SHAH\n\t\t\n\t\n\n \n\nDate\n: 27\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\npetitioner has prayed for appropriate writ, direction or order<br \/>\ndirecting the respondent authorities to implement the order dated<br \/>\n04.09.2008 passed in DP\/APPEAL\/3\/07\/2008 and to remove the<br \/>\nencroachment done by respondent No.5 made on the public way and also<br \/>\non government land.\n<\/p>\n<p>2.\tShri<br \/>\nH.S. Munshaw, learned advocate appearing on behalf of respondent<br \/>\nNos.2, 3 and 4 has stated at the Bar that as per the measurement<br \/>\nprepared by the DILR, it is established and proved that there is an<br \/>\nencroachment made by respondent No.5 on the road. He has also stated<br \/>\nat the Bar under the instructions from the Taluka Development<br \/>\nOfficer, who is personally present in the Court, that in view of the<br \/>\nabove, order dated 04.09.2008 shall be implemented and illegal<br \/>\nconstruction which is found to be on the road shall be removed at the<br \/>\nearliest but not later than three weeks from today.  Shri Prachhak,<br \/>\nlearned advocate appearing for Shri Joshi, learned advocate appearing<br \/>\non behalf of respondent No.5 has stated that as such there is already<br \/>\none Civil Suit filed by respondent No.5 with respect to the very land<br \/>\nin question.  However, it is reported that as such there is no<br \/>\ninterim injunction granted by the learned trial Court, on the<br \/>\ncontrary, it is reported that application Exh.5 is not pressed by<br \/>\nrespondent No.5 (as per the statement made by Shri Darji, learned<br \/>\nadvocate appearing on behalf of the petitioner).\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, when there is already an order passed by the<br \/>\nDistrict Panchayat against respondent No.5 and even as per respondent<br \/>\nNos.2 to 4, there is a construction put up by respondent No.5 is on<br \/>\npublic road, respondent Nos.2 to 4 are hereby directed to act as per<br \/>\nthe statement made by Shri Munshaw, learned advocate appearing on<br \/>\nbehalf of respondent Nos.2 to 4 recorded herein above, within a<br \/>\nperiod of three weeks from today.\n<\/p>\n<p>4.\tWith<br \/>\nthis, present Special Civil Application is disposed of accordingly.\n<\/p>\n<p>(M.R.\n<\/p>\n<p>Shah, J.)<\/p>\n<p>*menon<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Patel vs State on 27 August, 2010 Author: M.R.
