NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave arises\t from order  of the Division<br \/>\nBench of the Punjab &amp; Haryana High Court, made on August 18,<br \/>\n1992 in Civil Revision No. 73 of 1991.\n<\/p>\n<p>     The learned  counsel for  the petitioner  has contended<br \/>\nthat the decision of this Court in Babua Ram &amp; Ors. v. State<br \/>\nof U.K.\t &amp; Narc.  [(1995)  2  SC  689]\twas  referred  to  a<br \/>\nConstitution Bench in <a href=\"\/doc\/178452445\/\">Jose Antanio Cruz Dos R. Rodriqueses &amp;<br \/>\nAnr. v.\t Land Acquisition Collector &amp; Anr.<\/a> [1996) 1 SCC 88 =<br \/>\nJ.T. 1995  (8) SC  3281 and  thereafter cases  with  similar<br \/>\nfacts were  also referred. We find that the statement is not<br \/>\naccurate and  in the  facts of\tthis case, the question does<br \/>\nnot arise. The admitted position is an under.\n<\/p>\n<p>     Notification under Section 4(1) of the Land Acquisition<br \/>\nAct, 1984  [for short  the `Act&#8217;]  was published on June 26,<br \/>\n1973 acquiring 133.24 acres of land situated in Village Dara<br \/>\nKalan, District\t Kurukshetra for development and utilisation<br \/>\nof the\tland for  residential purposes. The Collector in his<br \/>\naward dated  July 17,  1975 awarded compensation at the rate<br \/>\nof Rs.\t3\/- per\t square yard. The appellant did not seek any<br \/>\nreference under\t Section 18. However, on reference sought by<br \/>\nothers, the  district judge  in his  award and\tdecree dated<br \/>\nOctober 3, 1981 enhanced the compensation to Rs. 7\/- per sq.<br \/>\nyd. Dissatisfied  therewith, those claimants filed appeal in<br \/>\nthe High  Court. The High Court by judgment and decree dated<br \/>\nMarch 14,  1990 further\t enhanced the compensation to Rs. 37<br \/>\nper sq.\t yd. Thereafter, the petitioner filed an application<br \/>\nwithin the  prescribed limitation period of 30 days from the<br \/>\ndate of the judgment of the High Court under Section 28-A of<br \/>\nthe Act\t for payment  of the enhanced compensation. The Land<br \/>\nAcquisition Collector  by  Order  dated\t September  5,\t1990<br \/>\ndismissed  the\t application  but  the\tDistrict  Judge\t re-<br \/>\ndetermined the\tcompensation by\t Order\tdated  December\t 24,<br \/>\n1991. The  revision application,  on reference\tby a learned<br \/>\nsingle Judge,  was allowed  by the  Division  Bench  setting<br \/>\naside the reference Court award. Thus, this special leave.\n<\/p>\n<p>     It is  contended that the petitioner is entitled to re-<br \/>\ndetermination of  compensation on  par with  others and\t the<br \/>\nquestion of  limitation does  not  stand  in  the  way.\t The<br \/>\nquestion, therefore,  is as to when the limitation begins to<br \/>\nrun for\t the purpose  of  filing  of  an  application  under<br \/>\nSection 28-A  of the  Act? The\tAmendment  Act\t68  of\t1984<br \/>\nintroducing Section  28-A had  come into  force with  effect<br \/>\nfrom September\t24, 1984.  Section 28-A\t envisage giving  of<br \/>\nbenefit to  a person  who had  accepted the award made under<br \/>\nSection\t 11  without  protest  and  did\t not  avail  of\t the<br \/>\nreference under\t Section  18  for  further  enhancement\t and<br \/>\nothers had  the ward  of enhanced  compensation. He has been<br \/>\ngiven right  to make  a written\t application to\t the  L.A.O.<br \/>\nwithin 30  days from  the date\tof the\taward of  the  Court<br \/>\nexcluding the  time taken  to obtain a certified copy of the<br \/>\naward of  the court.  IT is  now fairly\t well settled  legal<br \/>\nproposition that  the award of the court is the award of the<br \/>\nreference court\t under Section\t18. That  is clear  from the<br \/>\nstatement of  the objective  and reasons  as also  from\t the<br \/>\nunequivocal language  used in Section 28-A-(1) of the At. It<br \/>\nis equally  well settled  legal position  that once time has<br \/>\nbegun to  run, it will continue to run until it is stayed by<br \/>\nan appropriate\tcourt. The remedy, thereafter stands barred.