SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 05\/10\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled challenging the judgment and order passed in O.A. No.165\/1995<br \/>\ndated 29.10.2001 by the Central Administrative Tribunal, Ahmedabad<br \/>\n(for short, &#8220;the C.A.T.&#8221;) as also the order passed in<br \/>\nReview Application No.01\/2002 dated 12.02.2002.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that while the respondent herein was holding the<br \/>\npost of Scientific Assistant &#8216;C&#8217; in the petitioner-Department, he was<br \/>\nserved with a show cause Notice dated 04.06.1991 on the ground that<br \/>\nhe had engaged himself in other gainful employment by impersonating<br \/>\nhimself and thereby, committed breach of the relevant Rules. The<br \/>\nrespondent submitted his reply dated 04.06.1991 to the said Notice<br \/>\nwherein, he admitted his guilt. However, on the very next day, he<br \/>\nsubmitted an explanation denying the charges levelled against him.\n<\/p>\n<p>3.\tThe<br \/>\ndisciplinary authority passed an order whereby, the respondent was<br \/>\nordered to be reverted to the lower post of Scientific Assistant &#8216;B&#8217;<br \/>\nuntil he is found fit after five years from the date of the order to<br \/>\nbe restored to the higher post of Scientific Assistant &#8216;C&#8217;. Against<br \/>\nthe said order of the disciplinary authority, the respondent<br \/>\npreferred an appeal before the appellate authority of the<br \/>\npetitioner-Department. However, the same was rejected. Being<br \/>\naggrieved by the orders passed by the disciplinary and appellate<br \/>\nauthority, the respondent preferred O.A. No.165\/1995 before the<br \/>\nC.A.T. The C.A.T allowed the said application by judgment and order<br \/>\ndated 29.10.2001. The petitioners preferred Review Application<br \/>\nNo.01\/2002 before the C.A.T. However, the said application was<br \/>\nrejected by order dated 12.02.2002. Hence, this petition.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard Mr. Shakeel Qureshi learned counsel for the petitioners<br \/>\nand Mr. MS Trivedi learned counsel for the respondent. It appears<br \/>\nfrom the record that when the respondent was served with the show<br \/>\ncause Notice on 04.06.1991, he submitted a written reply on the very<br \/>\nsame day admitting his guilt. But, immediately on the next day, i.e.<br \/>\non 05.06.1991, the respondent submitted another written explanation<br \/>\nstating that he had submitted the earlier reply dated 04.06.1991<br \/>\nunder duress and denied the charges levelled against him. It appears<br \/>\nthat the disciplinary authority ignored the written explanation dated<br \/>\n05.06.1991 submitted by the respondent wherein, he had denied the<br \/>\ncharges, on the very next day after he had submitted his reply dated<br \/>\n04.06.1991.\n<\/p>\n<p>5.\tIn<br \/>\nour opinion, the disciplinary authority ought to have considered the<br \/>\nexplanation dated 05.06.1991 submitted by the petitioner before<br \/>\npassing the impugned order of reversion to the lower post. The C.A.T<br \/>\nhas rightly quashed the orders passed by the disciplinary as well as<br \/>\nthe appellate authority since the same were passed without any<br \/>\napplication of mind. We are in complete agreement with the reasonings<br \/>\ngiven by C.A.T in its order and hence, find no reasons to entertain<br \/>\nthis petition.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed.
