Heard learned counsel for the parties.<\/p>\n<p>                                    The petitioner has been made accused in a case under<\/p>\n<p>                        sections 302,307,323,34 of the I.P.C.\n<\/p>\n<p>                                    The petitioner     submits that even assuming the<\/p>\n<p>                        prosecution to be true no case under section 302 I.P.C. is made out<\/p>\n<p>                        rather offence under section 304A I.P.C. can be attracted.<\/p>\n<p>                        Petitioner is in custody since 25.11.2008 and co-accused Sanjay<\/p>\n<p>                        Singh and Meera Devi have already been allowed bail by this<\/p>\n<p>                        court as mentioned in para 11 of the petition.<\/p>\n<p>                                    In the facts and circumstances of the case, let the<\/p>\n<p>                        petitioner as above be released on bail on furnishing bail bond of<\/p>\n<p>                        Rs.5,000\/- (five thousand) with two sureties of the like amount<\/p>\n<p>                        each to the satisfaction of the       Sessions judge, Vaishali in<\/p>\n<p>                        Sessions Trial No. 263 of 2009, Rajapakar Police Station case no.<\/p>\n<p>                        129 of 2008.\n<\/p>\n<p>                                    Petitioner would not be absent physically for more<\/p>\n<p>                        than two consecutive dates at a stretch till three witnesses are<\/p>\n<p>                        examined in trial, otherwise his bail bond would be cancelled and<\/p>\n<p>                        he would be taken into custody.\n<\/p>\n<\/p>\n<pre>Shashi.
