Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/09\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            W.P.(C).No. 18024      OF 2009\n            ===========================\n\n    Dated this the 17th day of September,2009\n\n                       JUDGMENT\n<\/pre>\n<p>    The Writ Petition is filed for a direction to<\/p>\n<p>respondents 2 to 4, to arrest     fifth respondent the<\/p>\n<p>accused in C.C.1129\/2000 on the file of Judicial First<\/p>\n<p>Class Magistrate-II contending that inspite of the non-<\/p>\n<p>bailable warrant issued, fifth respondent is not being<\/p>\n<p>arrested.\n<\/p>\n<p>    2.   In  view  of  the  allegation  raised  in  the<\/p>\n<p>petition, report was called from Judicial First Class<\/p>\n<p>Magistrate, Ernakulam whether non-bailable warrant is<\/p>\n<p>pending.   The report received discloses that a non-<\/p>\n<p>bailable warrant was issued to the petitioner himself<\/p>\n<p>on  his  request  on  20.5.2005  and  the  non-bailable<\/p>\n<p>warrant was not returned and thereafter     no further<\/p>\n<p>non-bailable warrant was issued by the court.   In such<\/p>\n<p>circumstance,petitioner is not entitled to allege non<\/p>\n<p>action on the part of the police officer.   Petition is<\/p>\n<p>bereft of bonafides.
