Advocate\n\nHon'ble Ashok Srivastava,J.\n<\/pre>\n<p>This criminal revision has been directed against the<br \/>\njudgment and order dated 22.12.2008 passed by the<br \/>\nlearned Sessions Judge, Basti in Criminal Appeal No.<br \/>\n148 of 2008.\n<\/p>\n<p>An F.I.R. was lodged by one Ram Bahadur with the<br \/>\npolice of Police Station Nawabganj, Gonda on<br \/>\n6.5.2008 under Section 376 I.P.C. against the<br \/>\nrevisionist. It has been alleged in the F.I.R. that on<br \/>\n5.5.2008 in between 10.00 P.M. to 11.00 P.M., the<br \/>\nrevisionist entered the residential house of the<br \/>\ncomplainant and committed rape upon the 7 years<br \/>\nold   grand    daughter       of   the   complainant.   The<br \/>\nrevisionist was arrested and produced before the<br \/>\ncourt. He took a plea before the court that he was a<br \/>\njuvenile on the date of the alleged offence and,<br \/>\ntherefore, he should be declared as such and his<br \/>\nmatter be referred to the Juvenile Justice Board,<br \/>\nBasti (for the sake of convenience hereinafter<br \/>\nreferred to as &#8216;Board&#8217;). Thereafter the matter was<br \/>\nreferred to the Board. After hearing both the parties,<br \/>\nthe Board vide its order dated 18.9.2008 held that the<br \/>\nrevisionist was a juvenile on the relevant date.<br \/>\nThereafter an application for bail under Section 12 of<br \/>\nThe Juvenile Justice (Care and Protection of<br \/>\n Children) Act, 2000 (for the sake of convenience<br \/>\nhereinafter referred to as &#8216;Act&#8217;) was moved before the<br \/>\nBoard. After hearing both the parties, the bail<br \/>\napplication was rejected. Feeling aggrieved by the<br \/>\nsaid order passed by the Board, the revisionist filed<br \/>\nCriminal Appeal No. 148 of 2008 before the learned<br \/>\nSessions Judge, Basti under the provisions of<br \/>\nSection 52 of the Act. After hearing, the learned<br \/>\nSessions Judge dismissed the appeal. Feeling<br \/>\naggrieved by the said judgment, the present revision<br \/>\nhas been filed.\n<\/p>\n<p>I have heard learned counsel for the parties and<br \/>\nperused the records.\n<\/p>\n<p>It has been submitted from the side of the revisionist<br \/>\nthat the judgment and order impugned herein is bad<br \/>\nin the eyes of the law and the learned Sessions<br \/>\nJudge has failed to apply his mind in the matter in a<br \/>\nproper manner. It has been further submitted that the<br \/>\nlearned Sessions Judge as well as learned Board<br \/>\nhad overlooked the mandatory provisions of the Act<br \/>\nand the law laid down by this court and also of the<br \/>\nApex Court. It has also been submitted that the<br \/>\nlearned Board while passing the bail rejecting order<br \/>\ndated 10.11.2008, relied upon certain facts which<br \/>\nactually did not exist. It has further been submitted<br \/>\nthat the report submitted by the District Probation<br \/>\nOfficer before the learned Board is completely in<br \/>\nfavour of the revisionist despite no importance was<br \/>\ngiven to it and this perverse finding of the Board was<br \/>\nconfirmed by the learned Sessions Judge in appeal<br \/>\n without   proper appreciation     of the facts. The<br \/>\nrevisionist has cited a judgment 2006 ADJ 10-543<br \/>\n(Shailendra Kumar Yadav Vs. State of U.P.).<br \/>\nLearned A.G.A. has opposed this revision. He has<br \/>\nsubmitted that the revisionist has committed rape<br \/>\nupon an infant girl of 7 years and it is a crime against<br \/>\nthe society. He has further submitted that in rest of<br \/>\nher life the victim will suffer with this trauma and<br \/>\nalways have a feeling of humiliation while moving in<br \/>\nthe society.\n<\/p>\n<p>In the instant case, the revisionist is admittedly a<br \/>\njuvenile. The Juvenile Justice Act has been enacted<br \/>\nfor the benefit of juvenile offenders. It means that<br \/>\nthey will not be allowed to remain in custody without<br \/>\nany valid reason. For a healthy development of<br \/>\npersonality, a healthy atmosphere should be given to<br \/>\na juvenile offender and it is an indefeasible necessity.<br \/>\nThe Act has been provided for care, protection,<br \/>\ntreatment,     development     and    rehabilitation    of<br \/>\nneglected or delinquent juveniles and for adjudication<br \/>\nof certain matters relating to, and disposition of,<br \/>\ndelinquent juveniles. It is needless to say that this Act<br \/>\nhas got protection of the Indian Constitution. The<br \/>\nIndian Constitution imposes upon the State a primary<br \/>\nresponsibility of ensuring that all the needs of<br \/>\nchildren are met and that their basic human rights are<br \/>\nfully protected. As back as in the year 1989 General<br \/>\nAssembly of the United Nations            adopted      the<br \/>\nConvention on the Rights of the Child wherein a set<br \/>\nof standards to be adhered to by all State parties in<br \/>\n securing the best interest of the child has been<br \/>\nprescribed. To achieve this object, the Act was<br \/>\nenacted in the year 2000.