SINHA, J :\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tBishan Singh son of Bachchi Singh and Govind Ballabh son of<br \/>\nKrishnanand, the two surviving accused, who were tried and convicted for<br \/>\ncommission of an offence under Sections 147 and 308\/149 of the Indian<br \/>\nPenal Code (IPC) are before us; the other four accused, namely, Arjun<br \/>\nSingh, Shivraj, Govind Singh and Bhairav Dutt having expired.\n<\/p>\n<p>3.\tOne Harish Bhatt was the complainant.  On 30.09.1984 at about 06.30<br \/>\np.m. when he was going towards his village, the accused persons allegedly<br \/>\nassaulted him with lathis and took out a sum of Rs.400\/- from his pocket.<br \/>\nHis brother Ghanshyam Dutt Bhatt intervened.  It was alleged that the<br \/>\naccused persons were inimically disposed of towards the injured and had<br \/>\nattacked him with an intention to cause his death.  The injuries suffered by<br \/>\nHarish Bhatt as per the injury report prepared by Dr. J.S. Pangti (PW-6) are<br \/>\nas under :\n<\/p>\n<p>1.\tLacerated wound 3 cm x 1 cm on scalp at<br \/>\nright parietal region, 14 cm above the right<br \/>\neye-brow.  Scalp deep.  Fresh bleeding<br \/>\npresent.\n<\/p>\n<p>2.\tLacerated wound 5 cm x = cm x scalp deep<br \/>\non scalp, at right parietal area, 19 cm above<br \/>\nthe right eye-brow.\n<\/p>\n<p>3.\tLacerated wound 3 cm x &lt; cm x skin deep,<br \/>\n4 cm above the right eye-brow at right<br \/>\nforehead, 6 cm x 7 cm swelling around the<br \/>\nwound.\n<\/p>\n<p>4.\tAbrasion 1 cm x = cm, at upper lip, 3 cm<br \/>\nfrom the right angle of the mouth.\n<\/p>\n<p>4\/1\tAbrasion 1 cm x = cm at lower lip right<br \/>\nangle of mouth.\n<\/p>\n<p>5.\tContusion mark 10 cm x 5 cm above right<br \/>\nshoulder reddish in colour.  Swelling 2 cm<br \/>\naround the wound.\n<\/p>\n<p>6.\tContusion mark 6 cm x 6.5 cm on above and<br \/>\nfront and middle of left arm, 13 cm below<br \/>\nthe shoulder joint 1 cm swelling around the<br \/>\ninjury.\n<\/p>\n<p>7.\tContusion 12 cm x 10 cm at fore-arm, 8 cm<br \/>\nfrom the left wrist joint = cm swelling<br \/>\naround the injury.\n<\/p>\n<p>8.\tComplain of pain in both lower legs and<br \/>\nthigh, but no injury seen.<\/p>\n<p>4.\tAdmittedly, all the injuries except injury no.7 were simple ones.<br \/>\nInjury No. 7 being a fracture with dislocation of wrist joint was found to be<br \/>\ngrievous one.  The injured witness examined himself as PW-5.  In his<br \/>\ndeposition, he alleged :\n<\/p>\n<p>I used to stop the accused from fighting with the poor<br \/>\npeople and I was witness against the accused persons in<br \/>\nthe litigation  between Shanti Joshi and accused persons.<br \/>\nThat is why the accused beat me.  My head was<br \/>\nwounded.  My kurta was full of blood and seizure report<br \/>\nof kurta had been made in the hospital<\/p>\n<p>5.\tThe learned Trial Judge relying on or  on the basis of the testimonies<br \/>\nof the said witness as also his brother, convicted the appellants for<br \/>\ncommission of an offence under Sections 147 and 308\/149 IPC and<br \/>\nsentenced them to undergo rigorous imprisonment for one year for the<br \/>\noffence punishable under Section 147 IPC and rigorous imprisonment for<br \/>\nfour years for the offence punishable under Section 308\/149 IPC.\n<\/p>\n<p>6.\tAlthough in the First Information Report, the informant had alleged<br \/>\nthat all the six accused had earlier threatened to kill him as also burn his hut<br \/>\nand the said attack was with an intention to kill him, but the offence<br \/>\nrecorded therein was under Sections 147 and 323  IPC.  The charge-sheet<br \/>\nwas, however, submitted, inter alia, under Section 308 IPC.\n<\/p>\n<p>7.\tWe have noticed hereinbefore that in his deposition PW-5 stated about<br \/>\nthe existing enmity between the parties.  It does not appear from his<br \/>\ndeposition that he had made any statement  to the effect that the accused  had<br \/>\nattacked him with an intention to kill.  