Heard.\n<\/p>\n<p>2.    Case  diary  of Crime No. 22\/2005  registered  at<br \/>\nPolice  Station Ranchirai, Distt. Durg  (C.G)  for  the<br \/>\noffence  punishable under Sections 376 &amp; 450 of I.P.C.,<br \/>\nperused.\n<\/p>\n<p>3.    The  case  of prosecution is that  the  applicant<br \/>\nentered  into  the  house of the prosecutrix  at  about<br \/>\n10.00  a.m.  on 18.2.2005 and asked about her  husband.<br \/>\nThe prosecutrix replied that her husband is not present<br \/>\nin  home. Thereafter, he took the prosecutrix in a room<br \/>\nof  her  house and committed sexual intercourse against<br \/>\nher. Further case of the prosecution is that while  the<br \/>\napplicant   was  committing  sexual  intercourse,   the<br \/>\nhusband  of the prosecutrix returned to house then  the<br \/>\nprosecutrix  came  out  of the room  and  reported  the<br \/>\nmatter to her husband.\n<\/p>\n<p>4.   Learned counsel for the applicant submits that the<br \/>\nprosecutrix  was  a consenting party. He  also  submits<br \/>\nthat  since  the husband witnessed this scenario  while<br \/>\nentering  into the house at once, the prosecutrix  made<br \/>\ncomplaint to the husband and then only the offence  was<br \/>\nregistered. He further submits that the medical  report<br \/>\nof the prosecutrix is nil which supports the contention<br \/>\nof  the applicant. He prays for releasing the applicant<br \/>\non bail.\n<\/p>\n<p>5.    On  the other hand, learned State counsel opposed<br \/>\nthe  bail application.    It is submitted that earlier,<br \/>\nan  anticipatory bail application of the applicant  was<br \/>\ndismissed  by  this  Court vide order  dated  10.5.2005<br \/>\npassed  in M.Cr.C. No. 679\/2005. He prays for dismissal<br \/>\nof this application also.\n<\/p>\n<p>6.    So far as dismissal of an application filed under<br \/>\nSection  438 of Cr.P.C. is concerned, the law  is  well<br \/>\nsettled on the point that the consideration in relation<br \/>\nto  releasing  a  person on bail under Section  439  of<br \/>\nCr.P.C.  and  extending him the benefit of Section  438<br \/>\nare  different. In the matter of pre-arrest, the Courts<br \/>\nare  to  look into the prevailing circumstances and  to<br \/>\ndecide  that  on  the  facts  and  circumstances  of  a<br \/>\nparticular  case,  whether the  benefit  of  protective<br \/>\numbrella may be extended to  a person for enabling  him<br \/>\nto appear before the regular Court for grant of regular<br \/>\nbail.  &#8220;The power exercisable under S. 438 is  somewhat<br \/>\nextraordinary   in  character  and  it   is   only   in<br \/>\nexceptional cases where it appears that the person  may<br \/>\nbe  falsely  implicated or where there  are  reasonable<br \/>\ngrounds for holding that a person accused of an offence<br \/>\nis  not  likely  to otherwise misuse his  liberty  then<br \/>\npower  is to be exercised under S. 438. The power being<br \/>\nof  important nature it is entrusted only to the higher<br \/>\nechelons of judicial forums, i.e. the Court of  Session<br \/>\nor  the High Court. It is the power exercisable in case<br \/>\nof  an  anticipated accusation of non-bailable offence.<br \/>\nThe object which is sought to be achieved by S. 438  of<br \/>\nthe Code is that the moment a person is arrested, if he<br \/>\nhas already obtained an order from the Court of Session<br \/>\nor High Court, he shall be released immediately on bail<br \/>\nwithout  being sent to jail.&#8221; (Please see 2005 AIR  SCW<br \/>\n1013 [Adri Dharan Das -Vs- State of West Bengal])<\/p>\n<p>  7.  Whereas, in a case under Section 439 of Cr.P.C. a<br \/>\nperson is taken into custody and the matter relates  to<br \/>\nhis personal liberty, which is to be looked into on the<br \/>\nbasis   prima  facie  evidence  along  with  the  other<br \/>\nconsiderations on which his personal liberty should  be<br \/>\ncurtailed  or not.  &#8220;The considerations which  normally<br \/>\nweigh  with  the Court in granting bail in non-bailable<br \/>\noffences  are &#8211; the nature and seriousness of  offence;<br \/>\nthe  character of the evidence; circumstances which are<br \/>\npeculiar  to  the accused; a reasonable possibility  of<br \/>\nthe  presence of the accused not being secured  at  the<br \/>\ntrial;  reasonable  apprehension  of  witnesses   being<br \/>\ntampered with; the larger interest of the public or the<br \/>\nState  and other similar factors which may be  relevant<br \/>\nin  the  facts and circumstances of the case.&#8221;  (Please<br \/>\nsee 2005 AIR SCW 323 [Jayendra Saraswathi Swamigal -Vs-<br \/>\nState  of Tamil Nadu]). The rejection of an application<br \/>\nunder  Section  438  of  Cr.P.C.  is  not  a  Bar   for<br \/>\nentertaining  a  subsequent  application  filed   under<br \/>\nSection  439  of Cr.P.C.  Therefore, I  hold  that  the<br \/>\nrejection of an application filed under Section 438  of<br \/>\nCr.P.C.  would  not make a difference  in  entertaining<br \/>\nthis  application  as  the same is  to  be  entertained<br \/>\nindependently without being influenced by earlier order<br \/>\npassed by this Court u\/s 438 of the Cr.P.C.\n<\/p>\n<p>8.    Considering  the facts and circumstances  of  the<br \/>\ncase,   particularly  the  age  and  conduct   of   the<br \/>\nprosecutrix, I am of the opinion that present is a  fit<br \/>\ncase  in  which  the applicant should  be  enlarged  on<br \/>\nregular bail. This application filed under Section  439<br \/>\nof Cr.P.C. is allowed.\n<\/p>\n<p>9.
