JUSTICE AJAI LAMBA\n\n\nPRESENT: -       Mr. Mansur Ali,              Advocate,   for   the\n                 petitioner.\n\n                 Mr. Kamaldeep Singh Sidhu,                 Deputy\n                 Advocate General, Punjab.\n\n                 Mr.   Vikas  Kumar,    Advocate,               for\n                 respondent Nos.5 to 7.\n\n\n                            .       .    .\n\n\nAJAI LAMBA, J (Oral)\n\n               This     petition        has     been    filed   under\n\n<\/pre>\n<p>Section 482 Cr.P.C. for issuing directions to the<\/p>\n<p>official     respondents      to    register      FIR   against   the<\/p>\n<p>private respondents namely respondent Nos.5 to 7 in<\/p>\n<p>view   of     the    report        of   Agriculture       Department<\/p>\n<p>(Annexure P-7).\n<\/p>\n<p> Crl. Misc. No. M-26951 of 2006                                      [2]<\/p>\n<p>                  The limited question that is required to<\/p>\n<p>be considered in this case is whether prima facie it<\/p>\n<p>has been made out that offence has been committed or<\/p>\n<p>not so as to call for registration of FIR under<\/p>\n<p>Section 154 Cr.P.C.\n<\/p>\n<p>                  Attention of the Court has been drawn<\/p>\n<p>towards (Annexure P-7) that is a memo addressed by<\/p>\n<p>Director, Agriculture, Punjab to Chief Agriculture<\/p>\n<p>Officer, Ferozepur. The memo has been addressed in<\/p>\n<p>the context of judicial proceedings in Civil Writ<\/p>\n<p>Petition No.2707 of 2005 &#8216;Bharat Kumar Vs. State of<\/p>\n<p>Punjab&#8217;.      There       is     a   clear   finding    in   memo     dated<\/p>\n<p>3.6.2005 to the effect that on inquiry it has been<\/p>\n<p>found by the office that business of Fertilizer and<\/p>\n<p>insecticides         is    being       run   in   the    shop   located<\/p>\n<p>outside IBP, Petrol Pump in village Gumjal by Satija<\/p>\n<p>Trading Company. It has further been recorded that<\/p>\n<p>there is a direct violation of Fertilizer Control<\/p>\n<p>Order, 1985 and Insecticides Act. Keeping in view<\/p>\n<p>the findings immediate action against the firm be<\/p>\n<p>taken and information be sent to the Joint Director<\/p>\n<p>(Inputs) for Director, Agriculture, Punjab.<\/p>\n<p>                  Learned counsel for the respondent has<\/p>\n<p>tried to build up a case that subsequent to the<\/p>\n<p>passing      of   the      orders      and   conducting      inquiry      as<\/p>\n<p>reflected from Annexure P-7, the site was inspected.<\/p>\n<p>However, fertilizer and insecticides were not found<\/p>\n<p>in the premises outside IBP, Petrol Pump in village<\/p>\n<p>Gumjal.\n<\/p>\n<p> Crl. No. M-26951 of 2006                                               [3]<\/p>\n<p>                  Learned counsel for the petitioner has<\/p>\n<p>contended        that     there          is      another        shop     of         the<\/p>\n<p>respondent in immediate vicinity where the articles<\/p>\n<p>are     moved.      Admittedly            the      sign     board        of         the<\/p>\n<p>respondent        was     found          near     the     shop       where         the<\/p>\n<p>business is being carried.\n<\/p>\n<p>                  The      issue           whether        the     facts             and<\/p>\n<p>circumstances of the case require registration of<\/p>\n<p>FIR is limited. It is only to be shown prima facie<\/p>\n<p>that an offence has been committed so as to call for<\/p>\n<p>registration        of    FIR.       A    reference       to     Annexure           P-7<\/p>\n<p>indicates        that      prima          facie       offence          has         been<\/p>\n<p>committed. The contents of documents cannot be held<\/p>\n<p>in doubt as the author of the documents is Joint<\/p>\n<p>Director (Inputs) for Director, Agriculture, Punjab.<\/p>\n<p>It    is    addressed          to        Chief    Agriculture           Officer,<\/p>\n<p>Ferozepur,         and     is        in       reference         to      judicial<\/p>\n<p>proceedings in this Court viz. Civil Writ Petition<\/p>\n<p>No.2707 of 2005 &#8216;Bharat Kumar Vs. State of Punjab&#8217;.<\/p>\n<p>                  In view of the above, it was the duty of<\/p>\n<p>the    authorities        to     have         taken     cognizance       of         the<\/p>\n<p>offence committed. The petition is allowed.<\/p>\n<p>                  Official          respondents           are    directed           to<\/p>\n<p>register FIR and proceed with investigation.<\/p>\n<p>                  In     view       of    the    delay     already       caused,<\/p>\n<p>investigation be concluded expeditiously, preferably<\/p>\n<p>within 90 days of receipt of certified copy of this<\/p>\n<p>order.<\/p>\n<pre>\n\n                                                                 (AJAI LAMBA)\n Crl.
