ABDUL REHIM, J.\n             =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n                 W.P.(C) No. 24696 of 2010\n             =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n          Dated this the 8th day of September, 2010\n\n                           JUDGMENT\n<\/pre>\n<p>      Ext.P7 assessment finalized under the provisions of<\/p>\n<p>the Kerala Buildings Tax Act, 1975 is under challenge in this<\/p>\n<p>writ petition.\n<\/p>\n<p>        2. The petitioners are adjacent land owners, who had<\/p>\n<p>constructed buildings in their respective plots, after<\/p>\n<p>obtaining separate building permits from the local authority.<\/p>\n<p>It is stated that cost of construction of the buildings were<\/p>\n<p>met separately by the petitioners. It is also stated that on<\/p>\n<p>completion of construction separate building numbers were<\/p>\n<p>assigned by the local authority.\n<\/p>\n<p>       3. Assessment under the Kerala Building Tax Act was<\/p>\n<p>completed by the 1st respondent on issuing Ext.P3 order,<\/p>\n<p>treating both the buildings as a single unit, on the basis of<\/p>\n<p>the finding that the building is situated as a single unit<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24696\/2010         2<\/span><\/p>\n<p>without any separation and it is being used as a single unit<\/p>\n<p>by occupying both portions together by the same tenant.<\/p>\n<p>        4. Against Ext.P3 assessment, an appeal was filed by<\/p>\n<p>the petitioners, which culminated in Ext.P5 order. The<\/p>\n<p>appellate authority remanded the matter to the 1st<\/p>\n<p>respondent with a direction to take a fresh decision in the<\/p>\n<p>matter, after considering the documents and other records.<\/p>\n<p>Ext.P7 is the consequential order issued by the 1st<\/p>\n<p>respondent. It is mentioned in Ext.P7 that a further<\/p>\n<p>opportunity of hearing was afforded to the petitioners. The<\/p>\n<p>petitioners contended before the 1st respondent that the<\/p>\n<p>buildings are owned separately by the petitioners and the<\/p>\n<p>buildings are constructed on the basis of separate permits<\/p>\n<p>and separate building numbers were allotted to each of the<\/p>\n<p>buildings. It is further contended that there is separate lifts,<\/p>\n<p>separate staircases, separate water meters etc. and the<\/p>\n<p>letting of each building is made separately. But the 1st<\/p>\n<p>respondent observed that on the basis of inspection report<\/p>\n<p>dated 27-8-2008 (which is an inspection conducted before<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24696\/2010          3<\/span><\/p>\n<p>finalizing the assessment at the first stage) and on the basis<\/p>\n<p>of a decisions of this Court reported in <a href=\"\/doc\/1998728\/\">Balan V. Assistant<\/p>\n<p>Collector<\/a> (1990(3) ILR 1045) and <a href=\"\/doc\/360236\/\">K.G.Muraleedharan V.<\/p>\n<p>District Collector, Ernakulam (O.P. No.5479\/2001) the<\/a><\/p>\n<p>buildings need be treated as a single unit and hence<\/p>\n<p>completed the assessment again in the joint name of the<\/p>\n<p>petitioners.\n<\/p>\n<p>        5. It is the contention of the petitioners that after<\/p>\n<p>remand of the matter by the appellate authority, the 1st<\/p>\n<p>respondent had not conducted any personal hearing. On the<\/p>\n<p>other hand, when the petitioners appeared on the date of<\/p>\n<p>hearing only scrutiny of the documents were conducted by a<\/p>\n<p>Superintendent attached to the office of the 1st respondent.<\/p>\n<p>It is further alleged that the Superintendent had assured that<\/p>\n<p>the 1st respondent will conduct a fresh hearing. But no such<\/p>\n<p>hearing was conducted and the impugned order is issued<\/p>\n<p>without any verification of the documents and without<\/p>\n<p>conducting any proper enquiry. It is also contended that<\/p>\n<p>Ext.P7 order does not reflect any application of mind, with<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24696\/2010          4<\/span><\/p>\n<p>respect to the specific contentions raised.<\/p>\n<p>        6. In a statement field on behalf of the 1st respondent<\/p>\n<p>it is mentioned that on the basis of directions contained in<\/p>\n<p>the order of the appellate authority, a hearing was<\/p>\n<p>conducted and one of the petitioners appeared. It is further<\/p>\n<p>stated that on a site inspection it was seen that the building<\/p>\n<p>was constructed as a single unit without any barrier in<\/p>\n<p>between. It is a building constructed as a single unit having<\/p>\n<p>no separate wall, is the contention.\n<\/p>\n<p>        7. Learned Government Pleader contended that the<\/p>\n<p>order impugned in this writ petition is appealable and the<\/p>\n<p>petitioners had approached this Court bye-passing such<\/p>\n<p>remedies. Therefore, the very maintainability of the writ<\/p>\n<p>petition itself was challenged.\n<\/p>\n<p>        8. The question to be considered is as to whether the<\/p>\n<p>1st respondent had issued Ext.P7 order with due advertence<\/p>\n<p>to the contention raised by the petitioners on the basis of<\/p>\n<p>the records produce, on a proper application of mind, with<\/p>\n<p>proper bearing to the observations contained in the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24696\/2010         5<\/span><\/p>\n<p>appellate order. It is evident that the appellate authority<\/p>\n<p>had remitted the matter for a specific consideration of the<\/p>\n<p>issue based on the contentions raised by the petitioners and<\/p>\n<p>also based on documents which need be verified. But the<\/p>\n<p>impugned order does not reflect any reference to any of the<\/p>\n<p>documents, on the basis of which the matter was remanded.<\/p>\n<p>Hence, I am of the opinion that the impugned order does not<\/p>\n<p>satisfy the requirements of a proper exercise of a quasi<\/p>\n<p>judicial function.\n<\/p>\n<p>        9. It is brought to my notice that the petitioners have<\/p>\n<p>already remitted a sum of Rs.1,61,100\/- and further an<\/p>\n<p>amount of Rs.1,20,825\/-.\n<\/p>\n<p>        10. Under the above circumstances, the writ petition<\/p>\n<p>is allowed and Ext.P7 assessment is hereby quashed. The 1st<\/p>\n<p>respondent is directed to reconsider the matter afresh, in<\/p>\n<p>view of the remand made by the appellate authority<\/p>\n<p>(Ext.P5). He shall advert to the claim made by the<\/p>\n<p>petitioners with reference to all the documents produced.<\/p>\n<p>Further opportunity of hearing shall be afforded to them<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 24696\/2010        6<\/span><\/p>\n<p>before finalizing the matter. The 1st respondent shall pass a<\/p>\n<p>speaking order meeting all the contentions raised by the<\/p>\n<p>petitioners.\n<\/p>\n<p>        11. A fresh assessment in this regard shall be<\/p>\n<p>completed as early as possible, at any rate within a period of<\/p>\n<p>one month from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p>        12. Needless to say that recovery of balance amount<\/p>\n<p>can be proceeded only subject to finalization of assessment<\/p>\n<p>as directed above.\n<\/p>\n<\/p>\n<p>                                        C.
