KRISHNAN, J.\n                   ...........................................\n                  M.A.C.A.No.2891 OF 2008\n                  .............................................\n            Dated this the 15th day of January, 2010.\n\n                         J U D G M E N T\n<\/pre>\n<p>      This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Pala in OP(MV)No.545\/2007. The claimant, a<\/p>\n<p>pillion rider sustained injuries in a road accident and the<\/p>\n<p>Tribunal has awarded him a compensation of Rs.39,100\/=<\/p>\n<p>with 9% interest. The Tribunal exonerated the insurance<\/p>\n<p>company from the liability and directed respondents 1 and<\/p>\n<p>2 to pay the amount. It is aggrieved by that decision,<\/p>\n<p>respondents 1 and 2 in the original petition had come up<\/p>\n<p>in appeal.\n<\/p>\n<p>      2. A perusal of the award would show that the vehicle<\/p>\n<p>was insured by the 2nd respondent under a package policy.<\/p>\n<p>The clause relating to the policy in para-9 is extracted here:<\/p>\n<blockquote><p>            &#8220;Subject to the limits of liability as laid<br \/>\n       down in the Schedule hereto the Company will<br \/>\n       indemnify    the insured in the event of                  an<br \/>\n       accident caused by or arising out of the use<br \/>\n       of the insured vehicle against all sums which<br \/>\n       the insured shall become legally liable to pay<br \/>\n       in respect of<\/p>\n<p>            death of or bodily injury to any person<br \/>\n       including occupants            carried in the insured<\/p>\n<p><span class=\"hidden_text\">                                : 2 :<\/span><br \/>\nM.A.C.A.No.2891 OF 2008<\/p>\n<p>       vehicle including     the persons   carried in a<br \/>\n       motor vehicle ( provided such occupants are<br \/>\n       not carried for hire or reward) but except so<br \/>\n       far as it is necessary to meet the requirements<br \/>\n       Motor Vehicles Act, the Company shall not be<br \/>\n       liable where such death or injury arises out of<br \/>\n       and in the course of the employment of such<br \/>\n       person by the insured.\n<\/p><\/blockquote>\n<blockquote><p>            Damage to property other than property<br \/>\n       belonging to the insured or held in trust or in<br \/>\n       the custody or control of the insured&#8221;.<\/p><\/blockquote>\n<p>      3. This clause had come up for consideration before<\/p>\n<p>the two Division Benches of this court        in   <a href=\"\/doc\/135962\/\">New   India<\/p>\n<p>Assurance Co. Ltd. v. Hydrose<\/a> (2008 (3) KLT 778) and<\/p>\n<p><a href=\"\/doc\/1457758\/\">Mathew v. Shaji Mathew<\/a> (2009 (3) KLT 813). Further by<\/p>\n<p>virtue   of the    clarificatory circular dated 16.11.2009, the<\/p>\n<p>Insurance Regulatory and Development Authority had also<\/p>\n<p>clarified that occupants carried in a private car and pillion<\/p>\n<p>riders carried in a two wheeler are covered under the<\/p>\n<p>standard motor package policy. Therefore in the light of the<\/p>\n<p>two decisions and the clarificatory order it has to be held<\/p>\n<p>that the insurance company is liable to pay the amount. The<\/p>\n<p>finding to the contra is against law and therefore it is set<\/p>\n<p>aside. The insurance company is made liable.<\/p>\n<p><span class=\"hidden_text\">                               : 3 :<\/span><br \/>\nM.A.C.A.No.2891 OF 2008<\/p>\n<p>     In the result, the MACA is allowed and the finding of<\/p>\n<p>exoneration of liability of the insurance company is set aside<\/p>\n<p>and it is made liable to pay the amount. The insurance<\/p>\n<p>company shall deposit the amount within a period of 60<\/p>\n<p>days from the date of receipt of a copy of this judgment.<\/p>\n<p>                                    M.N.
