Parikh, learned<br \/>\n\tAdditional Public Prosecutor, waives service of Rule on behalf of<br \/>\n\tthe respondent-State.\n<\/p>\n<p>Present<br \/>\n\tapplication is filed by the applicants under Section 389 of the Code<br \/>\n\tof Criminal Procedure, 1973 to suspend the sentence imposed upon<br \/>\n\tthem vide order dated 14th<br \/>\n\tOctober 2010 passed by the learned Additional Sessions Judge, Fast<br \/>\n\tTrack Court No.1, Bhavnagar, in Special Atrocity Case No.28 of 2007<br \/>\n\tby releasing the applicants-accused on bail during the pendency of<br \/>\n\tthe appeal.\n<\/p>\n<p>Today<br \/>\n\tthis Court has admitted the appeal filed by the applicants-original<br \/>\n\taccused against the judgment and order of conviction and sentence<br \/>\n\tdated 14th<br \/>\n\tOctober 2010 passed by the learned Additional Sessions Judge, Fast<br \/>\n\tTrack Court No.1, Bhavnagar, in Special Atrocity Case<br \/>\n\tNo.28 of 2007. The applicants-accused are on bail at present. Amount<br \/>\n\tof fine is already paid by the present applicants-accused. As the<br \/>\n\tpresent applicants-accused are on bail at present and they  have<br \/>\n\tpaid the fine amount, it would be in the interest of justice to<br \/>\n\tallow this application.\n<\/p>\n<p>In<br \/>\n\tview of above facts and circumstances of the case emerging from the<br \/>\n\trecord and in view of the fact that the applicants are on bail at<br \/>\n\tpresent and the applicants have paid the amount of fine, present<br \/>\n\tapplication is hereby allowed. The substantive sentence is hereby<br \/>\n\tplaced under suspension pending hearing and disposal of the main<br \/>\n\tappeal and the applicants-original accused is hereby ordered to be<br \/>\n\treleased on same<br \/>\n\tbail, fresh bond.\n<\/p>\n<p>\tBail bond to be executed before the concerned trial Court.
