SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent Official Liquidator&#8217;s Report has been preferred by the<br \/>\nOfficial Liquidator of the Company in liquidation i.e. M\/s.<br \/>\nBhagyodaya Proteins Pvt. Ltd. (in liquidation) to permit him to<br \/>\ndisburse an amount of Rs. 26,865\/- to the only worker,  an amount of<br \/>\nRs. 4,68,888\/- to the unsecured creditors and an amount of Rs.<br \/>\n89,88,480\/-  to the share applicants as mentioned in paragraph 9 of<br \/>\nthe Official Liquidator&#8217;s Report as per the report of the Chartered<br \/>\nAccountant dated 12\/01\/2010.\n<\/p>\n<p>2.\tIt<br \/>\nis further prayed to ratify the action taken by the Official<br \/>\nLiquidator of making payment of Rs. 43,100\/- towards professional<br \/>\ncharge of M\/s. V.V. Patel &amp; Co., Chartered Accountant as per the<br \/>\nscheme approved by this Court for payment of fees to the Chartered<br \/>\nAccountant  in terms of the order dated 28\/08\/2009 passed by this<br \/>\nCourt in Official Liquidator&#8217;s Report No. 100\/2009.\n<\/p>\n<p>3.\tIt<br \/>\nis also further prayed to permit the Official Liquidator to keep the<br \/>\nbalance amount of Rs. 5,82,274\/-  for future liquidation expenses<br \/>\nafter disbursement to the workers, unsecured creditor and the share<br \/>\napplicant money holders.\n<\/p>\n<p>4.\tShri<br \/>\nHiren Modi, learned advocate appearing on behalf of the applicant has<br \/>\nsubmitted that after verification of the record and the statement of<br \/>\none of the Director of the Company in liquidation, it appears that<br \/>\nexcept one employee there is no worker, as before the manufacturing<br \/>\nactivity starts the Company had gone into liquidation.  It is<br \/>\nsubmitted that the Chartered Accountant has got the claims made by<br \/>\nthe unsecured creditors and the share applicants verified and as per<br \/>\nthe Chartered Accountant the aforesaid amount is payable to the<br \/>\nunsecured creditors and the share applicants.  It is submitted that<br \/>\nthere are no other secured or unsecured creditors except those whose<br \/>\nclaims have been verified by the Chartered Accountant.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, the Official Liquidator is hereby permitted to<br \/>\ndisburse an amount of Rs. 26,865\/- to the only worker, an amount of<br \/>\nRs. 4,68,888\/- to the unsecured creditors and an amount of Rs.<br \/>\n89,88,480\/- to the share applicants.  The same may be paid to the<br \/>\nrespective parties by an account payee cheque on proper verification<br \/>\nand after getting necessary receipt.  The said exercise to be<br \/>\ncompleted within a period of six weeks from today.\n<\/p>\n<p>6.\tThe<br \/>\naction of the Official Liquidator of the Company in liquidation for<br \/>\nmaking the payment of Rs. 43,110\/-  to the Chartered Accountant is<br \/>\nhereby ratified.\n<\/p>\n<p>7.\tThe<br \/>\nOfficial Liquidator is permitted to keep the balance amount of Rs.<br \/>\n5,82,274\/-  for future liquidation expenses etc. and the same shall<br \/>\nbe invested in the Fixed Deposit.\n<\/p>\n<p>8.\tWith<br \/>\nthis, the present Official Liquidator&#8217;s Report is disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Official vs Unknown on 26 April, 2010 Author: M.R.
