Advocate General<br \/>\n             for respondent No.5.\n<\/p>\n<p>                  Heard.\n<\/p>\n<p>                  The       impugned     order   dated    23.3.2010     is<br \/>\n             Annexure-P\/39 to the writ petition. It has been<br \/>\n             passed on behalf of Government of India. The solitary<br \/>\n             basis for passing that order refusing renewal of the<br \/>\n             recognition of the petitioner-college is mentioned in<br \/>\n             the paragraph 2 of that order which says that for the<br \/>\n             academic year 2009-2010, because of the strict time<br \/>\n             schedule approved by the Supreme Court of India in<br \/>\n             the case of Mridul Dhar and another Vs. Union of<br \/>\n             India and others, (2005) 2 SCC 65, renewal is being<br \/>\n             refused.\n<\/p>\n<p>             2. This order has been passed pursuant to the<br \/>\n               direction of this Court in this writ petition which<br \/>\n               was issued on 22.9.2009.\n<\/p>\n<p> 3.     A Division Bench of this Court while passing the<br \/>\nvery detailed order dated 22.9.2009 considered the<br \/>\ndecision of Mridul Dhar (supra) and directed that the<br \/>\ntime schedule fixed by the Supreme Court in that<br \/>\ndecision was being relaxed in this particular case.<br \/>\nThe High Court further directed in that order that<br \/>\nCentral Government would consider the report\/<br \/>\nrecommendation of the MCI and pass final orders by<br \/>\n29.9.2009. Another interim direction was issued<br \/>\nwhich is as follows:\n<\/p>\n<blockquote><p>        &#8220;In the meanwhile, the counseling Authority<br \/>\n        and the State of Madhya Pradesh will ensure<br \/>\n        that the petitioner College is allowed to<br \/>\n        participate in the counseling for admission to<br \/>\n        the MBBS seats in the petitioner College for<br \/>\n        the academic year 2009-2010 subject to the<br \/>\n        order that may be passed by the Central<br \/>\n        Government on the report of the MCI.&#8221;\n<\/p><\/blockquote>\n<p>4. This order was challenged before the Supreme<br \/>\n     Court which initially stayed the High Court&#8217;s order<br \/>\n     dated 22.9.2009 but later on declined to interfere<br \/>\n     and disposed of the appeal on 15.11.2010 saying<br \/>\n     that the matter is pending with the Union of India,<br \/>\n     which may pass appropriate orders in this regard.<br \/>\n   This direction of the Supreme Court amounts to<br \/>\n  approving the order dated 22.9.2009 which had<br \/>\n  also directed the decision to be taken by the<br \/>\n  Central     Government    after   considering    the<br \/>\n  report\/recommendation of the MCI.\n<\/p>\n<p>5. Thus, the Supreme Court refused to interfere with<br \/>\n  the order dated 22.9.2009 which had relaxed the<br \/>\n  time schedule on Mridul Dhar&#8217;s case (supra).\n<\/p>\n<p>6. The Union of India was a party to the writ petition<br \/>\n  and, therefore, the order of this Court dated<br \/>\n  22.9.2009      was   binding   upon    the   Central<br \/>\n  Government and has attained the finality after<br \/>\n  refusal of interference by the Supreme Court.\n<\/p>\n<p>7. It is, therefore, not open to the Union of India<br \/>\n  either to sit in appeal over the directions issued by<br \/>\n  the High Court in its order dated 22.9.2009 or to<br \/>\n  refuse to follow those directions by saying that<br \/>\n  although the High Court&#8217;s order which is binding<br \/>\n  upon the Union of India has relaxed the time<br \/>\n  schedule of Mridul Dhar&#8217;s case (supra) but Union<br \/>\n  of India will not follow the High Court&#8217;s order and<br \/>\n  stick to the time schedule of Mridul Dhar&#8217;s<br \/>\n  case(supra).\n<\/p>\n<p> 8. Therefore, the sole basis of the impugned order of<br \/>\n  the Central Government dated 23.3.2010 not being<br \/>\n  sustainable, the order is quashed. Obviously, as a<br \/>\n  result of quashing a fresh decision will have to be<br \/>\n  taken.\n<\/p>\n<p>9. It is not disputed by the learned counsel for the<br \/>\n  respondents that now after the amendment, the<br \/>\n  Central Government does not have the power of<br \/>\n  considering renewal and the power now stands<br \/>\n  vested in the Board of Governors. Accordingly, we<br \/>\n  direct Board of Governors to pass a reasoned order<br \/>\n  in this matter in the light of the order of this Court<br \/>\n  dated 22.9.2009 within one month from the date<br \/>\n  on which the certified copy of this order is<br \/>\n  presented   before   the   Chairman    of   Board   of<br \/>\n  Governors. For the convenience of the Board of<br \/>\n  Governors, the petitioner will submit a certified<br \/>\n  copy of this order and also submit a certified copy<br \/>\n  of the order dated 22.9.2009.\n<\/p>\n<p>10. We may also mention here, for the sake of<br \/>\nclarification only, that because there is already a<br \/>\ndirection quoted above in the order of this Court<br \/>\ndated 22.9.2009 with regard to the students who are<br \/>\n         admitted through the cosunseling to the academic<br \/>\n        session in question, and as a result of this order, the<br \/>\n        matter again becomes pending before the Central<br \/>\n        Government or more appropriately its successor i.e,<br \/>\n        the   Board   of   Governors,   therefore,   no   further<br \/>\n        direction is required to be passed with regard to that<br \/>\n        issue.\n<\/p>\n<p>        11.
