PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.Sanjeet Purohit, for the petitioner.\n<\/p>\n<p>                        &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>    Heard learned counsel for the petitioner.\n<\/p>\n<p>    The petitioner is facing the prosecution in<br \/>\npursuance   of   the   FIR   lodged   against   him   under<br \/>\nSections 7 and 13(1)(d)(2) of the Prevention of<br \/>\nCorruption Act, 1988 read with Section 120B IPC.<br \/>\n    According to the petitioner, the appointing<br \/>\nauthority considered all the facts and thereafter<br \/>\nreached to the conclusion that it is not a fit<br \/>\ncase for grant of sanction for prosecution of the<br \/>\npetitioner. However, the Deputy Secretary to the<br \/>\nGovernment of Rajasthan, Department of Energy vide<br \/>\ncommunication dated 24.12.2009 (Annex.8) and the<br \/>\nSecretary (Administration), Jodhpur Discom stated<br \/>\nthat the prosecution sanction be issued. According<br \/>\nto learned counsel for the petitioner, once the<br \/>\nappointing authority has decided that it is not a<br \/>\nfit case for grant of prosecution sanction, then<br \/>\nhe cannot at the instance of the other authorities<br \/>\ngrant the prosecution sanction.\n<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>      Learned counsel for the petitioner relied upon<br \/>\ntwo judgments of this Court namely, (1) <a href=\"\/doc\/141371448\/\">Kishan Lal<br \/>\nvs. State of Raj. &amp; Ors.<\/a> reported in 2009(2) RLW<br \/>\n1412 (Raj.) and (2) unreported judgment delivered<br \/>\nin the case of Hanuman Singh Vishnoi vs. State of<br \/>\nRaj. &amp; Ors. decided on 14.10.2009.\n<\/p>\n<p>      I    considered      the        submissions     of    learned<br \/>\ncounsel for the petitioner and perused the facts<br \/>\nof the case as well as considered the judgments<br \/>\nrelied upon by him.\n<\/p>\n<p>      It is clear from both the judgments referred<br \/>\nabove that in those cases, after the direction of<br \/>\nthe     Deputy     Secretary      to     the    Government\/Higher<br \/>\nAuthority\/Other           Authority,           the      prosecution<br \/>\nsanction was granted by the appointing authority,<br \/>\ntherefore, this Court interfered in those orders<br \/>\ngranting prosecution sanction. After two judgments<br \/>\nreferred above, the position became more clear and<br \/>\nthe appointing authority&#8217;s duties are very much<br \/>\nclear     and    unless   these    two    documents are          acted<br \/>\nupon by the appointing authority, the petitioner<br \/>\ncannot     challenge      the    recommendation         only     which<br \/>\nitself       has    no    penal        consequences        and    the<br \/>\nauthorities are yet to examine the effect of the<br \/>\ndirections issued in Annexures-8 and 9, therefore,<br \/>\nat    this       stage,   no      case     is    made      out     for<br \/>\ninterference of this Court.\n<\/p>\n<p><span class=\"hidden_text\">                         3<\/span><\/p>\n<p>    In view of the above, this writ petition is<br \/>\nhereby dismissed.\n<\/p>\n<p>    However, the petitioner will be free to avail<br \/>\nthe appropriate remedy at appropriate stage if the<br \/>\nprosecution sanction is granted against him.\n<\/p>\n<p>                               (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Rajendra Singh Meena vs Jodhpur Vidhyut Vitaran Nigam &#8230; on 10 February, 2010 1 S.B.
