COMMISSIONER - Respondent(s)\n \n\n===================================== \nAppearance\n: \nMR DM AHUJA for Petitioner(s) :\n1, \nNone for Respondent(s) :\n1, \n=====================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAVI R.TRIPATHI\n\t\t\n\t\n\n \n\nDate\n: 30\/08\/2011  \n \nORAL ORDER<\/pre>\n<p>1.0\tOften<br \/>\nit is felt that howsoever good may be the intention of the<br \/>\nlegislature and howsoever benevolent may the attempt on the part of<br \/>\nthe authorities, there are always people like the petitioner who can<br \/>\nnegative all the benevolent legislations and the benevolent actions<br \/>\nof the authorities.  This is one such case.\n<\/p>\n<p>2.0\tIn<br \/>\nthis case, inquiry under Section 7A of the Employees&#8217; Provident Fund<br \/>\nand Miscellaneous Provisions Act, 1952 (hereinafter referred to as<br \/>\n&#8216;the PF Act&#8217;) was held against M\/s. Lao More Biscuits Pvt. Ltd.,<br \/>\nthe petitioner herein.  The inquiry was concluded on 31st<br \/>\nOctober 2003.  Though it was not submitted by the learned advocate<br \/>\nMr. DM Ahuja for the petitioner, during the course of the argument,<br \/>\nwhen the Court inquired as to what is the order, the learned advocate<br \/>\nfor the petitioner submitted that by this order dated 31st<br \/>\nOctober 2003, the authority has decided &#8216;the issue of applicability<br \/>\nof the Act&#8217; to the petitioner &#8211; Unit.  This could not have been<br \/>\nin absence of deliberate attempt on the part of the petitioner to<br \/>\nshunt off the decision &#8211; the determination of moneys due from<br \/>\nemployers.  At one place the authority has recorded that:\n<\/p>\n<p>&#8220;As<br \/>\nthe recommendation of the Enforcement Officer was to cover the unit<br \/>\nas a contractor of another establishment M\/s. Parle Products Pvt.<br \/>\nLtd., Bombay, which was situated in the State of Maharashtra, a<br \/>\nreference was made by the office of the Regional Provident Fund<br \/>\nCommissioner Gujarat State, Ahmedabad (hereinafter referred to as<br \/>\n&#8216;the Department&#8217;) for securing their no objection for coverage of<br \/>\nM\/s. Lao More Biscuits Pvt. Ltd. by the Regional Provident Fund<br \/>\nCommissioner, Ahmedabad.   In the meantime as per the<br \/>\ndecision taken by the department to afford an opportunity to the unit<br \/>\nto represent their case regarding applicability of the Act to it, a<br \/>\nhearing was afforded under  Section 7A of the Employees&#8217;<br \/>\nProvident Fund s &amp; Miscellaneous Provisions Act, 1952 on<br \/>\n10\/12\/1992.  Accordingly, summons under Section 7-A was issued to the<br \/>\nunit asking them to represent their case on 10\/12\/1992.  On the said<br \/>\ndate, Shri S.L. Phalguni attended the proceedings and requested for<br \/>\nan adjournment  and the proceedings were adjourned<br \/>\nfrom time to time for 89 occasions.  During the course<br \/>\nof proceedings Shri S.C. Desai, Advocate appeared on behalf of the<br \/>\nestablishment and department was represented by different officers<br \/>\nfrom time to time depending upon the officer holding the charge of<br \/>\nthe relevant sections.  During the course of proceedings on different<br \/>\ndates, the Employees&#8217; Provident Fund Organization has taken a<br \/>\ndecision that the matter regarding applicability of a particular unit<br \/>\nwill be decided by the Regional PF Commissioner in whose jurisdiction<br \/>\nthe unit is situated.  Accordingly though there was no reply received<br \/>\nfrom Regional PF Commissioner, Maharashtra, the code No. under the<br \/>\nAct was issued to the unit vide department letter No.<br \/>\nAM\/25370\/ENEIV\/322 dated 24.7.1995 extending the provisions of the<br \/>\nAct to the unit w.e.f. 9\/1991 under the schedule head &#8216;Biscuits<br \/>\nMaking Industries&#8217;.  On receipt of the said letter the unit<br \/>\nhas raised objection vide its application dated 16.9.1995 stating<br \/>\nthat M\/s. Lao More Biscuits Pvt. Ltd., Ahmedabad is not coverable<br \/>\nunder the Employees&#8217; Provident Funds and Miscellaneous Provisions<br \/>\nAct, 1952 as it is not completed 3 years from the date of set up.<br \/>\nThe contention of the establishment communicated through various<br \/>\nletters as well as submissions made during the course of proceedings<br \/>\nunder Section 7-A are&#8230;&#8221; (emphasis<br \/>\nsupplied)    <\/p>\n<p>2.1\tThis<br \/>\norder dated 31st October 2003 was the subject matter of<br \/>\nappeal being ATA No. 305(5)2004 which came to be disposed of by order<br \/>\ndated 29th October 2010.  The learned advocate for the<br \/>\npetitioner vehemently submitted that both the orders are contrary to<br \/>\nlaw and the petitioner be held to be entitled to the benefits of<br \/>\nSection 16(1)(d) of the PF Act, though, today, that section does not<br \/>\nfind place on the Statute Book because it is already deleted with<br \/>\nretrospective effect from 22nd September 1997 by Act of<br \/>\n1998.\n<\/p>\n<p>3.0\tHaving<br \/>\nperused the order passed by the authority under the PF Act and having<br \/>\nperused the order passed in appeal, the Court finds no substance in<br \/>\nthe petition.\n<\/p>\n<p>3.1\tAt<br \/>\nthis juncture, the learned advocate for the petitioner placed<br \/>\nreliance on a decision of the Rajashthan High Court, Jaipur Bench in<br \/>\nthe matter of Aditya Synthetics Pvt. Ltd. (M\/s.) Vs. Union of<br \/>\nIndia, reported in RLW (Rajashthan) 2 (1993) 193.  The learned<br \/>\nadvocate for the petitioner submitted that this decision is relied by<br \/>\nthe appellate authority against the petitioner, but, according to the<br \/>\nlearned advocate for the petitioner, the said decision is in favour<br \/>\nof the petitioner.\n<\/p>\n<p>3.2\tTaking<br \/>\ninto consideration the age of the litigation and the way it is<br \/>\nprolonged getting  adjournments on 89 occasions, the petition is<br \/>\ndismissed without imposing any cost.\n<\/p>\n<p>[<br \/>\nRavi R.
