\nand his father namely ‘.’t’hie:’.it-ideVceasedi–HSiddappa were
\nassaulted with axe’ it  the accused
\nBheemanagoudai\ufb02’5\/  who is petitioner
\nNo.2 hereiiiy  triorni the said complaint that
\nduringviviithe  No.1 Siddesh who is<\/p>\n
petitiorieru No.1  to have assaulted on the<\/p>\n

 The’ i\u00e9oiiice papers submitted by the learned HCGP<\/p>\n
ii.”4″=H”i’eveal..that, the deceased Siddappa died on 26\/ 11\/2009. As<\/p>\n
i’ . ii-tiicouid be seen from the postmortem examination report,<\/p>\n
 -tiiere was a 6 ‘\/22 inches length injury over his head of the<\/p>\n
\u00a2 <\/p>\n
deceased that was caused with a sharp edged weapon and
\ncause of the death was due to ‘coma’ as a result of head<\/p>\n
injury sustained.\n<\/p>\n
4. It is clear from the above that the  <\/p>\n
Bheernangowda was responsibleiii ifo: ‘–\u00abcausing_ death. of <\/p>\n
deceased by inflicting the said hea’dAii’i_iiiry iiiim
\nwith axe, a sharp edged    be that
\nwhile so assaulting petitioner’ accused did
\nnot intend to cause  .–‘the.f_’circumstance under
\nwhich he  gandi iised by him clearly
\nindicate t’;1ati.i\\yi’:ii-e::ass’aii1t-ingi so he has that he was likely to<\/p>\n
cause the\u00bb.death’ oft”.ithe::_i’_.deceased. Therefore, I am of the<\/p>\n
 cons\u00a7i.de_r’ed opiiniongtliat he does not deserve the grant of<\/p>\n
 of the learned counsel for the<\/p>\n
 petitioneyr that this petitioner is permanently residing at the<\/p>\n
it address shown in the bail petition and as such he couid not<\/p>\n
be said to misuse his liberty if he is granted bail. T his fact<\/p>\n
