No.40733 of 2008\n    Akshyabar Ojha, Son of late Parmhans Ojha, Resident of Village Kharahatar, District Buxar ----\n                                              Petitioner\n                                               Versus\n                                  State Of Bihar ---- Opposite Party\n                                              -----------\n<\/pre>\n<p>2          26.7.2011                     Heard learned counsel for the petitioner and the counsel<\/p>\n<p>                             appearing on behalf of the State.\n<\/p>\n<p>                                         The petitioner has challenged the order of cognizance<\/p>\n<p>                             dated 19.4.2008 under Sections 302 and 120(B)\/34 of the Indian Penal<\/p>\n<p>                             Code and 25(1-B) a, 26 35 of the Arms Act.\n<\/p>\n<p>                                         Learned counsel for the petitioner submits that he was not<\/p>\n<p>                             seen at the place of occurrence.
