No.41302 of 2008\n    Md.Tamanna Haidar, son of Late Haider Ali, village Mathurapur, PS Warisnagar, Dist.\n                                Samastipur - Petitioner.\n                                         Versus\n                                     State Of Bihar\n                                        -----------\n<\/pre>\n<p>2     28.7.2011                       Heard learned counsel for the petitioner and the<\/p>\n<p>                          counsel appearing on behalf of the State.\n<\/p>\n<p>                                      This application has been filed for quashing the order,<\/p>\n<p>                          dated 21.4.2008 passed in Warisnagar PS Case No. 241\/2007 by<\/p>\n<p>                          the C.J.M, Samastipur by which cognizance for the offences under<\/p>\n<p>                          sections 341, 323, 379, 307, 504 and 506\/34 of the Penal Code.<\/p>\n<p>                                      The First Information Report has been instituted on<\/p>\n<p>                          behalf of the Principal of the Madrasa wherein he claims that at<\/p>\n<p>                          about 8 AM the petitioner came and threatened to kill him and<\/p>\n<p>                          some other persons. It is also alleged that he took away Rs.5000\/-<\/p>\n<p>                          from his house.\n<\/p>\n<p>                                      Learned counsel     for the petitioner submits that on<\/p>\n<p>                          bare perusal of the First Information Report it is evident that no<\/p>\n<p>                          case is made out under section 323, much less, under section 307<\/p>\n<p>                          of the Penal Code.\n<\/p>\n<p>                                      This court has not issued notice to the informant in<\/p>\n<p>                          this case as the State counsel amply represents the interest of the<\/p>\n<p>                          informant. The First Information Report does not disclose that any<\/p>\n<p>                          overt act was committed nor does it disclose that any injury was<\/p>\n<p>                          inflicted upon the informant and as such this court prima facie<\/p>\n<p>                          finds that the allegations made in the First Information Report are<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        false. If the petitioner had any interest in killing the informant, he<\/p>\n<p>        would have done so, as apparently there was no one to stop him<\/p>\n<p>        from killing the informant at the time of the occurrence.<\/p>\n<p>                    I accordingly remand the matter back to the C.J.M,<\/p>\n<p>        Samastipur to hear the parties and specifically the objection raised<\/p>\n<p>        on behalf of the informant and pass appropriate orders in the case,<\/p>\n<p>        subject to the fact that charges have not been framed in the case.<\/p>\n<p>                    This application is disposed of with the aforesaid<\/p>\n<p>        observation.\n<\/p>\n<p>                    Counsel for the petitioner is directed to produce a copy<\/p>\n<p>        of this order before the court concerned within one month failing<\/p>\n<p>        which this application shall stand dismissed.<\/p>\n<pre>haque                                          ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Tamanna Haidar vs State Of Bihar on 28 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
