Waghela) in the case<br \/>\n\tof Ajaysinh Vikramsinh Sarvaiya v. State of Gujarat and others,<br \/>\n\tand therefore, in view of the same, the present<br \/>\n\tpetition is required to be disposed of.\n<\/p>\n<p>\tIt<br \/>\n\twould be beneficial to reproduce the above cited decision as under :\n<\/p>\n<p> 1.\tThe<br \/>\npetitioner has invoked Articles 14, 16 and 226 of the Constitution<br \/>\nupon denial of appointment to him as Vidhya Sahayak by respondent<br \/>\nno.2.  The petitioner was denied appointment on account of doubts<br \/>\nabout genuineness of the testimonials produced by him.\n<\/p>\n<p>2.\tIt<br \/>\nis the contention of the petitioner that, only due to mistake on part<br \/>\nof the clerk in the office of respondent no.3, wrong age was<br \/>\nmentioned in the certificate given to the petitioner and that mistake<br \/>\nwas subsequently corrected.  Therefore, the petitioner was entitled<br \/>\nto be appointed after being duly selected in the selection process<br \/>\nand being placed at serial no.262 in the merit list.\n<\/p>\n<p>3.\tIt<br \/>\nwas fairly conceded for the respondent that similar other cases of<br \/>\ndoubtful testimonials of the candidates, who were at serial nos.268<br \/>\nand 269 were heard by this Court (Coram:Honourable Justice<br \/>\nK.S.Jhaveri) and their petitions were allowed by order dated<br \/>\n13.1.2009 in Special Civil Application Nos.3102 and 3103 of 2008,<br \/>\nsubject to certain conditions.  That order is not disturbed when<br \/>\nLetters Patent Appeals were preferred therefrom, and after order<br \/>\ndated 23.11.2009 of Division Bench of this Court those candidates<br \/>\nhave already been appointed.\n<\/p>\n<p>4.\tUnder<br \/>\nthe above circumstances, present petition is also required to be<br \/>\nallowed subject to liberty to the respondent to conduct enquiry<br \/>\nregarding genuineness of the certificates produced by the petitioner.<br \/>\n Accordingly, the petition is partly allowed with the directions<br \/>\nthat:\n<\/p>\n<p>(I)<br \/>\n\tLetters dated 2.7.2007 and 18.12.2007, at Annexure-C and E of<br \/>\nrespondent no.2, are set aside;\n<\/p>\n<p>(II)\tThe<br \/>\nrespondents are directed to consider the case of the petitioner for<br \/>\nappointment on the post of Vidhya Sahayak, as if the certificates<br \/>\nwere genuine;\n<\/p>\n<p>(III)\tIt<br \/>\nshall be open for the respondent to conduct an enquiry regarding<br \/>\ngenuineness of the certificates produced by the petitioner and if<br \/>\ncertificates were found to be bogus, appointment of the petitioner<br \/>\nshall be liable to be cancelled.\n<\/p>\n<p>5.\tRule<br \/>\nis made absolute accordingly with no order as to costs.  Direct<br \/>\nservice is permitted.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, when the issue involved in the present petitions<br \/>\n\thas already been decided by this Court by way of above cited<br \/>\n\tdecision, in light of the same the present petition is required to<br \/>\n\tbe disposed of and the same stands disposed of accordingly. The<br \/>\n\tparties to abide by the above cited decision.
