Learned A.G.P.<br \/>\n     for the appellant submitted that interim order dated<br \/>\n     21.10.1997 passed by the learned single Judge on special<br \/>\n     civil application no. 7803 of 1997 while issuing notice<br \/>\n     on it is stayed on civil application and during the<br \/>\n     pendency   and    final   disposal of this appeal, the<br \/>\n     respondent original petitioner has already reached the<br \/>\n     age of superannuation and also retired from service.<br \/>\n     However, as stated earlier, there is a sick note of Shri<br \/>\n     Raval for respondent no.       1 &#8211;
