GOPAL SHARAN, ADVOCATES\n                               -----------\n<\/pre>\n<p>9   28-1-2011              Heard learned counsel for the appellant and learned<\/p>\n<p>                 counsel for the respondent.\n<\/p>\n<p>                           By the judgment and order under appeal dated 11th<\/p>\n<p>                 December, 2009 the learned Principal Judge, Family Court,<\/p>\n<p>                 Rohtas at Sasaram has dismissed appellant&#8217;s Matrimonial Suit<\/p>\n<p>                 bearing no. 102 of 2006 and has refused to dissolve the<\/p>\n<p>                 marriage by grant of decree of divorce under section 13 of the<\/p>\n<p>                 Hindu Marriage Act,1955.\n<\/p>\n<p>                           The material issues for the purpose of divorce were<\/p>\n<p>                 issue nos.3 and 4 dealing with the allegations of illicit relation<\/p>\n<p>                 of respondent with other person who was not made a party as<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>per Patna High Court Rules and cruelty by the respondent<\/p>\n<p>against the appellant.\n<\/p>\n<p>          The discussion made by the learned Principal Judge<\/p>\n<p>with regard to these issues discloses that the appellant was the<\/p>\n<p>sole witness from his side and the court found that he failed to<\/p>\n<p>prove the allegations of adultery as well as that of cruelty.<\/p>\n<p>The respondent has filed written statement and alleged<\/p>\n<p>demand of dowry and cruelty to her and she examined herself<\/p>\n<p>as well as two other witnesses in support of her case. It has<\/p>\n<p>come on record that appellant had alleged illicit relation of the<\/p>\n<p>respondent with a person who as per evidence of the<\/p>\n<p>respondent, was her uncle and the Court found the allegation<\/p>\n<p>to be without any evidence. It has also come on record that<\/p>\n<p>out of the wed-lock a daughter was born to the parties in<\/p>\n<p>1993. From submissions advanced at bar, it is clear that the<\/p>\n<p>daughter was living with her mother and she arranged for her<\/p>\n<p>marriage but due to unfortunate accident she died in the year<\/p>\n<p>2010.\n<\/p>\n<p>          After carefully going through the material, we do<\/p>\n<p>not find any such evidence or circumstances which may<\/p>\n<p>persuade us to reverse the findings given by the Family Court.<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>         The acts of torture were allegedly directed also against the<\/p>\n<p>         parents of the appellant but he did not examine them as<\/p>\n<p>         witnesses nor anyone-else has come to support his evidence.<\/p>\n<p>                   In the facts and circumstances of the case, we find<\/p>\n<p>         no good ground to entertain this appeal.
