Heard Shri Sushil Kumar Mallick,<\/p>\n<p>                  learned    counsel         for    the     petitioner,            Shri<\/p>\n<p>                  Dinbandhu Singh, learned G.P.9, who appears<\/p>\n<p>                  on    behalf    of    respondent          nos.1       to     5   and<\/p>\n<p>                  learned    counsel         appearing           on    behalf        of<\/p>\n<p>                  respondent no.6\/Accountant General, Bihar,<\/p>\n<p>                  Patna.\n<\/p>\n<p>                            The     petitioner,             who       retired        as<\/p>\n<p>                  Headmistress from D.K. Girls Middle School,<\/p>\n<p>                  Buxar     on     31.5.2010,              has        prayed        for<\/p>\n<p>                  directing the respondents for clearing her<\/p>\n<p>                  all    retiral    dues.      It     has    been       stated       by<\/p>\n<p>                  learned    counsel         for     the    petitioner             that<\/p>\n<p>                  till    date,    nothing         has    been    paid       to     the<\/p>\n<p>                  petitioner.          The         petitioner           repeatedly<\/p>\n<p>                  represented before the authority concerned<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>for      clearing         her            retiral           dues.       In<\/p>\n<p>paragraph-13             of         the        writ           petition,<\/p>\n<p>specifically it has been mentioned that no<\/p>\n<p>departmental         proceeding                was         going       on<\/p>\n<p>against        her       nor            any        allegation          of<\/p>\n<p>corruption           or             misappropriation                   of<\/p>\n<p>Government       fund         was       alleged          against      the<\/p>\n<p>petitioner.          Even           then           the        authority<\/p>\n<p>concerned has not cleared her retiral dues.<\/p>\n<p>The writ petition was filed on 23.8.2011.<\/p>\n<p>            Learned counsel for the State Shri<\/p>\n<p>Dinbandhu Singh submits that he has already<\/p>\n<p>sent letter to the department.<\/p>\n<p>            In view of the fact that petitioner<\/p>\n<p>retired       long   back          on     31.5.2010           and    also<\/p>\n<p>statement made on oath that there was no<\/p>\n<p>departmental         proceeding               or     any       criminal<\/p>\n<p>proceeding       pending           against          her       and    till<\/p>\n<p>date, no retiral dues have been paid, the<\/p>\n<p>court is of the opinion that writ petition<\/p>\n<p>can be disposed of at this stage directing<\/p>\n<p>the respondents to take steps to clear all<\/p>\n<p>admitted       retiral         dues       of       the     petitioner<\/p>\n<p>within    a    period         of    eight          weeks      from    the<\/p>\n<p>date   of     receipt\/production                   of     a    copy    of<\/p>\n<p>this order. The respondent no.6 is required<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>        to    issue    authorization         within    four    weeks<\/p>\n<p>        from the date of receipt of sanction order<\/p>\n<p>        from the State authority. Respondents\/State<\/p>\n<p>        are    directed       to    issue    sanction       order   in<\/p>\n<p>        respect      of     full   pension,     gratuity,      leave<\/p>\n<p>        encashment etc. within eight weeks from the<\/p>\n<p>        date    of    receipt\/production          of    a    copy   of<\/p>\n<p>        this order.\n<\/p>\n<pre>                     With         above       observation           and\n\n        direction,          the      writ      petition       stands\n\n        disposed of.\n\n\nN.H.\/                                     ( Rakesh Kumar,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
