Balachandran, J.\n            --------------------------\n             W.P.(C)No.36795 of 2008 E\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    This writ petition is filed by the plaintiff in<\/p>\n<p>O.S.No.306\/07 on the file of the Munsiff&#8217;s Court,<\/p>\n<p>Ernakulam.  She filed I.A.No.8685\/08 in the said<\/p>\n<p>suit when the suit was listed for trial and vide<\/p>\n<p>Exhibit P3 order dated 21.11.2008, the trial court<\/p>\n<p>dismissed  the application   and  hence this   writ<\/p>\n<p>petition.\n<\/p>\n<p>    2.   It is submitted by the counsel for the<\/p>\n<p>petitioner that the suit stood posted for trial in<\/p>\n<p>the list to this day and that it is adjourned to<\/p>\n<p>19.12.2008 on the submission made in the court<\/p>\n<p>below that the petitioner\/plaintiff has filed this<\/p>\n<p>writ petition and that it is pending consideration<\/p>\n<p>by this Court.\n<\/p>\n<p>    3.  The prayer in the application for issuance<\/p>\n<p>of a commission is to measure out the plaint<\/p>\n<p>schedule property on the basis of resurvey records<\/p>\n<p><span class=\"hidden_text\">WPC 36795\/08              2<\/span><\/p>\n<p>with the assistance of Taluk Surveyor.   The suit is<\/p>\n<p>one for injunction.    There is no need to measure<\/p>\n<p>the   plaint  schedule  property  and  to  fix   the<\/p>\n<p>boundaries in a suit for prohibitory injunction<\/p>\n<p>simplicitor.   It is submitted that there is already<\/p>\n<p>a commission report filed as early as on 21.3.2007<\/p>\n<p>on the application of the petitioner herself.     It<\/p>\n<p>is also submitted that necessity for issuance of a<\/p>\n<p>commission    is  for    reason   of   the   earlier<\/p>\n<p>Commissioner   having   not  located   the   western<\/p>\n<p>boundary of the scheduled property.   If at all the<\/p>\n<p>petitioner wanted any clarification, she should<\/p>\n<p>have asked for the commission report being remitted<\/p>\n<p>to the same Commissioner.      That was not done.<\/p>\n<p>Further, if at all the petitioner\/plaintiff wanted<\/p>\n<p>a  commission   for   surveying  the  property   and<\/p>\n<p>locating its boundaries with the intention to amend<\/p>\n<p>the plaint subsequently, then also, she should not<\/p>\n<p>have slept over her rights after submission of the<\/p>\n<p>commissioner&#8217;s report on 21.3.2007.       The court<\/p>\n<p><span class=\"hidden_text\">WPC 36795\/08               3<\/span><\/p>\n<p>below    observed  that without setting  aside  the<\/p>\n<p>earlier     commission report, a  fresh  commission<\/p>\n<p>cannot be allowed and further that in the plaint,<\/p>\n<p>in the basic tax receipt, etc., only the survey<\/p>\n<p>number of the property is mentioned, with no record<\/p>\n<p>to show the re-survey number in relation to the<\/p>\n<p>scheduled property.     To crown all that, is the<\/p>\n<p>inaction on the part of the petitioner\/plaintiff to<\/p>\n<p>file an application sufficiently early.    Inasmuch<\/p>\n<p>as the application has been filed when the suit is<\/p>\n<p>posted for trial in the list to this day, I have no<\/p>\n<p>difficulty to conclude that Exhibit P2 application<\/p>\n<p>for issuance of a commission with the assistance of<\/p>\n<p>a Taluk Surveyor was filed only with a view to see<\/p>\n<p>that trial of the case is protracted with some<\/p>\n<p>ulterior motives.     It is also to be noted that<\/p>\n<p>carbon copy of the order was issued on 6.12.2008,<\/p>\n<p>but this writ petition is filed only on 12.12.2008.<\/p>\n<p>The   order   of  the  court below disallowing  the<\/p>\n<p>application for issuance of a commission to measure<\/p>\n<p><span class=\"hidden_text\">WPC 36795\/08              4<\/span><\/p>\n<p>out the properties on the basis of resurvey, for<\/p>\n<p>the first time when the suit has come up in the<\/p>\n<p>list has only to be upheld and this writ petition<\/p>\n<p>dismissed.\n<\/p>\n<p>     In the result, I dismiss this writ petition.<\/p>\n<p>16th December, 2008       (K.P.Balachandran, Judge)<br \/>\ntkv<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court N.P.Subhashini vs K.V.Sathyan on 16 December, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 36795 of 2008(E) 1.
