V.A. Muhammed, the learned counsel appearing for the<\/p>\n<p>petitioner and Sri. A.J.Varghese, the learned Government Pleader<\/p>\n<p>appearing for respondents 1 to 3. In the nature of the order that I<\/p>\n<p>propose to pass, it is not necessary to issue notice to or hear the fourth<\/p>\n<p>respondent.\n<\/p>\n<p>      2. The petitioner is a teacher in the fourth respondent&#8217;s school. He<\/p>\n<p>was placed under suspension pending disciplinary action by Ext.P1 order<\/p>\n<p>dated 25.7.2008     for a period of 15 days.      The Manager thereafter<\/p>\n<p>sought the permission of the District Educational Officer to continue in<\/p>\n<p>suspension beyond 15 days. Such permission was granted by Ext.P2<\/p>\n<p>order dated 7.8.2008. It appears that the Manager thereafter moved the<\/p>\n<p>Deputy Director of Education in revision, who by Ext.P4 order passed on<\/p>\n<p>12.1.2009 permitted the Manager to continue the suspension till the<\/p>\n<p>disciplinary proceedings are finalised. It appears that the disciplinary<\/p>\n<p>enquiry has already been held and report of enquiry submitted.          The<\/p>\n<p>petitioner has aggrieved by Ext.P4, filed Ext.P6 revision petition before<\/p>\n<p>the Secretary to Government, General Education Department. He submits<\/p>\n<p>that as the enquiry against him has already been completed, there is no<\/p>\n<p>reason to continue him under suspension and that all that the Manager<\/p>\n<p>has to do is to finalise the disciplinary proceedings. In this Writ Petition<\/p>\n<p><span class=\"hidden_text\">WP(C) 8684\/09                       -: 2 :-<\/span><\/p>\n<p>the petitioner inter alia seeks a direction to the Secretary to Government,<\/p>\n<p>General Education Department to pass orders on Ext.P6 revision petition<\/p>\n<p>after affording him an opportunity of being heard.<\/p>\n<p>      3. Ext.P4 order, which is impugned in Ext.P6 revision petition<\/p>\n<p>discloses that the disciplinary enquiry against the petitioner has already<\/p>\n<p>been held and report of enquiry received by the Manager. The petitioner<\/p>\n<p>was placed under suspension on 25.7.2008. Nearly eight months have<\/p>\n<p>passed thereafter. In these circumstances, the Secretary to Government,<\/p>\n<p>General Education Department has to consider whether continuance of<\/p>\n<p>the suspension is warranted.\n<\/p>\n<p>      4. Accordingly I dispose of this Writ Petition with a direction to the<\/p>\n<p>Secretary to Government, General Education Department to consider<\/p>\n<p>Ext.P6 revision petition and pass orders thereon after affording the<\/p>\n<p>petitioner and the fourth respondent an opportunity of being heard.<\/p>\n<p>Final orders in the matter shall be passed within six weeks from the date<\/p>\n<p>on which the petitioner produces a certified copy of this judgment.
