Learned Senior Advocate, Mr. Patel invited attention of<br \/>\nthe Court to Page No.56 and read paragraph No.6.27 which reads as<br \/>\nunder:\n<\/p>\n<p>&#8220;6.27\tIt is submitted<br \/>\nthat in fact before the APEC the Appellant had requested that the<br \/>\nconcerned proceedings under Section 7-A of the Act should be<br \/>\nconducted against the concerned contractors and not against the<br \/>\nAppellant but to no avail.  It is however interesting to note that in<br \/>\nregard to one of the contractors namely M\/s. Siddhi Vinayak<br \/>\nEnterprises, the APEC in the impugned order has directed for<br \/>\ninitiating a separate enquiry.  It is reiterated that it is the<br \/>\ncontractors whose establishment had been treated as independent<br \/>\nestablishments under the Act by the PF Department, by issuing them<br \/>\nseparate and distinct PF Code Nos., who are liable for payment of PF<br \/>\nContributions under the Act and not the Appellant.&#8221;\n<\/p>\n<p>2.\t\tNotice<br \/>\nand Notice as interim-relief returnable on 25\/07\/2011.\n<\/p>\n<p>2.1\t\tBy<br \/>\nway of ad-interim-relief  further execution and operation<br \/>\nof order dated 30\/04\/2007 passed under Section 7A by the respondent<br \/>\nNo.1-Assistant Provident Fund Commissioner, Rajkot is stayed.
