The grounds urged in support of<br \/>\nthe applications are that the claim petitions from which the present<br \/>\napplications arise, were effectively heard by the Tribunal and after<br \/>\nfull fledged hearing the award was passed.  It is claimed by the<br \/>\napplicants that the judgment is indivisible and that therefore the<br \/>\nentire award is required to be set aside since one of the opponents<br \/>\nherein i.e. original claimant had expired while the proceedings were<br \/>\npending before the Tribunal, however, the heirs\/legal representatives<br \/>\nof the said deceased was not brought on record and that therefore the<br \/>\naward came to be passed against a dead person person which renders<br \/>\nthe award null and void qua the deceased opponent claimant.  However,<br \/>\nsince the award is indivisible the entire award is required to be set<br \/>\naside.  On such averments, the applications came to be filed in the<br \/>\nyear 2000.\n<\/p>\n<p>\tThe<br \/>\naforesaid details go to show that the first appeals with which the<br \/>\nabove applications are connected have been preferred against the<br \/>\naward passed in November, 1999.  Some of the applications are filed<br \/>\nwith a request to bring heirs\/legal representatives on record while<br \/>\nsome of the applications in this group are filed seeking condonation<br \/>\nof delay and some on the ground of payment.  The fact remains that<br \/>\nsince the date of filing the applications have never been prosecuted<br \/>\nand the applications have remained idle, any step to get the<br \/>\napplications heard and appropriate orders passed have not been taken<br \/>\nby the appellants.\n<\/p>\n<p>\tThe<br \/>\naward which was passed almost 11 years before must have been executed<br \/>\nby now.\n<\/p>\n<p>\tIt<br \/>\nis pertinent to note that in another group of similar applications<br \/>\narising from the same group of claims petitions, by order dated<br \/>\n5\/3\/2010 Rule was issued with a view to giving an opportunity to the<br \/>\napplicants and also with a view to finding out the status of the<br \/>\naward.  However, in the said group the appellants did not bother to<br \/>\npay the process fee also.  Again, even after indulgence shown by the<br \/>\nCourt, the appellants remained dormant and did not take any action to<br \/>\npay the process fee.  Ultimately the Court was constrained to dismiss<br \/>\nthe applications for non prosecution by order dated 31\/3\/2010.\n<\/p>\n<p>\tUpon<br \/>\nhearing the learned advocates it appears that in present group also<br \/>\neven if the process is issued, ultimately same history is going on to<br \/>\nbe repeated and thus application after some time will meet the same<br \/>\nfate.\n<\/p>\n<p>\tAs<br \/>\nnoted above, the award passed in November, 1999 must have been<br \/>\nexecuted by now.  Hence, present applications, even if entertained,<br \/>\nwould not serve any effective purpose.  The applicants appellants are<br \/>\nnot in a position to state anything with regard to the status of the<br \/>\naward.  They also have not taken trouble to find out from their own<br \/>\nrecord and clarify as to whether the compensation amounts have been<br \/>\nalready paid or not.  The fate of the claimants is also unknown.\n<\/p>\n<p>\tConsidering<br \/>\nthe fact that for about 10 years any action have not been taken by<br \/>\nthe applicants appellants in respect of above mentioned applications,<br \/>\nand for all these years the applicants have remained negligent, it<br \/>\nfollows that the applicants are not interested in prosecuting the<br \/>\napplications further.\n<\/p>\n<p>\tThus,<br \/>\nkeeping the development which took place with regard to the Civil<br \/>\nApplication Nos.1686 to 1698 of 2005 wherein the above referred<br \/>\norders dated 5\/3\/2010 and 31\/3\/2010 were passed, it appears that it<br \/>\nwould not be improper or unjust in the peculiar facts and<br \/>\ncircumstances of the case that present applications are allowed to<br \/>\nmeet the same fate.  Hence, the applications are dismissed for non<br \/>\nprosecution.\n<\/p>\n<p>\tIt<br \/>\nis however, clarified that in present group as well as in earlier<br \/>\ngroup of case (which came to be disposed of by order dated 31\/3\/2010)<br \/>\nit would be open to the applicants to move appropriate application<br \/>\nwithin reasonable time from today for appropriate orders if the<br \/>\napplicants appellants can find out the status of the award and can<br \/>\nstate on affidavit the exact status of the award, and also as to<br \/>\nwhether awarded amounts have been deposited or not and disbursed or<br \/>\nnot and if the awarded amount remains deposited with the Tribunal or<br \/>\ninvested, then such request for further appropriate orders may be<br \/>\nconsidered by the Court.
