Justice V.GIRI\n\n Dated :28\/11\/2008\n\n O R D E R\n                            V.GIRI,J.\n                     -------------------------\n                  W.P ( C) No.34289 of 2008\n                     --------------------------\n            Dated this the 28th November, 2008\n\n                       J U D G M E N T\n<\/pre>\n<p>     In the circumstances of the case, the        State of<\/p>\n<p>Kerala, represented by the Principal Secretary to<\/p>\n<p>Government , Forest Department, is impleaded as addl. 4th<\/p>\n<p>respondent.\n<\/p>\n<p>     2.    Petitioner bid certain timber in auction from<\/p>\n<p>the Kollathirumedu Range in Vazhachal Division.       The<\/p>\n<p>total value of the timber was assessed at Rs.5,03,877\/-.<\/p>\n<p>1\/5th of the amount was deposited on the date of<\/p>\n<p>confirmation of sale. Balance amount towards sale value,<\/p>\n<p>Forest Development Tax, Value Added Tax was to be paid<\/p>\n<p>within sixty days. Admittedly, it has not been paid.   An<\/p>\n<p>extension of 30 days was granted by the Range Officer.<\/p>\n<p>A portion of the balance amount was paid within the<\/p>\n<p>extended 30 days.      Petitioner again sought for     an<\/p>\n<p>extension and paid the balance amount due by way of sale<\/p>\n<p>value and Forest Development Tax along with interest<\/p>\n<p>W.P ( C) No.34289 of 2008<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>and penal interest within the said extended period of 30<\/p>\n<p>days.    Nevertheless, he was not able to pay the entire<\/p>\n<p>amount due. The amount which is to be given in the<\/p>\n<p>statement filed by the 2nd respondent in paragraphs 6 and 7<\/p>\n<p>read as follows:\n<\/p>\n<blockquote><p>            &#8220;6.  Sri.Manoj Kumar did not remit the<br \/>\n      sale value and taxes within the stipulated time of<br \/>\n      60 days. He requested for extension of time for<br \/>\n      remitting the balance amount due. As per sale<br \/>\n      conditions, the Range Officer is competent to<br \/>\n      grant 30 days time for the remittance of balance<br \/>\n      amount due with penal interest @ 18% per<br \/>\n      annum; and the       Divisional Forest Officer is<br \/>\n      competent for further extension of 30 days on<br \/>\n      realization of penal interest @ 24% per annum<br \/>\n      and    2.5%     surcharge   on  penal    interest.<br \/>\n      Accordingly     permission   was    granted   for<br \/>\n      remitting the balance amount due with penal<br \/>\n      interest.\n<\/p><\/blockquote>\n<blockquote><p>            The total amount due from the bidder is as<br \/>\n      follows:-<\/p><\/blockquote>\n<pre>\n\n      Balance Sale Value                 Rs.4,03,079-00\n      FDT                                     28,343-00\n      VAT &amp; Cess                              63,615-00\n      IT &amp; Cess                               15,178-00\n      Penal interest @ 18% per annum           6,471-00\n      Penal interest @ 24% per annum           5,387-00\n      with surcharge\n                                 Total Rs.5,22,073-00\n\n<\/pre>\n<blockquote><p>           7.    As per the sale conditions, Sri.Manoj<br \/>\n     Kumar is liable to pay a total amount of<\/p>\n<p>W.P ( C) No.34289 of 2008<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>     Rs.5,22,073\/- within the stipulated time limit of<br \/>\n     28.8.2008 and to remove the produce from the<br \/>\n     depot after remitting sufficient ground rent vide<br \/>\n     sale conditions 7 (b) but Sri.Manoj Kumar made<br \/>\n     only partial remittance.<\/p><\/blockquote>\n<pre>\n\n      Balance Sale Value                 Rs.4,03,079-00\n      FDT                                     28,343-00\n      Penal interest @ 18% per annum           2,529-00\n      Penal interest @ 24% per annum           5,387-00\n      with surcharge\n                                Total  Rs.4,39,338-00\n\n\n\n<\/pre>\n<blockquote><p>      3.    This writ petition has been filed seeking a<\/p>\n<p>direction to the respondents to accept the balance amount<\/p>\n<p>due from the petitioner and release the timber to him.\n<\/p><\/blockquote>\n<p>Second respondent has filed a statement and           I have<\/p>\n<p>already referred to the relevant portion of such statement.<\/p>\n<p>      4.    I am not in a position to    find fault with the<\/p>\n<p>action taken by the respondents in considering the<\/p>\n<p>petitioner as not having complied with the terms and<\/p>\n<p>conditions of the auction, if they are implemented strictly<\/p>\n<p>and correctly.\n<\/p>\n<p>      But I take note of the submission made by Special<\/p>\n<p>Government Pleader Sri.Renjith Thampan that it is always<\/p>\n<p>open to the Government to extend the time for payment of<\/p>\n<p>W.P ( C) No.34289 of 2008<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>amount due by way of VAT in this regard. It is open to the<\/p>\n<p>petitioner to move the Government.\n<\/p>\n<p>      In the result, the writ petition is disposed of<\/p>\n<p>permitting the petitioner to move the Government for an<\/p>\n<p>appropriate extension of the time to pay the balance<\/p>\n<p>amount due by way of VAT as mentioned in the statement<\/p>\n<p>filed by the 2nd respondent referred to above. If such a<\/p>\n<p>representation is filed within two weeks from today along<\/p>\n<p>with a copy of this judgment and copy of the writ petition,<\/p>\n<p>Government shall take appropriate decision as above<\/p>\n<p>mentioned within one month thereafter.