<br \/>\nThe proviso  to\t Section  28-A(1)  only\t excludes  the\ttime<br \/>\nactually  taken\t in  obtaining\tthe  certified\tcopy,  while<br \/>\ncomputing the  period of  three months limitation prescribed<br \/>\nunder Section  28-A(1). In  other words,  the time  take  to<br \/>\nobtain certified copy alone is to be excluded in computation<br \/>\nof  limitation\tof  three  months.  The\t reference  in\tJose<br \/>\nAntonio&#8217;s case\twas confine  to the  question as to which of<br \/>\nthe two awards, when there are more than one award passed by<br \/>\nthe reference Court in respect of the land covered under the<br \/>\nsame notification  published under  Section 4(1), would give<br \/>\ncause of  action and  to the  question\tlimitation  to\tfile<br \/>\napplication under  Section  28-A(1).  In  other\t words,\t the<br \/>\nquestion therein  was which  of the  two dates of two award,<br \/>\nfurnishes the  period of  limitation of three months. In the<br \/>\npresent case  in hand that question dos not arise. There are<br \/>\nno two awards of the reference Court. In Scheduled Caste Co-<br \/>\nop. Land  Owning Society Ltd. v. Union of India [AIR 1991 SC<br \/>\n730], a Bench of three Judges of this Court held that &#8220;It is<br \/>\nobvious on a plain reading of Sub-Section (1) of Section 28-<br \/>\nA that\tis applies only to those claimants who had failed to<br \/>\nseek a\treference under\t Section 18. The redetermination has<br \/>\nto be done by the Collector on the basis of the compensation<br \/>\nawarded by  the Court  in the reference under Section 18 and<br \/>\nan application\tin  that  behalf  has  to  be  made  to\t the<br \/>\nCollector within  30 days  from the  date of  the award. The<br \/>\norder of  the  High  Court  does  not  give  right  of\tfile<br \/>\napplication under Section 28A(1).\n<\/p>\n<p>     In State  of Punjab  V\/s. Raghbir\tSingh &amp;\t Ors. [1995)<br \/>\nSupp. 2\t SCC 679)  on similar  facts the  ward was  accepted<br \/>\nwithout protest\t and no\t reference was\tsought\tfor  by\t the<br \/>\nrespondents. On\t reference under  Section 18 at the instance<br \/>\nof others,  the District  Judge confirmed  the award  of the<br \/>\nCollector  but\t on  appeal  the  High\tCourt  enhanced\t the<br \/>\ncompensation. When  application under  Section 28-A (1) came<br \/>\nto be  filed after the High Court judgment. It was held that<br \/>\nthe remedy  under Section 28-A was unavailable as the decree<br \/>\nof the\tHigh Court  is not that of the reference Court under<br \/>\nSection 18.  The limitation period had begun to run from the<br \/>\ndate of\t the award of the District Judge. In State of Punjab<br \/>\nV\/s.  Raghubir\t Singh\t[(1989)\t  3  SCR   316\tat  339],  a<br \/>\nConstitution Bench  had held that the words &#8220;any such award&#8221;<br \/>\ncannot have  any reference  to the  appellate orders  of the<br \/>\nHigh Court  or of  the Supreme\tCourt.\tIn  the\t context  of<br \/>\nSection 30  (2), it  must have reference to the award of the<br \/>\nCollector or the Civil Court made between April 30, 1982 and<br \/>\nSeptember 24,  1984. In\t other words, the Constitution Bench<br \/>\naffirmed that  the award  of the  Court is  of the reference<br \/>\nCourt or  the Collector as the case may be. In D. Venkamma &amp;<br \/>\nOrs. V\/s.  Special Tehsildar (LA) Unit-IV, Janagareddigudem.<br \/>\nW.G. District,\tElugi, A.P.  [1996) (1)\t 851), under similar<br \/>\nfacts as  in this  case, the  award came  to be\t made by the<br \/>\nDistrict Judge\ton  reference  at  the\tinstance  of  others<br \/>\ncovered under  the same notification but no application came<br \/>\nto be  made immediately\t thereafter. The Civil Court enhance<br \/>\ncompensation on\t November 26,  1983. The  High Court&#8217;s award<br \/>\nwas made  on February  1, 1989. Thereafter, on May 12, 1989,<br \/>\napplication  under   Section  28-A  (1)\t was  filed  seeking<br \/>\nredetermination of  the compensation. It was held that court<br \/>\nreferred in  Section 28 is the reference Court under Section<br \/>\n18  and\t  not  the  High  Court\t and  that,  therefore,\t the<br \/>\napplication filed, though within limitation from the date of<br \/>\nthe High  Court&#8217;s judgment,  was not  maintainable. In\tU.P.