Justice A.K.BASHEER\n\n Dated :15\/07\/2008\n\n O R D E R\n                H.L.DATTU, C.J. &amp; A.K.BASHEER, J.\n               ------------------------------------------------------\n         S.T.Rev.No.98 of 2005 &amp; C.M.Appln.No.179 of 2005\n                   ---------------------------------------------\n                  Dated, this the 15th day of July, 2008\n\n                                   O R D E R\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>              State being aggrieved by the orders passed by the Kerala<\/p>\n<p>Sales Tax Appellate Tribunal, Additional Bench, Thiruvananthapuram<\/p>\n<p>in T.A.No.284 of 1999 dated 22-11-2000 is before us in this revision<\/p>\n<p>petition.\n<\/p>\n<p>              (2) In filing the revision petition there is a delay of 1246<\/p>\n<p>days. To condone the said delay, C.M.Appln.No.179 of 2005 is filed<\/p>\n<p>under section 5 of the Limitation Act. Along with the said application a<\/p>\n<p>printed affidavit is filed before us. In the said affidavit except stating<\/p>\n<p>that the papers were moving from table to table and person to person, no<\/p>\n<p>other explanation is offered by the revenue for the delay in filing the<\/p>\n<p>revision petition.\n<\/p>\n<p>              (3) The explanation offered by the petitioner for<\/p>\n<p>condonation of the delay in filing the Sales Tax Revision case is wholly<\/p>\n<p>unsatisfactory. Therefore, the delay in filing the revision petition cannot<\/p>\n<p>be condoned by us.
