Public Prosecutor and Mr. Sunil Joshi,<br \/>\nlearned advocate waive service of rule on behalf of  respondent Nos.1\n<\/p>\n<p>&#8211; State and 2 respectively.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent application under Sec.482 of the Code of Criminal Procedure<br \/>\nhas been filed for quashing of complaint registered as M Case No.07<br \/>\nof 2005 with Sarkhej Police Station as well as private complaint<br \/>\nbeing Criminal Inquiry Case No.108 of 2005 dated 29.7.2005 pending<br \/>\nbefore 1st Additional Civil Judge and Judicial Magistrate<br \/>\nFirst Class, Ahmedabad Rural alongwith the orders passed thereon and<br \/>\nfurther proceedings in pursuance to the said case for the offences<br \/>\npunishable under Sections 406, 408, 420, 468, 471, 477A and 120B of<br \/>\nIndian Penal Code.\n<\/p>\n<p>3.\t\tMr.Panchal<br \/>\nsubmitted that respondent No.2 &#8211; original complainant &#8211;<br \/>\nNathiben Patel is real aunt of the applicants and the applicants are<br \/>\nthe real nephews of the respondent No.2 &#8211; original complainant<br \/>\nand because of intervention of several family members and mediators,<br \/>\namicable settlement has taken place between respondent No.2 &#8211;<br \/>\noriginal complainant and present applicants. It is further submitted<br \/>\nthat various Civil Suits and RTS proceedings were also pending before<br \/>\nthe competent Court, wherein consent decree has been passed in<br \/>\npursuance of the consent terms arrived at before this Court in First<br \/>\nAppeal No.3265 of 2010. The consent terms arrived at between the<br \/>\nparties is placed on record at Annexure-B.\n<\/p>\n<p>4.\t\tThe<br \/>\nrespondent No.2 &#8211; Nathiben is 90 years old lady. She is<br \/>\nidentified by learned advocate Shri Sunil Joshi. She submitted before<br \/>\nthis Court that she voluntarily entered into settlement and matter is<br \/>\namicably settled and she also requested to quashed the complaint and<br \/>\ncriminal proceedings. Therefore, it is submitted that in view of<br \/>\nsettlement between the parties, complaint be quashed and petition be<br \/>\nallowed. Mr.Panchal, has relied upon following decisions in support<br \/>\nof his submissions: &#8211;\n<\/p>\n<p>(1)\tNikhil Merchant<br \/>\nv\/s. CBI and Anr. [2009 (1) GLH 31]<\/p>\n<p>(2)\tJagdish Chananan &amp;<br \/>\nOrs. v\/s. State of Haryana &amp; Anr. \t[2008 (2) GLH 53]<\/p>\n<p>(3)\tManoj Sharma v\/s.\n<\/p>\n<p>State [JT 2008 (11) SC 674]<\/p>\n<p>5.\t\tIt<br \/>\nis submitted by Mr.Joshi, learned Advocate appearing for respondent<br \/>\nno.2 &#8211; original complainant that matter is settled and that the<br \/>\ncomplainant has no grievance against the present applicants.\n<\/p>\n<p>6.\t\tThe<br \/>\nApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\nreported in (2008)4  Supreme Court Cases page 582 has<br \/>\nobserved as under in paras 5 and<br \/>\n7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt is on the<br \/>\nbasis of this compromise that the application was filed in the High<br \/>\nCourt for quashing of proceedings which  has been dismissed by the<br \/>\nimpugned order.  We notice from a  reading of the FIR and the other<br \/>\ndocuments on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7. We see from the<br \/>\nimpugned order that the learned Judge has confused a compounding of<br \/>\nan offence with the quashing of  proceedings.  The outer limit of<br \/>\nRs.250\/- which has led to the dismissal of the application is an<br \/>\nirrelevant factor in the later case.  We accordingly allow the appeal<br \/>\nand in the peculiar facts of the case, direct that  FIR No.155 dated<br \/>\n17th November 2001 P.S. Kotwali, Amritsar and all proceedings<br \/>\nconnected therewith shall be deemed to be quashed.&#8221;\n<\/p>\n<p>7.\t\tConsidering<br \/>\naforesaid decisions of the Hon&#8217;ble Supreme Court and settlement<br \/>\narrived between the parties, in opinion of this Court, no useful<br \/>\npurpose would be served in continuing with the criminal proceedings<br \/>\nand it will be harassment to the parties.  Hence, a case is made out<br \/>\nto exercise powers under section 482 of Criminal Procedure Code.\n<\/p>\n<p>8.\t\tIn<br \/>\nthe result, present application is allowed.  The complaint registered<br \/>\nas M Case No.07 of 2005 with Sarkhej Police Station as well as<br \/>\nprivate complaint being Criminal Inquiry Case No.108 of 2005 dated<br \/>\n29.7.2005 pending before 1st Additional Civil Judge and<br \/>\nJudicial Magistrate First Class, Ahmedabad Rural alongwith the orders<br \/>\npassed thereon and further proceedings in pursuance to the said case<br \/>\nfor the offences are required to be quashed and are accordingly<br \/>\nquashed. Rule is made absolute to the aforesaid extent.
