{"id":94308,"date":"2009-02-18T00:00:00","date_gmt":"2009-02-17T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-basanti-lal-singhvi-vs-ministry-of-home-affairs-mha-on-18-february-2009"},"modified":"2016-04-14T21:09:38","modified_gmt":"2016-04-14T15:39:38","slug":"shri-basanti-lal-singhvi-vs-ministry-of-home-affairs-mha-on-18-february-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-basanti-lal-singhvi-vs-ministry-of-home-affairs-mha-on-18-february-2009","title":{"rendered":"Shri Basanti Lal Singhvi vs Ministry Of Home Affairs (Mha) on 18 February, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Basanti Lal Singhvi vs Ministry Of Home Affairs (Mha) on 18 February, 2009<\/div>\n<pre>                       Central Information Commission\n                 Adjunct to Appeal No. CIC\/WB\/A\/2007\/00518 dated 22-3-2007\n                          Right to Information Act 2005 - Section 19\n\nAppellant:             Shri Basanti Lal Singhvi\nRespondent:            Ministry of Home Affairs (MHA)\n\n\n                                        ORDER\n<\/pre>\n<p>In our decision of 31.7.2008 we had held as follows:\n<\/p>\n<blockquote><p>         From the above it is clear that the disclosure of information sought<br \/>\n         in the present application will not, in the view of Speaker, Lok<br \/>\n         Sabha, breach the exemption from disclosure granted u\/s 8 (1) (c)<br \/>\n         CPIO Shri NN Perumal, Director MHA will now provide the<br \/>\n         information sought by appellant Shri Basanti Lal Singhvi, which<br \/>\n         will now be disclosed to him within 20 days of the date of receipt<br \/>\n         of this decision notice, allowing for 5 days for issue of notice to the<br \/>\n         third party and a further 10 days for the third party to respond.\n<\/p><\/blockquote>\n<blockquote><p>         Shri Basanti Lal, complainant has filed several complaints of non-\n<\/p><\/blockquote>\n<p>compliance before us, in which he has contended that the Central Public<br \/>\nInformation Officer, Ministry of Home Affairs, has not provided the requisite<br \/>\ninformation, arising from the direction of the Commission, to him till date.\n<\/p>\n<p>         The Commission called for a compliance report from the CPIO MHA.<br \/>\nFrom the records it appears that instead of complying with the orders of the<br \/>\nCommission the concerned public authority has made a further reference to the<br \/>\nLok Sabha Secretariat. On the examination of records it is observed that in<br \/>\ncompliance with the orders of the Central Information Commission, a notice has<br \/>\nbeen issued to the third party i.e. erstwhile Maharaja of Udaipur to make a<br \/>\nsubmission in writing or orally regarding the disclosure of the information asked<br \/>\nfor by the appellant. A copy of the notice appears to have also been sent to the<br \/>\nChief Secretary, Government of Rajasthan for causing service on the third<br \/>\nparty.\n<\/p>\n<p><span class=\"hidden_text\">                                            1<\/span><\/p>\n<p>       It is astonishing that the Commission has been kept in the dark inasmuch<br \/>\nas neither the copy of the reference made to the Lok Sabha Secretariat, nor<br \/>\neven a copy of the notice issued to the third party has been marked to the<br \/>\nCommission. The Notice to the third party having been issued on 3rd October<br \/>\n2008, but what followed thereafter is not known, despite the setting of a clear<br \/>\ntime frame by this Commission in its directions. If the department has come to<br \/>\nknow that the property in question is a private property rather than a State<br \/>\nproperty, as stated by them, nothing prevented them from approaching this<br \/>\nCommission. We have thus been given reason to believe that the department<br \/>\nmore particularly the CPIO has willfully disobeyed the orders of the Commission<br \/>\nand has thereafter obstructing providing of the information as ordered by the<br \/>\nCommission.\n<\/p>\n<p>      Now therefore CPIO, Shri N.M. Perumal, Director Ministry of Home<br \/>\nAffairs, is hereby directed to show cause as to why a maximum penalty of<br \/>\nRs. 25,000\/- should not be not imposed on him under section 20 (1) of the<br \/>\nRTI Act 2005 for having willfully obstructed furnishing of information to<br \/>\nappellant Shri Basanti Lal Singhvi in compliance with the orders of the<br \/>\nCommission. He shall do so by personal appearance on 9.3.&#8217;09 at 4.00 pm at<br \/>\nRoom No. 306, 2nd floor, B Wing, August Kranti Bhawan, Bhikaji Cama Place,<br \/>\nNew Delhi<\/p>\n<p>(Wajahat Habibullah)<br \/>\nChief Information Commissioner<br \/>\n18.2.2008<\/p>\n<p>Authenticated true copy.