The learned Trial Judge in his<br \/>\njudgment solely relying upon the allegations made in the First Information<br \/>\nReport opined that a case under Section 308 IPC was made out.\n<\/p>\n<p>8.\tInterestingly, the learned Trial Judge observed that the charge  under<br \/>\nSection 308 IPC read with Section 149 thereof was proved, because the eye-<br \/>\nwitnesses had clearly sated that they were armed with lathis.\n<\/p>\n<p>9.\tThe learned Trial Judge did not notice the ingredients of Section 308<br \/>\nIPC which provides for existence of  an intention or knowledge.\n<\/p>\n<p>10.\tThe High Court also dismissed the appeal, opining :\n<\/p>\n<p>\t33.\tFrom perusal of record it has been<br \/>\nestablished that the intention of the accused persons was<br \/>\nto commit culpable homicide.  They had enmity with the<br \/>\ninjured Harish Bhatt.  Threats were also given to him by<br \/>\nthe accused persons to ruin his life.  PW-4, Ghanshyam<br \/>\nDutt has clearly stated that when he reached at the spot<br \/>\nhe saw that the accused persons were beating the injured<br \/>\nrecklessly with Lathis-Dantas.  Injuries were also caused<br \/>\non scalp.  Looking to the seat of injuries and the fact and<br \/>\ncircumstances of the case the prosecution has been able<br \/>\nto prove the offence u\/s 308\/149 IPC against the accused<br \/>\npersons.  The finding of the trial court is just and proper<br \/>\nand need no inference by the appellate court.  <\/p>\n<p>11.\tBefore an accused can be held to be guilty under Section 308 IPC, it<br \/>\nwas necessary to arrive at a finding that the ingredients thereof, namely,<br \/>\nrequisite intention or knowledge was existing.  There cannot be any doubt<br \/>\nwhatsoever that such an intention or knowledge on the part of the accused to<br \/>\ncause culpable homicide is required to be proved.  Six persons allegedly<br \/>\naccosted the injured.  They had previous enmity.  Although overt-act had<br \/>\nbeen attributed against each of the accused  who were having lahtis, only<br \/>\nseven injuries had been caused and out of them only one of them was<br \/>\ngrievous, being  a fracture on the arm,  which was not the vital part of the<br \/>\nbody.\n<\/p>\n<p>12.\tThe accused, therefore, in our opinion, could not be said to have<br \/>\ncommitted any offence under Section 308 IPC.  The same would fall under<br \/>\nSections 323 and 325 thereof.\n<\/p>\n<p>13.\tThe question now is what punishment should be awarded.\n<\/p>\n<p>14.\tWhile imposing punishment in a case of this nature, the court is<br \/>\nrequired to take into consideration  the factors which may weigh with the<br \/>\ncourt for taking a lenient view in the matter.  The incident is of 1984.  23<br \/>\nyears have elapsed.  Appellants had all along remained on bail.  It is not<br \/>\nstated that they had ever misused the privilege of bail.  The incident does not<br \/>\nreflect any cruelty on their part or any mental depravity. They had been in<br \/>\ncustody for more than five months.  In a situation of this nature, we are of<br \/>\nthe opinion that it may not be proper for this Court to send the accused<br \/>\npersons back to prison.  However, the injured had suffered pains at the hands<br \/>\nof the appellants.  We are, therefore, of the opinion that while their<br \/>\nsubstantive sentence may be  reduced to the period undergone, they should<br \/>\npay a fine of  Rs. 15,000\/- (Rupees fifteen thousand) each; failing which<br \/>\nthey should undergo simple imprisonment for a period of one year each.  If<br \/>\nthe aforementioned amount is realized, a sum of Rs. 25,000\/- (Rupees<br \/>\ntwenty five thousand) out of the sum, may be paid to the informant.\n<\/p>\n<p>15.\tAppellants who are in custody shall be released forthwith, if not<br \/>\nrequired in connection with any other case, subject to the aforementioned<br \/>\nconditions.\n<\/p>\n<p>16.\tThe appeal is allowed to the aforementioned extent.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Bishan Singh &amp; Anr vs The State on 9 October, 2007 Author: S.B.
