1.\tThe present
\napplication has been filed for grant of anticipatory bail under sec.
\n438 of the Code of Criminal Procedure in connection with C.R. No.
\nI-519\/2010 registered with Naroda Police Station,  for the alleged
\noffences under sec. 381 of IPC.\n<\/p>\n
2.\tLearned advocate Mr.
\nBarot submitted that as it is evident from the complaint, the offence
\nis alleged to have been committed 1\u00bd years before filing of
\nthe complaint. He referred to the FIR as well as other papers and
\nsubmitted that he is a suspect about the alleged offence that the
\napplicant who was an employee of the complainant was passing on
\nphotographs and other details to the competitor for which the offence
\nhas been registered.  It was submitted that the mobile phone was
\ntaken from him which has been returned to the applicant.  Learned
\nadvocate Mr. Barot also submitted that he will co-operate in the
\ninvestigation  and the present application may therefore be allowed
\nsubject to any condition.\n<\/p>\n
3.\tLearned APP Mr.
\nNanavaty resisted the application and submitted that for the offence
\ncommitted custodial interrogation may be required for recovery of the
\nmaterial which is alleged to have been stolen. He submitted that if
\nthe mobile phone is recovered, it would give further clue for the
\ninvestigation.\n<\/p>\n
4.\tLearned Sr. Counsel
\nMr. SV Raju appearing for the complainant  has submitted referring to
\nthe FIR and other papers that earlier also a complaint was filed on
\n18.8.2008. He also submitted that from the mobile phone the
\nphotographs which have been taken by the applicant were downloaded
\nand the print of phone calls from the mobile is also taken. He
\ntherefore submitted that the present application may not be
\nentertained.\n<\/p>\n
5.\tIn view of rival
\nsubmissions, it is required to be considered whether the present
\napplication can be considered or not.\n<\/p>\n
6.\tIt is well accepted
\nthat the discretion under sec. 438 of CrPC is required to be
\nexercised with care and circumspection. At the same time, the
\nobservations made by the Hon’ble Apex Court in a judgment in the case
\nof Shri
\nGurbaksh Singh Sibia and ors. V. State of Punjab reported
\nin (1980) 2
\nSCC 565 with regard to exercise of discretion under sec. 438 are
\nrequired to be appreciated.\n<\/p>\n
7.\tThe complaint is
\nfiled in respect of the incident which is alleged to have taken place
\n1\u00bd years back. Learned Sr. Counsel Mr. Raju has stated that
\nearlier also a complaint has been filed, meaning thereby that even
\nafter the complaint, his services continued.  Further, the
\nphotographs from the mobile phone were downloaded with print of the
\nmobile phone call numbers and it has been returned.\n<\/p>\n
8.\tTherefore, without
\nany further elaboration, considering the guidelines for exercise of
\ndesertion under sec. 438, it is a fit case to exercise such
\ndiscretion considering the rival submissions including the business
\nrivalry and the present application deserves to be allowed.\n<\/p>\n
9.\tThe application is
\naccordingly allowed. The applicant is ordered to be released on bail
\nin the event of his arrest in connection with C.R. No. I-519\/2010
\nregistered with Naroda Police Station in respect of the offence
\nalleged against him on his executing a personal bond of Rs. 25,000\/-
\n(Rupees Twenty Five Thousand only) each with one solvent surety for
\nthe like amount  and on further conditions that he shall :\n<\/p>\n
(a)\tremain present
\nbefore the trial court regularly as and when directed on the dates
\nfixed;\n<\/p>\n
(b)\tremain present at
\nthe concerned Police Station on 12.10.2010 between 11.00 am and 2.00
\npm.\n<\/p>\n
(c )\tmake himself
\navailable for interrogation by the police officer whenever and
\nwherever required.\n<\/p>\n
(d)\tnot directly or
\nindirectly make any inducement, threat or promise to any person
\nacquainted with the facts of the case so as to dissuade him from
\ndisclosing such facts to the court or to any police officer;\n<\/p>\n
(e)\tnot to obstruct or
\nhamper the police investigation and not to play mischief with the
\nevidence collected or  yet to be collected by the police;\n<\/p>\n
(f)\tat the time of
\nexecuting the bond, furnish his address to the I.O. and the courts
\nconcerned, and shall not change his residence till the final disposal
\nof the case or till further orders;\n<\/p>\n
(g)\tnot to leave India
\nwithout the permission of the court and if having a passport, shall
\ndeposit the same before the trial court within a week;\n<\/p>\n
10.\tIt is also directed
\nthat at the time of reporting, he will hand over the mobile phone
\nwhich is alleged to have been used for the purpose of committing the
\nalleged offence and it will be open for the I.O. whether to seize it
\nor not.\n<\/p>\n
11.\tIt would be open to
\nthe I.O. to file an application for remand if he considers it proper
\nand just and the learned Magistrate would decide it on merits.\n<\/p>\n
12.\tThis order will hold
\ngood if the applicant is arrested at any time within 90 days from
\ntoday.  The order for release on bail will remain operative only for
\na period of 10 days from the date of his arrest during which it will
\nbe open to the applicant to make a fresh application for being
\nenlarged on bail in usual course which, when it comes before the
\ncompetent court, will be disposed of in accordance with law having
\nregard to all the attending circumstances and the materials available
\nat the relevant time uninfluenced by the act that anticipatory bail
\nwas granted.\n<\/p>\n
\tRule is made absolute.\n<\/p>\n
