrial Court  on  August
\n31, 1959.  The decision of the industrial Court was given on
\nOctober\t 24,  1959 and after the appeal\t was  dismissed\t the
\nappellant  moved  the  High Court for grant  of\t a  writ  on
\nNovember 16, 1959.”\n<\/p>\n
    The\t appellant  in this case had claimed a\tmandamus  or
\ndirection  to  the  respondents to issue  to  the  appellant
\nimport\tlicence\t for  art  silk yarn of\t the  value  of\t Rs.
\n8,03,530.45.  It is well-know that the exchange position  of
\nthis   country\tand  the  policy  of  Government   regarding
\nInternational trade varies from year t year and it would  be
\nrather odd for this Court to direct that a Import licence be
\ngranted\t in  the year 1968 in respect  of  allege,,  default
\ncommitted  by  the  Government in 1959 or  1962.   In  these
\nmatters\t it is essential that persons who are  aggrieved  by
\norder of the Government should approach the High Court after
\nexhausting the remedies provided by law, rule or order\twith
\nutmost expedition.\n<\/p>\n
865<\/span><\/p>\n
    The learned counsel for the appellant contends that this
\nmatter\tinvolved fundamental rights and this Court at  least
\nshould not refuse to give relief on the ground of delay. But
\nwe  are\t exercising our jurisdiction not under Art.  32\t but
\nunder Art. 226, and as observed. by Gajendragadkar, C.J., in
\nthe  passage  extracted above, even in the case\t of  alleged
\nbreach of fundamental rights the matter must be left to\t the
\ndiscretion of the High Court.\n<\/p>\n
In the result the appeal fails.\t Parties will bear their own
\ncosts.\n<\/p>\n
