            The   revision   petitioners   are   the   tenants   in<\/p>\n
occupation of the concerned premises, and under orders<\/p>\n
of eviction  under Section 11  (4)(iv) of Kerala Buildings<\/p>\n
(Lease   and   Rent   Control)   Act   [Act   2   of   1965]<\/p>\n
{hereinafter referred to as ‘the Act’}.<\/p>\n
            2.     The   courts   below   concurrently   found   in<\/p>\n
favour   of   the   landlord   and   directed   the   revision<\/p>\n
petitioners   to   surrender   vacant   possession   of   the<\/p>\n
building   on   or   before   30.9.2003.     It   was   also   directed<\/p>\n
that   the   landlord   shall   reconstruct   the   building   within<\/p>\n
one year after getting possession and the tenants shall<\/p>\n
have   the   first   option   to   get   the   reconstructed   building<\/p>\n
allotted to them, with a liability to pay fair rent.<\/p>\n
            3.     It   is   the   contention   of   the   revision<\/p>\n
petitioners   that   there   was   no   offer   in   the   rent   control<\/p>\n
petitions that they will be provided accommodation after<\/p>\n
reconstruction.   It   is   also   contended   that   the   proposed<\/p>\n
R.C.R.No.419 & 420 of  2006<\/p>\n

reconstructed   building   is   not   suitable   for   the   business<\/p>\n
conducted by the petitioners.\n<\/p>\n<\/p>\n
                  4.     We   find   that   the   Rent   Control   Court     has<\/p>\n
specifically directed as to the time limit within which the<\/p>\n
reconstruction has to be completed and also provided the<\/p>\n
first option to the petitioners with liability to pay fair rent<\/p>\n
as   per   the   statutory   stipulation.     Hence   this   contention<\/p>\n
has no merit.\n<\/p>\n<\/p>\n
                  5.     So   far  as   the   contention   that   the   premises<\/p>\n
proposed   to   be   reconstructed   would   not     be   suitable   to<\/p>\n
the business being conducted  by the petitioners – one of<\/p>\n
the   petitioners   is   conducting   a   provision   store   and   the<\/p>\n
another is conducting a hotel, we find that such a ground<\/p>\n
was not raised before the courts below.   The petitioners<\/p>\n
are not entitled to raise a fresh ground at the revisional<\/p>\n
stage.\n<\/p>\n<\/p>\n
                  6.  On a perusal of the judgments of the courts<\/p>\n
below, we find that the premises  were  inspected by the<\/p>\n
commissioner   and   the   commissioner   reported   that   the<\/p>\n
building is a tiled one and the walls had cracks and that in<\/p>\n

the locality there are a number of concrete buildings and<\/p>\n
that   the   place   is   a   commercially   important   one.     This<\/p>\n
court   as   well   as   the   Supreme   Court   have   held   on   a<\/p>\n
number of occasions that the ‘condition of the building’ is<\/p>\n
a   larger   concept   which   includes   consideration   of   social<\/p>\n
surroundings   and   allied   factors.   The   revision   petitioners<\/p>\n
are not entitled to confine the landlord to the ownership<\/p>\n
of the present tiled and dilapidated building.   We find no<\/p>\n
merit in these revision petitions and hence the same are<\/p>\n
dismissed, confirming the findings of the courts below.<\/p>\n
                  The petitioners will surrender vacant possession<\/p>\n
of   the   building  within   two   months   from   today   and   from<\/p>\n
the   date   of   getting   possession,   the   landlord   shall<\/p>\n
reconstruct the building within one year therefrom.<\/p>\n
