BASANT, J.\n\n           ````````````````````````````````````````````````````\n                    B.A. No. 881 OF 2008 E\n           ````````````````````````````````````````````````````\n           Dated this the 10th day of March, 2008\n\n                             O R D E R\n<\/pre>\n<p>           Application for anticipatory bail.          Petitioner faces<\/p>\n<p>allegations under the Kerala Abkari Act. He was allegedly<\/p>\n<p>found to be in possession of 5 litres of arrack on 2.2.08.<\/p>\n<p>Crime has been registered.           Petitioner is the 2nd accused.<\/p>\n<p>The 1st accused was arrested at the spot. The petitioner&#8217;s<\/p>\n<p>name appears in the seizure mahazar itself as one of the<\/p>\n<p>accused i.e., A2. Investigation is in progress. The petitioner<\/p>\n<p>apprehends imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent.              According to the<\/p>\n<p>learned counsel for the petitioner, the petitioner has been<\/p>\n<p>dragged into this case with malafide and oblique motive. The<\/p>\n<p>excise official misbehaved towards the sister-in-law of the<\/p>\n<p>petitioner and she complained to superior officers. That is<\/p>\n<p>why false allegations are being raised against the petitioner.<\/p>\n<p>BA.881\/08<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>In these circumstances, anticipatory bail may be granted to<\/p>\n<p>the petitioner. He may be saved of the undeserved trauma of<\/p>\n<p>arrest and incarceration, it is prayed.\n<\/p>\n<p>     3.     The learned Public Prosecutor opposes the<\/p>\n<p>application vehemently.       He submits that allegations of<\/p>\n<p>misbehavior towards the sister-in-law of the petitioner are<\/p>\n<p>invented only to vex and harass the excise officials who<\/p>\n<p>detected and investigated the crimes.         The learned Public<\/p>\n<p>Prosecutor points out that the petitioner&#8217;s brother is involved<\/p>\n<p>in many cases. The petitioner is also involved in an earlier<\/p>\n<p>crime registered as early as in 2005, it is submitted.<\/p>\n<p>     4.     The learned Public Prosecutor at the request of this<\/p>\n<p>Court had placed before this Court the case diary in crime<\/p>\n<p>24\/05 which relates to a crime registered on 11.6.05. The<\/p>\n<p>seizure mahazar in that case as also the occurrence report<\/p>\n<p>have been perused by me.            It is clearly seen that fresh<\/p>\n<p>allegations are not raised now (after the complaint of the<\/p>\n<p>sister-in-law of the petitioner) by the excise officials against<\/p>\n<p>him. As early as on 11.6.05 in the seizure mahazar and the<\/p>\n<p>BA.881\/08<br \/>\n<span class=\"hidden_text\">                                 : 3 :<\/span><\/p>\n<p>occurrence report clear allegations are raised against the<\/p>\n<p>petitioner herein also.\n<\/p>\n<p>      5.    Having considered all the relevant inputs, I find<\/p>\n<p>merit in the opposition by the learned Public Prosecutor. I am<\/p>\n<p>satisfied that there are no features in this case which would<\/p>\n<p>justify the invocation of the extraordinary equitable discretion<\/p>\n<p>under Section 438 Cr.P.C.         This, I agree with the learned<\/p>\n<p>Public Prosecutor,     is a fit case where the petitioner must<\/p>\n<p>appear before the investigating officer or the learned<\/p>\n<p>Magistrate having jurisdiction and then seek regular bail in the<\/p>\n<p>normal and ordinary course.\n<\/p>\n<p>      6.    In the result, this petition is dismissed.
