Raval,  learned APP appears and waives service of  notice of<br \/>\nRule on behalf of the Respondent  &#8211; State of Gujarat.\n<\/p>\n<p>3\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>4\tThe<br \/>\napplicant-convict prisoner, who, vide judgment and order dated<br \/>\n22.7.2005,  rendered in Sessions Case No. 176 of 2003, by the learned<br \/>\nAdditional Sessions Judge, Fast Track Court No.4,  Vadodara,  has<br \/>\nbeen convicted for the offence punishable under Section 302  of the<br \/>\nIndian Penal Code and sentenced to imprisonment for life, has filed<br \/>\nthis application under Section  389(1) of the Code of Criminal<br \/>\nProcedure, through  his wife  Anitaben Dilipbhai Thakur,  praying to<br \/>\nenlarge the applicant  on temporary bail for a period of  30 days to<br \/>\nenable him to remain present  at the time of operation  of his<br \/>\ndaughter, which is scheduled on 13.10.2010, who is suffering from<br \/>\nrenal stone, infection in urine  and kidney.\n<\/p>\n<p>5\tWe<br \/>\n have considered the submissions advanced by Mrs. Subhadra G. Patel,<br \/>\nlearned Advocate for the applicant and Mr. K.P. Raval, learned APP<br \/>\nfor the respondent &#8211; State of Gujarat.  We have also perused the<br \/>\naverments made in the application and the supporting document that<br \/>\nform part of the application. We have also gone through the jail<br \/>\nremarks  sheet  submitted by learned APP  during the course of<br \/>\nsubmission.\n<\/p>\n<p>6\tUpon<br \/>\nperusal of the jail remarks sheet, we have noticed that   the<br \/>\napplicant has  undergone imprisonment of total period of 6 years, 02<br \/>\nmonths and 26 days.  During  the said period, he has enjoyed  parole<br \/>\nleave on six times  granted by the District Magistrate, Vadodara. He<br \/>\nwas  also  released  on temporary bail  on two occasions  and also<br \/>\nenjoyed furlough leave  on two occasions.  Almost on all the<br \/>\noccasions i.e. either on temporary bail  or parole or furlough leave,<br \/>\nthe applicant was released  on the ground of  ailment of his wife and<br \/>\nhis daughter. On all the occasions, he has surrendered in time,<br \/>\nexcept on one occasion  he surrendered late by 185 days.    Further,<br \/>\non perusal of the  certificate dated 6.10.2010   issued by Dr.<br \/>\nVoijoykumar Singh,  General Surgeon, Vadodara,  we have noticed that<br \/>\nhis daughter  Puja  is suffering from  renal stone and infection in<br \/>\nurine and kidney.  Her operation is scheduled on 13.10.2010.<br \/>\nTherefore, according to us, in view of this,  if the applicant is<br \/>\nreleased on temporary bail  for a period of 15 days from the date of<br \/>\nhis actual release,   the same would meet the ends of justice.\n<\/p>\n<p><span class=\"hidden_text\">6\t<\/span><\/p>\n<p>\tFor the foregoing reasons, the Application succeeds   in part and<br \/>\naccordingly it is partly allowed.  The applicant &#8211; convict &#8211;\n<\/p>\n<pre> DILIP KEHRILAL THAKUR    is\nordered\n<\/pre>\n<p>to be released on temporary bail for a period of 15 days from the<br \/>\ndate of his  actual release on  executing  a personal bond of Rs.<br \/>\n5,000\/-  before the Jail Authority on usual terms and conditions.<br \/>\nThe applicant shall surrender to the jail authority on completion of<br \/>\n15 days  from the date of his  release without fail.  During the<br \/>\nperiod of temporary bail, the applicant shall not abuse  the liberty<br \/>\ngranted to him and shall maintain law and order.\n<\/p>\n<p>7\t\tRule<br \/>\nis made absolute accordingly to the aforesaid extent.
