Rai, learned counsel for the petitioner.\n      Shri S.S. Chouhan, learned counsel for respondents.<\/pre>\n<p>      Sole relief which the petitioner seeks in the present<br \/>\npetition under Article 226 of Constitution of India is a<br \/>\ndirection to respondent No. 1 to strictly adhere to Rule 10<br \/>\nof the Cantonment Electoral Rules, 2007 while preparing the<br \/>\nElectoral Roll of Cantonment Board, Pachmarhi.\n<\/p>\n<p>      Placing reliance on the electoral rolls prepared by<br \/>\nCantonment Board, Pachmarhi of the year 2003 and 2009-10 it<br \/>\nis contended by learned counsel for the petitioner that though<br \/>\nelectoral rolls for the Cantonment Board Pachmarhi is being<br \/>\nprepared by respondent No. 1 on 1st July of each year; however,<br \/>\nthe same is not in consonance with Rule 10 of the Rules, 2007<br \/>\nwhich stipulates that the electoral roll shall be divided into<br \/>\nseparate parts for each ward and the names of electors in each<br \/>\npart of the roll shall be arranged according to house numbers.<br \/>\nIt is submitted that respondent No. 1 while preparing the<br \/>\nelectoral roll though have divided it into separate part in each<br \/>\nward but names of electors in each part of the roll are not<br \/>\narranged in accordance with the house numbers.\n<\/p>\n<p>      The respondent No. 1 though have filed the return but has<br \/>\nnot adverted to the aforesaid allegations made by the petitioner.\n<\/p>\n<p>      Rule 10 of the Rules of 2007 stipulates:<br \/>\n    &#8220;10. Preparation of electoral rolls . &#8211; (1) The Board or<br \/>\n    where a Board is not constituted, the Officer<br \/>\n    Commanding the Station, shall prepare on Ist July of<br \/>\n    each year, in English and in the language commonly<br \/>\n    used in the District in which Cantonment is located, an<br \/>\n    electoral roll in Form I.\n<\/p>\n<p><span class=\"hidden_text\">                                                    2<\/span><\/p>\n<p>                     (2)      The electoral roll shall be divided into separate<br \/>\n                     parts for each ward.\n<\/p>\n<p>                     (3) The names of electors in each part of the roll shall<br \/>\n                     be arranged according to house numbers.\n<\/p>\n<p>                     Explanation . &#8211; For the purposes of this sub-rule, any<br \/>\n                     building or unit line used for the purpose of lodging<br \/>\n                     troops shall be deemed to be a house.\n<\/p>\n<p>                     (4)  The names of electors in each part of the electoral<br \/>\n                     roll shall be numbered as far as practicable,<br \/>\n                     consecutively with a separate series of numbers<br \/>\n                     beginning with number one.&#8221;\n<\/p>\n<p>                          A fair reading of the aforesaid Rules reveals that the<br \/>\n                 respondent Board besides preparing the electoral roll by dividing<br \/>\n                 it into separate part for each ward are also under an obligation<br \/>\n                 to arrange the name of electoral in each part of according to<br \/>\n                 house numbers.\n<\/p>\n<p>                          Trite it is that when the Rules provide for doing of things<br \/>\n                 in certain manner the functionaries are bound to follow the<br \/>\n                 same.\n<\/p>\n<p>                          Having thus considered the petition is disposed of with a<br \/>\n                 direction to respondent No. 1 to strictly adhere to the provisions<br \/>\n                 contained in Rule 10 of Rules 2007 while preparing the electoral<br \/>\n                 roll of 2010-11 of Cantonment Board, Pachmarhi.\n<\/p>\n<p>                          The petition is disposed of in above terms.
