Public Prosecutor, Mr.L.R.Pujari and learned advocate<br \/>\n\tMr.Soeb Bhoharia   waive service of notice of rule on behalf of the<br \/>\n\trespondent Nos.1 and 2 respectively.\n<\/p>\n<p>The<br \/>\n\tpresent application under Sec.482 of the Code of Criminal Procedure<br \/>\n\thas been filed for quashing of FIR registered as C.R.No.I &#8211; 305 of<br \/>\n\t2010 before Vatva    Police Station, Ahmedabad  for the offences<br \/>\n\tpunishable under Secs.394, 452  and  114 of IPC   in pursuance of<br \/>\n\tcomplaint filed by the respondent No.2-complainant.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mr.Saiyed   for the petitioner, learned Addl.<br \/>\n\tPublic Prosecutor, Mr.L.R.Pujari for the respondent No.1 and learned<br \/>\n\tadvocate, Mr.Soeb Bhoharia  for the respondent No.2.\n<\/p>\n<p>It<br \/>\n\tis jointly submitted by the learned Counsel for the parties that the<br \/>\n\tmatter is settled between the parties and a compromise has been<br \/>\n\tarrived at between the parties and the terms of settlement  is also<br \/>\n\tplaced on the record of the case.  It is submitted by learned<br \/>\n\tadvocate for the petitioner that the petitioner is on bail. The<br \/>\n\tcomplainant is also present before this Court, who is identified by<br \/>\n\tlearned advocate Mr.Soeb Bhoharia for the complainant. It is further<br \/>\n\tsubmitted that all injured witnesses are also present and they are<br \/>\n\tidentified by original complainant.    It is further submitted that<br \/>\n\tnow the complainant  has no grievance against the petitioner.\n<\/p>\n<p>The<br \/>\n\tApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\n\treported in (2008)4  Supreme Court Cases page 582 has<br \/>\n\tobserved as under in paras 5 and<br \/>\n\t7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt<br \/>\nis on the basis of this compromise that the application was filed in<br \/>\nthe High Court for quashing of proceedings which  has been dismissed<br \/>\nby the impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>6.<br \/>\n\t Applying the ratio of the aforesaid decision of the Apex Court to<br \/>\n\tthe facts of the present case, I am of the opinion that this Cri.<br \/>\n\tMisc. Application is required to be allowed and the parties be<br \/>\n\tpermitted to compound the offence.\n<\/p>\n<p>7.<br \/>\n\t    In the result, this Cri. Misc. Application is allowed. The<br \/>\n\tcomplaint being  C.R.No.I &#8211; 305 of 2010 registered before<br \/>\n\tVatva    Police Station, Ahmedabad and the proceedings therein are<br \/>\n\trequired to be quashed and are accordingly quashed. Rule is made<br \/>\n\tabsolute.
