The said documents are taken on<br \/>\nrecord.\n<\/p>\n<p>2.\tMr.Variava, learned<br \/>\nadvocate and Mr.Jal Unwala, learned advocate submit that in view of<br \/>\nthe settlement arrived at between the parties during the execution<br \/>\nproceedings, the appellants &#8211; defendants have handed over the<br \/>\npossession of the suit property to the respondents &#8211; plaintiffs<br \/>\nand, therefore, cause of action does not survive in proceedings of<br \/>\nSecond Appeal.\n<\/p>\n<p>3.\tIn view of the said<br \/>\ncircumstances, Mr.Variava, learned advocate seeks permission to<br \/>\nwithdraw the Second Appeal.
