This appeal is by the NWKRTC, Hubli ea.ll:i1a_g~.._in<\/p>\n
question the compensation awarded by the  .<\/p>\n
respondentswclaimants.\n<\/p>\n
2. Learned counsei for the iaippveiliarit–‘C_orporation’<\/p>\n
submits that the MACT erred_ir_1 recording a fintling \u00b0tha~ti.the <\/p>\n
accident occurred due to theiifault by the_Co.r.poration bus
\ndriver and consequeiitly   could “not have<\/p>\n
awarded the amount towards ipeirma_.n.e’1:it:disability and loss<\/p>\n
of inco’rneiiid’u.r\u00a3fng  whienithe respondent continued
\nthe work andthere”‘:was\u00ab_no.,1of3s of employment even after the
\naccident. As suoh,’._thie_q’uantum also requires to be reduced.<\/p>\n
  On.._the other hand learned counsel for the<\/p>\n
Vitresppc-nderxta\u00e9rlaimant supported the award of the Tribunal by<\/p>\n
su3″j_1nit’tvin*g:_that’after retirement, the claimant would find it<\/p>\n
difi’ir:u1t__”toVi\u00ablget some employment and therefore award of<\/p>\n
 amount under the head of loss of permanent disability is<\/p>\n

3. Having thus heard both sides insofar as the<\/p>\n
accident is concerned, I am unable to agree <\/p>\n

Tribunal was that the bus  driven
\nby the driver concerned–…_d’ashiegd petitioner and
\nhis wife. Such stand   supported by
\nthe   on the finding
\nof   ior. So far quantum is
\nconcerklpt\ufb02”#15?\/.};a;ii?s  is iiistified in submitting that
\nthe Tribiinai’ granted compensation towards<\/p>\n
loss of–.permanent~disa’bi1ity and loss of income when the<\/p>\n
i\u00b0c]ain1ant7hirnself suhniits that he continues to Work without<\/p>\n
 1_oiss. of .Ve1np’Edy*-tnent or any loss of salary and when the<\/p>\n
accident  he was aged only 52 years. Under these<\/p>\n
  V’-circumstances, the question of awarding compensation<\/p>\n
 loss of future earning capacity in respect of<\/p>\n
respondent who happened to be an employee getting<\/p>\n

government salary, does not arise and so far as loss of<\/p>\n
income during treatment period is concerned, no doeiiment<\/p>\n
was produced by the claimant to show that helostii *<\/p>\n
during the period of treatment.   _<\/p>\n
4. Therefore, cornpensation awarded iwilirihvave to be r ‘<\/p>\n
reduced by disallowingpthe   loss of
\nincome during treatmen~i:andi.i: p1o:’ssVii. o’f.ipieir1nanent disability.<\/p>\n
In other words,  reduced by
\nR364, 173      Rs. 1,5e,673–, the
\nclaimant   E\u00e9s.9}.,500\/~\u00bb instead of
\nRs. 1,56,673 \/ i.  p  of the Tribunal
\nremains undisturbed; V i ii  <\/p>\n