\n<\/p>\n<p>From the perusal of the orders passed by the Board it<br \/>\nis evident that the learned Principal Magistrate has<br \/>\nmentioned that as per the report of the District<br \/>\nProbation Officer, the revisionist belongs to a middle<br \/>\nclass family and the juvenile does not have any<br \/>\ncriminal background. It has also come in his order<br \/>\nthat as per the report of Police Station Nawabganj,<br \/>\nthere was no criminal history behind the revisionist.<br \/>\nNothing has been mentioned in this order that there<br \/>\nexisted any circumstance which may go against him.<br \/>\nDespite, the learned Board has presumed that if the<br \/>\njuvenile is released on bail, he may come into contact<br \/>\nof known or unknown criminals. I do not find that<br \/>\nthere is any rationale in the reasonings given by the<br \/>\nlearned Principal Magistrate presiding the Board.<br \/>\nRather it is based on conjectures and surmises.<br \/>\nNow let us examine the judgment and order passed<br \/>\nby the learned Sessions Judge, Basti which is<br \/>\nimpugned herein. In the last but one para of his<br \/>\njudgment, the learned Sessions Judge has said that<br \/>\nthe findings of the Juvenile Justice Board is sound<br \/>\nand based on records. He has dealt with the mental<br \/>\ncondition of the victim and has said that incident has<br \/>\ndestroyed the entire psychology of the girl and she<br \/>\nmay be pushed into deep mental problem. In the<br \/>\ninstant case the revisionist is a juvenile. He cannot<br \/>\nbe kept at par with an adult accused. There is a<br \/>\n separate law for juveniles and therefore the other<br \/>\nface of the coin should also be seen while disposing<br \/>\nof such matters. The Act has been enacted with a<br \/>\nspecific   purpose     and   that   is   the   immature<br \/>\nunderstanding of the alleged crime by a juvenile. The<br \/>\njuvenile cannot be put on the same footing upon<br \/>\nwhich an adult can be kept. In my opinion, the<br \/>\nlearned Sessions Judge has not considered at all the<br \/>\npurpose for which the Act has been enacted.<br \/>\nSection 12 of the Act makes it mandatory that if a<br \/>\njuvenile is arrested or detained or appears or is<br \/>\nbrought before a Board, he shall be released on bail.<br \/>\nHe shall shall not be released if there appear<br \/>\nreasonable grounds for believing that the release is<br \/>\nlikely o bring him into association with any known<br \/>\ncriminal or expose him to moral, physical or<br \/>\npsychological danger or that his release would defeat<br \/>\nthe ends of justice.\n<\/p>\n<p>In the instant case no facts have been mentioned by<br \/>\nthe Board which may indicate that if the juvenile is<br \/>\nreleased on bail, he will come into association with<br \/>\nany known criminal. There is no fact either in the<br \/>\norder of the Board that the release is likely to bring<br \/>\nthe juvenile into association of such person which<br \/>\nmay expose him to moral, physical and psychological<br \/>\ndanger. As far as the last para of Section 12 (1) of<br \/>\nthe Act,&#8221; that the release of the juvenile would defeat<br \/>\nthe ends of justice,&#8221; is concerned, I do not find any<br \/>\nfact which may indicate that the juvenile, if release on<br \/>\nbail, will be hazardous to society or he may be in a<br \/>\n position to cause anything which may be termed as<br \/>\nsomething abnoxious or dangerous to the society at<br \/>\nlarge.\n<\/p>\n<p>In the circumstances mentioned above, I am of the<br \/>\nview that the order passed by the Board and<br \/>\nconfirmed by the learned Sessions Judge, Basti are<br \/>\nnot based on sound reasonings and should be set<br \/>\naside. As a consequence the revision is allowed.<br \/>\nIn the instant case it is also to be seen that the<br \/>\nalleged crime is heinous. Therefore, it appears<br \/>\nnecessary that the revisionist should be released on<br \/>\nbail but he should be in constant supervision of the<br \/>\nDistrict Probation Officer of the district concerned till<br \/>\nthe disposal of the matter pending before the Board.<br \/>\nLet the revisionist, Shiv Poojan alias Ram Poojan be<br \/>\nreleased on bail in Case Crime No. 170 of 2008,<br \/>\nunder Section 376 I.P.C., Police Station Nawabganj,<br \/>\nDistrict Gonda on furnishing a personal bond of the<br \/>\nfather\/legal guardian with two reliable sureties each<br \/>\nin the like amount to the satisfaction of the Juvenile<br \/>\nJustice Board, Basti.\n<\/p>\n<p>The father of the revisionist, Shiv Poojan alias Ram<br \/>\nPoojan is directed to keep the revisionist under his<br \/>\nguidance and will make an endeavour to ensure that<br \/>\nhe may not commit any act which may be termed as<br \/>\nillegal, immoral or against the norms of the society.<br \/>\nThe revisionist shall be placed under the supervision<br \/>\nof the District Probationary Officer of the district<br \/>\nconcerned till the disposal of the matter as already<br \/>\nmentioned above.
