On completion of 9 years of continuous service, the<br \/>\npetitioner was given benefit of higher pay-scale as per the<br \/>\nprevailing policy. Thereafter, the petitioner made representation to<br \/>\nthe respondent-Company requesting to grant him benefit of next higher<br \/>\npay-scale on completion of 18 years&#8217; service. However, the said<br \/>\nrepresentation came to be rejected by order dated 24.02.1999. It is<br \/>\nthis order which is under challenge in this petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the parties and perused the documents on record.<br \/>\nThe respondent-Company rejected representation of the petitioner<br \/>\nseeking benefit of higher pay-scale on the ground that the petitioner<br \/>\nhad not cleared the qualifying examination or was not possessing the<br \/>\nrequisite educational qualification. Learned counsel for the<br \/>\npetitioner was not able to show from the record that the petitioner<br \/>\nfulfilled either of the above two criteria, as described in the<br \/>\nimpugned order. The petitioner has claimed that a similarly situated<br \/>\nemployee has been granted benefit of higher pay-scale. However, the<br \/>\nsaid fact has been categorically denied by the respondents in the<br \/>\nreply filed in this petition. Even otherwise, the petitioner cannot<br \/>\nclaim benefit on the basis of any illegality which might have been<br \/>\ncommitted at any point of time. The fact remains that the petitioner<br \/>\nwas found ineligible for getting benefit of higher pay-scale as per<br \/>\nthe 9-18-27 formula and therefore, the respondents rejected his<br \/>\nrepresentation.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, I find no merits in the present petition and<br \/>\nhence, the petition is rejected.
