Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/07\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.1318 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner is the accused and first respondent<\/p>\n<p>the complainant in C.C.No.6\/2008 on the file of<\/p>\n<p>Judicial   First   Class   Magistrate&#8217;s   Court-II,<\/p>\n<p>Kottayam. Case of the first respondent in Annexure-<\/p>\n<p>A complaint is that his name, as an accused person,<\/p>\n<p>was   included   in   the   charge   sheet    after<\/p>\n<p>pronouncement of the judgment in C.C.No.689\/1998 by<\/p>\n<p>Judicial First Class Magistrate-I, Kottayam and in<\/p>\n<p>that  case   investigation   was   based   on   the<\/p>\n<p>information  furnished   by  the   petitioner   and<\/p>\n<p>allegations  in   that  case   against  the   first<\/p>\n<p>respondent  are  totally  false  and  baseless  and<\/p>\n<p>petitioner and first respondent had to face trial<\/p>\n<p>for offences under Sections 341, 294(b) and 506(1)<\/p>\n<p>read with Section 34 of Indian Penal Code and<\/p>\n<p>learned  Magistrate,  under  Annexure-B   judgment,<\/p>\n<p>acquitted him and while the case was in progress,<\/p>\n<p><span class=\"hidden_text\">CRMC 1318\/09               2<\/span><\/p>\n<p>first respondent had to stand in the witness dock<\/p>\n<p>as an accused and it gave impression to the people<\/p>\n<p>that he committed heinous and shameful crime and it<\/p>\n<p>affected his reputation and spoiled his image and<\/p>\n<p>in such circumstances, petitioner committed the<\/p>\n<p>offence under Section 499 punishable under Section<\/p>\n<p>500 of Indian Penal Code. This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure to<\/p>\n<p>quash   Annexure-A   complaint and  the  proceedings<\/p>\n<p>taken therunder.\n<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and first respondent were heard.\n<\/p>\n<p>    3.     As rightly pointed out by learned counsel<\/p>\n<p>appearing for the petitioner, the allegations in<\/p>\n<p>Anenxure-A complaint, even if accepted in toto, do<\/p>\n<p>not make out an offence under Section 499 which is<\/p>\n<p>punishable under Section 500 of Indian Penal Code.<\/p>\n<p>Even the entire case in Annexure-A complaint is<\/p>\n<p>accepted, because of enmity and grudge, at the<\/p>\n<p>instance of the petitioner, police submitted a<\/p>\n<p><span class=\"hidden_text\">CRMC 1318\/09              3<\/span><\/p>\n<p>charge sheet roping the petitioner also as an<\/p>\n<p>accused.    Even though first respondent is innocent<\/p>\n<p>and he has to stand as an accused for several years<\/p>\n<p>and by standing in the accused dock, some people<\/p>\n<p>gathered there had the impression that he is a<\/p>\n<p>criminal and it affected his reputation, at best,<\/p>\n<p>it can be said that case of the first respondent is<\/p>\n<p>that he was maliciously prosecuted at the instance<\/p>\n<p>of the petitioner. But, that does not mean that<\/p>\n<p>first respondent committed an offence under Section<\/p>\n<p>499 of Indian Penal Code.     In the absence of an<\/p>\n<p>allegation that petitioner, by words, either spoken<\/p>\n<p>or intended to be read or by signs or by visible<\/p>\n<p>representations made or published any imputation<\/p>\n<p>concerning the first respondent, intended to harm<\/p>\n<p>or knowing or having reason to believe that such<\/p>\n<p>imputation will harm the reputation of the person,<\/p>\n<p>petitioner cannot be prosecuted for the offence<\/p>\n<p>under     Section  499   of   Indian   Penal   Code.<\/p>\n<p>Continuation of the proceedings is clearly an abuse<\/p>\n<p><span class=\"hidden_text\">CRMC 1318\/09              4<\/span><\/p>\n<p>of process of the Court.\n<\/p>\n<p>     Petition is, therefore, allowed.