<br \/>\nState Industrial  Development Corpn. Ltd. V\/s. State of U.P.<br \/>\n&amp;  Ors.\t  [(1995)   2\tSCC   766],   an   application\t for<br \/>\nredetermination of  the compensation  was  filed  after\t the<br \/>\naward of the reference Court, was pending appeal in the High<br \/>\nCourt. The  Appellant objected\tto  the\t redetermination.  A<br \/>\nBench of  three Judges\tof this\t Court had  held that  since<br \/>\nappeal was  pending, the  Collector  was  not  justified  in<br \/>\nredetermining the  compensation. The  award of the Collector<br \/>\nwas set\t aside the  matter was\tdirected to  be kept pending<br \/>\ntill the  appeal was disposed of in the High Court. In State<br \/>\nof Maharashtra\tV\/s. Manakchand Pyarmal &amp; Ors. [(1996) a SCC<br \/>\n297], same direction was given to keep the application under<br \/>\nSection 28-A  pending till  the appeal against the reference<br \/>\nCourt awarded  was decided  by the  High Court.\t In State of<br \/>\nPunjab V\/s.  Raghubir Singh  &amp; Ors. [(1995) Supp. 2 SCC 679]<br \/>\nit was\theld that  an application  for\tre-determination  of<br \/>\ncompensation can  be made  only on the basis of the judgment<br \/>\nof the\treference Court and the same must be made within the<br \/>\nlimitation period prescribed by Section 28-A (1) of the Act.<br \/>\nTherein, the facts were that award was made by the Collector<br \/>\non December  22, 1983. The reference Court by judgment dated<br \/>\nSeptember 10,  1990 enhanced  the compensation.\t Application<br \/>\nfiled  on   January  2,\t 1991  under  Section  28-A  seeking<br \/>\nredetermination of  the compensation  on the  basis  of\t the<br \/>\njudgment of  the High Court, was dismissed by the Collector.<br \/>\nOn revision  application, the  High Court  directed by order<br \/>\ndated August 14, 1992 redetermination of the compensation on<br \/>\nthe basis  of its earlier judgment dated September 12, 1990.<br \/>\nOn those  facts this  Court held  that the  application\t for<br \/>\nredetermination was barred by limitation. Appeal was allowed<br \/>\nand the order of the High Court was set aside.\n<\/p>\n<p>     Thus only those claimants who had failed to apply for a<br \/>\nreference under Section 18 of the Act are conferred with the<br \/>\nright to apply for redetermination under Section 28A(1). But<br \/>\nall those  who had not only sought a reference under Section<br \/>\n18 but\thad also  filed an  appeal in the High Court against<br \/>\nthe award  made by  the reference  court are not entitled to<br \/>\navail of  the remedy  under Section  28A. Equally, the right<br \/>\nand  remedy of reference Court under Section 18 had enhanced<br \/>\nthe compensation  in an\t award and  decree under section 26.<br \/>\nWithin three  months from  the date  of the  reference court<br \/>\nexcluding the  time taken under proviso, the applicant whose<br \/>\nland was acquired under the same notification but who failed<br \/>\nto avail  the remedy  under Section 18, would be entitled to<br \/>\navail the  right and remedy under Section 28A. The order and<br \/>\njudgment of  the High  Court does not give such right. Thus,<br \/>\nthis Court held that Section 28-A does not apply to an order<br \/>\nmade  by   the\tHigh   Court  for   redetermination  of\t the<br \/>\ncompensation. Thus,  we hold that the question of  reference<br \/>\nto the\tConstitution Bench does not arise. The claimants are<br \/>\nnot entitled  to make  an application for redetermination of<br \/>\ncompensation under Section 28-A(1) after the judgment of the<br \/>\nHigh Court  not are  the claimants entitled to avail of that<br \/>\naward which  is more  beneficial to the claimants, i.e., the<br \/>\nHigh Court judgment.\n<\/p>\n<p>     The special leave petition is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Smt.
