Justice K.PADMANABHAN NAIR\n\n Dated :10\/04\/2007\n\n O R D E R\n                         K.Padmanabhan Nair,J.\n\n                    -------------------------------------\n\n                     Insurance Appeal No.52 of 2004\n\n                    -------------------------------------\n\n                 Dated, this the 10th day of April, 2007\n\n\n                                 JUDGMENT\n<\/pre>\n<p>             A workman, who filed appeal challenging a decision of<\/p>\n<p>the E.S.I. Medical Board, is the appellant. The appellant met with<\/p>\n<p>an   accident   during   the   course   of   employment   and   sustained<\/p>\n<p>employment   injury.   He   underwent  an   examination   by   a   Medical<\/p>\n<p>Board.   The   Board   fixed   his   disability   at   6%.   Challenging   that<\/p>\n<p>decision   of   the   Board,   the   appellant   filed   an   appeal   before   the<\/p>\n<p>Insurance   Court.   Before   the   Insurance   Court,   the   appellant<\/p>\n<p>produced   a   disability   certificate   issued   by   the   doctor,   who   was<\/p>\n<p>examined   as   P.W.2.   Relying   on   the   oral   evidence   of   P.W.2   and<\/p>\n<p>Exhibit P2 medical certificate, the Insurance Court enhanced the<\/p>\n<p>disablement   benefit   from   6%   to   20%,   though   P.W.2   had   fixed<\/p>\n<p>32% disability. Challenging that decision, the employee has filed<\/p>\n<p>this appeal.\n<\/p>\n<\/p>\n<p>             2. I have carefully gone through the evidence of P.W.2<\/p>\n<p>and   Exhibit   P2   certificate.   It   is   not   possible   to   accept   the<\/p>\n<p>contention   of   the   appellant   that   the   entire   percentage   of<\/p>\n<p>disablement   benefit   fixed   by   P.W.2   has   to   be   accepted.   But,<\/p>\n<p>considering all aspects of the matter, I am of the view that the<\/p>\n<p>disablement benefit can be fixed at 25%.<\/p>\n<p>Ins.App.No.52 of 2004<\/p>\n<p>                                     &#8211; 2 &#8211;\n<\/p>\n<p>\n             In   the   result,   the   appeal   is   allowed   in   part.   The<\/p>\n<p>disablement   benefit   in   the   case  of   the  appellant   is   enhanced  to<\/p>\n<p>25%.
