Justice S.S.SATHEESACHANDRAN\n\n Dated :22\/02\/2010\n\n O R D E R\n                    S.S.SATHEESACHANDRAN, J\n                    -------------------------------------\n                      C.R.P No.485 OF 2008\n                      --------------------------------\n             Dated this the 22nd day of February 2010\n\n                                 ORDER\n<\/pre>\n<p>           Revision is directed against the order awarding<\/p>\n<p>enhanced compensation to the claimant in O.P(Ele.) No.118 of<\/p>\n<p>2003 towards the loss and injury suffered by the drawing of<\/p>\n<p>overhead lines through her property by the K.S.E.B, hereinafter<\/p>\n<p>referred to a the Board. The Board, for the purpose of drawing<\/p>\n<p>Punnapra-Edathua 110 KV line, cut and removed some trees from<\/p>\n<p>the   property    of  the      claimant\/respondent,          and towards<\/p>\n<p>compensation thereof, a sum of Rs.11,820\/- was fixed and paid.<\/p>\n<p>Dissatisfied with the quantum of compensation, the claimant<\/p>\n<p>preferred the O.P seeking enhanced compensation. The Board<\/p>\n<p>resisted   that    application        contending         that  reasonable<\/p>\n<p>compensation has already been paid.               In the enquiry, no oral<\/p>\n<p>evidence was adduced. An advocate commissioner deputed by<\/p>\n<p>the court, after conducting a local inspection filed a report. After<\/p>\n<p>examining the materials produced and hearing the counsel, the<\/p>\n<p>court  below    awarded      a    sum      of    Rs.761\/-    as enhanced<\/p>\n<p>compensation towards the yielding pepper-vines cut and removed<\/p>\n<p>from the property of the claimant.              The amount awarded as<\/p>\n<p>compensation is meagre and no interference thereof is warranted.<\/p>\n<p>C.R.P No.485 OF 2008              Page numbers<\/p>\n<p>Over and above, the above sum fixed as enhanced compensation<\/p>\n<p>towards the      pepper-vines cut and removed, the court below on<\/p>\n<p>the basis of the commission report found that 8 cents out of the<\/p>\n<p>22.20 cents of the property of the claimant through which the<\/p>\n<p>lines were drawn had been injuriously affected and that area<\/p>\n<p>suffered diminution of land value. Fixing the centage value of the<\/p>\n<p>property at Rs.10,000\/-, the court below has determined the<\/p>\n<p>diminution of land value at 30%. Though the learned counsel for<\/p>\n<p>the Board contended that the value fixed and the percentage of<\/p>\n<p>injurious    affection  determined   are   excessive,  I  find, no<\/p>\n<p>interference thereof is warranted. Commissioner has reported the<\/p>\n<p>advantages and disadvantages of the property, and taking note of<\/p>\n<p>the relevant factors applicable, the learned District Judge has<\/p>\n<p>fixed the centage value and also determined the percentage of<\/p>\n<p>diminution of land value. Some arbitrariness in fixation of land<\/p>\n<p>value and also percentage of diminution in such cases is<\/p>\n<p>inescapable.     Interference with such fixation is called for only<\/p>\n<p>where it is shown that the value fixed is totally unreasonable and<\/p>\n<p>not based on any material.        Compensation awarded towards<\/p>\n<p>diminution of land value after holding that 8 cents in the property<\/p>\n<p>of the claimant had been affected to the extent of 30% is only<\/p>\n<p>Rs.24,000\/-.      The total amount of enhanced compensation<\/p>\n<p>awarded by the court below is Rs.24,761\/- which was directed to<\/p>\n<p>C.R.P No.485 OF 2008             Page numbers<\/p>\n<p>be paid with 6% interest per annum from the date of cutting of<\/p>\n<p>trees till realisation.   There is nothing to indicate that the<\/p>\n<p>compensation so awarded is unreasonable, but, on the contrary, it<\/p>\n<p>is shown to be just and adequate.
