Shri M K Sinha\n\n^                 Shri N N Roy\n\n CORAM:      Honble Shri Satish K Agnihotri J\n\n Dated:     15\/09\/2010\n\n: JUDGEMENT    \n<\/pre>\n<p>                        ORDER ORAL<\/p>\n<p>     WRIT PETITION UNDER ARTICLE 227 OF THE CONSTITUTION<br \/>\n                          OF INDIA<\/p>\n<p>  1.   By this petition, the petitioner seeks to quash<\/p>\n<p>       the order dated 14.05.2009 (Annexure P\/1) passed by<\/p>\n<p>       the  respondent No. 3, Additional  Collector,<\/p>\n<p>       Gariyaband whereby the Revenue Revision  Case<\/p>\n<p>       No.\/03\/B-121, year 2007-2008, has been dismissed<\/p>\n<p>       upholding the resolution dated 10.09.2007, passed by<\/p>\n<p>       the respondent No. 5, Gram Panchayat, Arand.\n<\/p>\n<p>2.   The facts, in nutshell, are that the respondent<br \/>\nNo. 5, Gram Panchayat Arand, issued a<br \/>\nnotification\/publication on 08.09.207 for allotment<br \/>\nof Government pond namely `Ganjha&#8217; on lease for<br \/>\nfishing as per policy of the government. In<br \/>\nresponse, four applications including that of the<br \/>\npetitioner and the respondent No. 7, were received.<br \/>\nA resolution was passed by the Gram Panchayat,<br \/>\nallotting the lease of the pond for fishing to the<br \/>\nrespondent No.7.. According to the petitioner, the<br \/>\nsaid proposal was not in accordance with law, and<br \/>\naccordingly, against the said resolution, the<br \/>\npetitioner preferred a revision before the<br \/>\nrespondent No. 3, praying for rejection of the<br \/>\nresolution passed by the Gram Panchayat. The said<br \/>\nrevision was rejected vide order dated 14.05.2009<br \/>\n(Annexure P\/1). However, in the meantime, the said<br \/>\nresolution was stay ed by the Additional Collector,<br \/>\nvide order dated 11.07.2007.\n<\/p>\n<p>3.   On perusal of the impugned order dated<br \/>\n14.05.2009 (Annexure P\/1), it is evident that the<br \/>\nrespondent No. 3 has held that the petitioner had<br \/>\nnot filed certified copy of the resolution dated<br \/>\n10.09.2007 and further, all the applicants who<br \/>\nparticipated for grant of lease, were not arrayed as<br \/>\nparty, thus, the revision was not maintainable and<br \/>\nthe same was dismissed. Consequently, the stay<br \/>\ngranted vide order dated 11.07.2007 was also<br \/>\nvacated.\n<\/p>\n<p>4.   According to learned counsel for the<br \/>\npetitioner, pursuant to the resolution, no specific<br \/>\norder of allotment of pond on lease to the<br \/>\nrespondent No. 7 has been passed. The resolution<br \/>\ncannot be subjected to judicial review as it is<br \/>\nsimple minutes of the proceeding.\n<\/p>\n<p>5.   The further contention of learned counsel for<br \/>\nthe petitioner that the Gram Panchayat may be<br \/>\ndirected to pass an order, is without any basis as<br \/>\nin a writ jurisdiction, where no specific order has<br \/>\nbeen passed on the basis of resolution, as<br \/>\naforestated, as the resolution is only the record of<br \/>\nthe proceedings of the meeting of Gram Panchayat, no<br \/>\ndirections can be issued by this Court. The Gram<br \/>\nPanchayat is competent to withdraw or to pass<br \/>\nsubsequent resolution modifying or withdrawing the<br \/>\nearlier one. In view of that, no direction can be<br \/>\nissued against the Gram Panchayat as prayed by the<br \/>\nlearned counsel for the petitioner.\n<\/p>\n<p>6.   This Court, in Khatbadan Singh Parihar v. State<br \/>\nof C.G. &amp; Others1, held that `resolution&#8217; is an<br \/>\nexpression of the opinion of the members who have<br \/>\ncome out to a unanimous conclusion but the<br \/>\n`resolution&#8217; by itself does not have the force of<br \/>\nlaw.\n<\/p>\n<p>7.   The Supreme Court, in <a href=\"\/doc\/1944204\/\">New India Assurance Co.<br \/>\nLtd. v. Nusli Neville Wadia &amp; Anr.2,<\/a> held that the<br \/>\nresolutions are mere guidelines and not controlled<br \/>\nby the statutory provisions.\n<\/p>\n<p>8.   In the instant case, after passing of the<br \/>\nresolution for allotment of Government pond namely<br \/>\nGanjha on lease to the respondent No. 7, the<br \/>\npetitioner preferred a revision before the<br \/>\nrespondent No. 3, without there being any specific<br \/>\norder or execution of any lease between the Gram<br \/>\nPanchayat and the respondent No. 7 which was<br \/>\nultimately dismissed by the respondent No. 3. Thus,<br \/>\nin absence of any specific order, the resolution, as<br \/>\naforestated, cannot be challenged.\n<\/p>\n<p>9.   Applying the well settled principles of law to<br \/>\nthe facts of the case on hand, the writ petition is<br \/>\ndevoid of merit and is accordingly dismissed.\n<\/p>\n<p>10.
