\nRamakrishna of Suegehahaili cdmes to know that a

village. The said’Samekrishha alcngwith Marulaiah<\/p>\n
and Shreadraiqpes ts the pend and finds that it
\nis \ufb02the . dead \u00b0abed\u00a7>, of Narasamma. The said<\/p>\n
Ramakrishna icdeea a ccmpiaint before the pclice<\/p>\n
alleging hthst~5Narasamma is married to accused<\/p>\n
J’g’Negi about a year ago. Since the marriage, she is<\/p>\n
‘s\ufb01bjected”tcfcruelty and harassment and she was<\/p>\n
hct*ipretided food and other amenities. Despite<\/p>\n
ad\u20aciee}a.ithe accused did not desist from<\/p>\n
u”,\u00a51nfiicting cruelty” and harassment. Hence stated<\/p>\n
‘7,’:\u00a7a:’ Narasamma should have committed suicide<\/p>\n
‘H’-~uhable to bear the torture. The Tehsiidar has<\/p>\n
conducted the inquest. The dead body is subjected
\nte pcstwmortem examination. The cause sf death is<\/p>\n
shown to be asphyxia on account of drowning. In<\/p>\n

P.W.5 are the parents ef the deceased. eF,W,14,<\/p>\n
Jayamma, a neighbour of P.W.4 support\u00e9 the teee<\/p>\n
of the prosecution to the effecteethet_ the \u00b0p<\/p>\n
deceased was subjected te cruelty a\ufb01d hareeement<\/p>\n
for nonwgayment of _the 47belence f;emohnt.i<cfg<\/p>\n
Rs.5,000\/- and that t'1te'""v–t.deceas}e'tiij".=dt;:;i}\u00a3g her'<\/p>\n
visits to the viliageg"hao" informed" PtW.\u00e9 and
\np..w.5 and as we3.:t"t_;:'  the acts of<\/p>\n
cruelty.\n<\/p>\n
(D.W;i){–nei\u00a7hbout”of~the accused and one Papanna
\n(D.W.2);  also-“heichboer of the accused. Their<\/p>\n
evidence is to the effect that the deceased was<\/p>\n
‘i’ii#ie\u00a7iheppiiy Qith accused Mo.1 and there was no<\/p>\n
27.hefe3emehtfehd cruelty. It is aiso the case of<\/p>\n
thei defehce witness Jayammai that the deceased<\/p>\n
Va eccidehtally fell into the pond and died and that<\/p>\n
‘o it is not a case of suicide.\n<\/p>\n
\u00e9. The trial Court has found that the
\nevi\ufb01ence of ?tW.4, P.W.5 and P.W.14 is not<\/p>\n
credible since it is not consistent with the<\/p>\n

tima”for=GOwri\ufb02faa?\u00a7valiahd later her dead body
\nwas fooad in the pd\ufb01d.,P.W.\u20ac in the evidence also
\nstates that at tha’time of marriage, the accused<\/p>\n
da\ufb01andadx Rs.Z5aQQD\/~ dowry and. 10 sovereigns of<\/p>\n
‘;gold._orna\ufb01a\ufb01ts. But they have agreed to pay<\/p>\n
“_g\u00a7,ld;\u00a7UOf2l ‘cash and 8 aovereigns of gold<\/p>\n
or\ufb01am\u00e9ats. Gold ornaments and cash of Rs.5,000!*<\/p>\n
.iH’~waa paid. The balance of Rs.S,OOOf- was yet to be<\/p>\n
iggaid.\n<\/p>\n
6. The trial Court aurmisea that P.W.4 is
\noniy a Coolie and that he has no capacity to pay
\nthe dowry. However, we find that the evidence of<\/p>\n
P.W.4 is credible and wall corroborated by M.Oa.E<\/p>\n

Chain, M.O.3 is Silver Leg chain, M.O.4 is Toe<\/p>\n
Ring, M.O.5 is Nose Stud. an\u00e9 24.0.6 is Cxegisqhi<\/p>\n
Chain with Thali. The gold ornamehtssVhfedueee_h’<\/p>\n
before the Court is identifieeh ash helenqihgh_te<\/p>\n
the \ufb01eceased. It corroborates, the gv\u00e9x:ion”u\u00a2fu<\/p>\n
P.W.4 that he has paid 8 sovereigns ef \u00e9eid ath<\/p>\n
the time of marriaee. Th\u00e9’$5?\u00a7\u00bb\u00a7act is net denied
\nand disputed in the erosseexehihetien. P.W.5 also
\nstated to _ihei effe\ufb01\ufb01; \ufb01g }\u00a2\u00a2@an\u00a7t of dowry and
\nharassmept \ufb01es \ufb01ehe\ufb01aym\u00e9nt 5: hs.5,000\/-. In the<\/p>\n
statement hhefeie =the_ Tahsiidar, it is recorded
\nthat dcwty bf Rsgi\ufb01\ufb01\/4 was paid. The said writing<\/p>\n

iv, the factx\ufb01pat the evidence of P.W.4 categorically<\/p>\n
i_:\u20ac$tahiish\u00e9s that 8 sovereigns of gold was given<\/p>\n
‘age the hseid jewellery is at M.Os. 1 and 2.<\/p>\n
p.w.1\u00e9i an independent witness aiso supports the<\/p>\n
i”ieese of the grosecution to the effect that the<\/p>\n
ieeceased during her Visit to her parents’ house<\/p>\n
“stated that the accused are harassing the<\/p>\n
deceased and subjecting’ her to crueltyt witheut
\ngiving food for nonwpayment of Rs.5,000\/-. P.W.14<\/p>\n
aise stated that cash and jeweiiery were given.<\/p>\n

7. The defence evidence of D.W.1 and D.W.2
\naepears to be artificial. Although P.W.\u00a7 had
\nturned hostile, the allegation in ‘th\u00e9l:_FIR<\/p>\n
corroborates the version of P.W.4 andf\u00a7{W}S{that_<\/p>\n
deceaaed was aub\ufb01ected to cruelty and \ufb01ataasment;uiK<\/p>\n
It is to be note\ufb01 that in .the =tig4l tit
\nallegations of harassment andi \ufb01ruei\ufb01yo ate jaa\u00a7\u00a7=\u00bb
\nonly against Accuaedt NoS;i\u00bb and V3{‘ihe\u00a3e “is not
\nallegation against A\u00a7CQ\u00a7\u00e9d’w\u00a7y\u00a7m In t\ufb01at View of
\nthe matter, it i%VgN \ufb01\u00a7f\u00a2el\u00a7 ggat Accused No.1<\/p>\n
and Accu3ed%tNo.3 tafeglgoiltyf of inflicting<\/p>\n
haraesment and oruelty.on the deceased for dowry
\nand ate iiabie foo pnniahment under Section 498~A:

E\u00e9; ihe deceased had died by drowning in the<\/p>\n

one to_lae\u00a7hyxia on account of drowning. The<\/p>\n

lleaooidental ano not suicidal. Near the bank of the<\/p>\n
Tpono, there is {K} material forthcoming to Show<\/p>\n
that the deceased had visited the pond for the
\nbonafide purpose of washing clothes. That apart,<\/p>\n
at the bank of the pond, depth will not be too<\/p>\n

prosecetion has established the fact ehat it is-i<\/p>\n
an unnatural death takes place within a year of
\nthe marxiage. ?he\u00a3eferegv “the i_offence under
\nSection 38458 attracts .eeat’.Aeeused No.1 and
\nAccused Ne.3\u00a74are7&qeiltyW_ef”~the offence. The
